No shame upon that, except jam band fans tend to be mellow and despite being an octogenarian and the ranking Democrat member of the House Appropriations Committee, she seems a little more Rage Against the Machine-centric than anything else.<\/p>\n<p>On Monday, she had an exchange with <a href=\"https:\/\/www.westernjournal.com\/trumps-epa-head-lee-zeldin-needs-to-undo-the-endangerment-finding\/\" target=\"_blank\" rel=\"noopener\">Lee Zeldin<\/a>, administrator of the Environmental Protection Agency, about regulatory authority. DeLauro.<\/p>\n<p>\u201cMaybe others are not, I\u2019m not,\u201d she said. But let me ask \u2026\u201d<\/p>\n<p>Zeldin cut in.<\/p>\n<p>\u201cThat\u2019s really important as a member of Congress,\u201d he said. \u201cLoper Bright says that we as an agency don\u2019t have the authority to get creative if Section 202 of the Clean Air Act.\u201d<\/p>\n<p>DeLaurao wasn\u2019t apparently listening.<\/p>\n<p>\u201cNo, no \u2014 but you do not have \u2014 excuse me! You do <em>not<\/em> have the right to say climate change doesn\u2019t exist! That it\u2019s a hoax! And that\u2019s where this administration is coming from!\u201d DeLauro shouted.<\/p>\n<p>Zeldin was calm, but he was clearly disdainful of a lawmaker who knew so little about the law she was arguing.<\/p>\n<p>\u201cI understand you\u2019re upset. You don\u2019t know what Loper Bright is,\u201d he said. \u201cDo you know what the major questions doctrine is? You\u2019re a member of Congress, you should know \u2026 do you want me to tell you what the two biggest Supreme Court cases are of the last few years?\u201d<\/p>\n<p>She did not, and she said she was sick of \u201cthis BS.\u201d Oh snaps.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">DeLauro gets fed up with Lee Zeldin\u2019s arrogance and condescension: \u201cYou do not have the right to say climate change does not exist, that it\u2019s a hoax! Americans, including Lee Zeldin, do have a <em>right<\/em> to say whatever they want, so long as it is not legally libelous, defamatory or inciting immediate violence.<\/p>\n<p>I have a <em>right<\/em> to say that I not only think Bigfoot exists, but that he is actually <a href=\"https:\/\/www.westernjournal.com\/flat-lying-db-cooper-hijacking-case-just-got-new-plot-twist\/\" target=\"_blank\" rel=\"noopener\">D.B. Cooper<\/a>. I have a <em>right<\/em> to say Joey Buttafuoco should be appointed ambassador to <a href=\"https:\/\/www.westernjournal.com\/ap-croatia-back-on-track-beats-wales-2-1-in-euro-qualifier\/\" target=\"_blank\" rel=\"noopener\">San Marino<\/a>. I have a <em>right<\/em> to say that the designated hitter rule is a tool of Satan. This is true whether I\u2019m just some random writer joking around on an article, as I am here, or whether I\u2019m the administrator of the EPA. (But seriously for a second: The DH does have a whiff of the demonic about it, no?)<\/p>\n<p>When a Democrat specifically talks about what you have the \u201cright\u201d to say, your ears should perk up: This is not just a slip of the tongue but the thought police coming out and saying that you cannot be a \u201cdenier,\u201d as if climate change were the Holocaust and we had laws against this sort of thing (which we don\u2019t).<\/p>\n<p>However, I\u2019m burying the substance here, because what everyone seemed to miss is that the ranking Democrat on the House Appropriations Committee went into a subcommittee hearing with the EPA head and didn\u2019t seem to know how the Supreme Court cases of <a href=\"https:\/\/www.westernjournal.com\/supreme-court-hears-cases-cut-federal-bureaucracy-off-knees\/\" target=\"_blank\" rel=\"noopener\">Loper Bright Enterprises v. Raimondo<\/a> or West Virginia v. Environmental Protection Agency affected Section 202 of the Clean Air Act.<\/p>\n<p>This is a pretty simple thing to explain: Section 202 of the Clean Air Act authorizes the EPA to set emissions standards for motor vehicles. The 2024 Loper Bright decision, however, significantly curtailed the authority of regulatory agencies to set these sorts of things by fiat, in this case involving a rule set by the National Marine Fisheries Service.<\/p>\n<p>It also overruled a previous decision, Chevron v. Natural Resources Defense Council, and declared that the Supreme Court and lower courts should not defer to federal agency interpretations of the law, as <a href=\"https:\/\/www.oyez.org\/cases\/2023\/22-451\" target=\"_blank\" rel=\"noopener\">Oyez<\/a> notes. Instead, it strengthened the so-called \u201c<a href=\"https:\/\/www.law.cornell.edu\/wex\/major_questions_doctrine\" target=\"_blank\" rel=\"noopener\">major questions doctrine<\/a>,\u201d in which major decisions about policy must be made by elected members of Congress, accountable to voters, not by bureaucrats staffing the administrative state.<\/p>\n<p>In <a href=\"https:\/\/www.oyez.org\/cases\/2021\/20-1530\" target=\"_blank\" rel=\"noopener\">West Virginia v. EPA<\/a>, decided two years earlier, the court ruled that greenhouse gas emissions were not specifically covered under the Clean Air Act.<\/p>\n<p>By deductive reasoning, therefore, what DeLauro was ranting about \u2014 the EPA not <a href=\"https:\/\/amzn.to\/3YuVZYV\" >setting greenhouse gas emission standards<\/a> for motor vehicles because it lacks the regulatory authority to do so under the Clean Air Act, as explicitly stated in two separate Supreme Court decisions \u2014 was something she was also in the wrong about.<\/p>\n<p>This is true no matter how severe or mild or nonexistent climate change may or may not be. Nobody has to weigh in on that, because what she is advocating for is unconstitutional and illegal. It\u2019s a non-issue.<\/p>\n<p>She\u2019s wrong. Period. End of story. Finito.<\/p>\n<p>But then, why should we be surprised? She\u2019s 83 and was in the wrong about the First Amendment, too.<\/p>\n<p>But boy, she was certainly <em>loudly<\/em> in the wrong about it! She sure showed that guy who was correct who\u2019s boss! <em>And<\/em> her hair is purple, too!<\/p>\n<p>These are the people the Democrats want you to believe are the <a href=\"https:\/\/www.westernjournal.com\/chris-murphy-backtracks-sarcasm-cheering-iran-isnt-first-time-reprehensible-words-come-back-haunt\/\" target=\"_blank\" rel=\"noopener\">Responsible Adults in the Room\u2122<\/a>.
