The article claims Democrats and their allies opposed and challenged that rule, leading a judge to delay most provisions and Senate Democrats to back legislation that would overturn it.<\/p>\n<p>it frames the upcoming repayment problem as a \u201cmanufactured crisis\u201d that Democrats will criticize rhetorically once it becomes politically salient, despite the author\u2019s assertion that Democrats previously blocked measures aimed at preventing the underlying fraud and eligibility errors.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>Sixteen years ago, as Democrats prepared to enact Obamacare, then-House Speaker Nancy Pelosi, D-Calif., infamously <a href=\"https:\/\/www.youtube.com\/watch?v=hV-05TLiiLU\" target=\"_blank\" rel=\"noreferrer noopener\">claimed<\/a>, \u201cWe have to pass the bill so that you can find out what\u2019s in it.\u201d Pelosi\u2019s comments may ring true next spring, when Americans of modest means may face the prospect of repaying thousands of dollars in Obamacare subsidies, thanks to a series of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/inflation-is-hitting-voters-who-will-decide-some-key-midterm-races-the-hardest\/\" title=\"Inflation Is Hitting Voters Who Will Decide Some Key Midterm Races the Hardest\">policy choices made<\/a> by Democrats over the years.<\/p>\n<h2><strong>Fraud from Misstating Income<\/strong><\/h2>\n<p>Last August, the Congressional Budget Office (CBO) released an <a href=\"https:\/\/www.cbo.gov\/system\/files\/2025-08\/61506-marketplace.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">analysis<\/a> estimating that 2.3 million Exchange enrollees \u201cimproperly claimed\u201d Obamacare subsidies \u201cvia intentional overstatement of income\u201d in 2025. CBO specifically examined the number of enrollees who claimed income just above the poverty level because, in most cases, households with incomes below the poverty level do not qualify for premium subsidies. <\/p>\n<p>Through last year, overstating income to qualify for subsidies constituted a rational choice. Households could receive a subsidy that in 2025 <a href=\"https:\/\/www.cbo.gov\/system\/files\/2024-06\/51298-2024-06-healthinsurance.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">averaged<\/a> just over $6,000 per person. Even if such households\u2019 actual income did not equal their estimated earnings, and their below-poverty income made them ineligible for subsidies entirely, the law capped <a href=\"https:\/\/www.irs.gov\/pub\/irs-drop\/rp-24-40.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">maximum repayments<\/a> for such households at $375 for a single individual and $750 for a household. Enrollees could thus come out thousands of dollars ahead by inflating their income to qualify for subsidies, since they would have to repay only a small portion of those subsidies if they were found ineligible after the fact.<\/p>\n<p>The <a href=\"https:\/\/wordpress.juniperresearchgroup.com\/wp-content\/uploads\/2025\/08\/BBB-Summary.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">budget reconciliation bill<\/a> Congress passed last year eliminated the repayment caps, requiring enrollees to pay back every dollar of ineligible subsidies they receive. This provision takes effect with the 2026 tax and plan years, meaning it will first affect filers next spring, as they file their 2026 tax returns.<\/p>\n<h2><strong>Prevent Improper Enrollment<\/strong><\/h2>\n<p>Rather than requiring individuals with income below the poverty level to pay back thousands of dollars in <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/joe-biden-who-dodged-obamacare-taxes-now-proposes-expanding-obamacare-2\/\" title=\"Joe Biden, Who Dodged Obamacare Taxes, Now Proposes Expanding Obamacare\">federal insurance subsidies<\/a>, a more prudent approach would be to screen applicants more carefully to prevent ineligible individuals from receiving subsidies in the first place. A <a href=\"https:\/\/www.federalregister.gov\/documents\/2025\/06\/25\/2025-11606\/patient-protection-and-affordable-care-act-marketplace-integrity-and-affordability\" target=\"_blank\" rel=\"noreferrer noopener\">program integrity rule<\/a> finalized by the Trump administration last June would have done just that. The rule imposed minimum premium payments on households that do not verify their income every year, required Exchange enrollees to file taxes annually to verify whether households received the correct amount of subsidies, and required additional verification for special enrollment periods.<\/p>\n<p>But Democrats have worked to stop these common-sense anti-fraud measures. A group of Democrat cities and interest groups filed suit against the program integrity rule. Last August, a federal judge issued an <a href=\"https:\/\/caselaw.findlaw.com\/court\/us-dis-crt-d-mar\/117643916.html\" target=\"_blank\" rel=\"noreferrer noopener\">opinion<\/a> that prevented <a href=\"https:\/\/www.cms.gov\/files\/document\/columbus-kennedy-impacts.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">most of its provisions<\/a> from going into effect during the open enrollment period in late 2025 and early 2026. Likewise, all 47 Senate Democrats <a href=\"https:\/\/www.senate.gov\/legislative\/LIS\/roll_call_votes\/vote1192\/vote_119_2_00008.htm\" target=\"_blank\" rel=\"noreferrer noopener\">voted for<\/a> a <a href=\"https:\/\/www.congress.gov\/bill\/119th-congress\/senate-joint-resolution\/84\/text?s=1&#038;r=2\" target=\"_blank\" rel=\"noreferrer noopener\">resolution<\/a> sponsored by Sen. Mark Warner, D-Va., that would have overturned the program integrity rule entirely.<\/p>\n<h2><strong>Democrats\u2019 Manufactured \u2018Crisis<\/strong>\u2018<\/h2>\n<p>When ineligible households receive large bills to repay their subsidies during next year\u2019s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/report-irs-to-stop-using-face-recognition-tech-following-backlash\/\" title=\"Report: IRS to Stop Using Face-Recognition Tech Following Backlash\">tax filing season<\/a>, Democrats will undoubtedly object, notwithstanding that their fingerprints will be all over this \u201ccrisis.\u201d They opposed steps to prevent ineligible individuals from enrolling before they <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/how-politico-propagandists-use-corruption-to-hide-ignorance\/\" title=\"How Politico Propagandists Use Corruption To Hide Ignorance\">receive taxpayer subsidies<\/a>. They oppose work requirements that might <a href=\"https:\/\/thefederalist.com\/2024\/03\/18\/mississippis-work-requirement-for-medicaid-is-just-an-excuse-to-expand-the-welfare-state\/\" target=\"_blank\" rel=\"noreferrer noopener\">raise households\u2019 income<\/a> above the poverty level, enabling them to qualify for Exchange subsidies. Indeed, individuals below the poverty level do not qualify for Exchange subsidies because, when writing Obamacare in 2009 and 2010, Democrats intended to shoehorn all such individuals into state Medicaid programs \u2014 that is, until the Supreme Court <a href=\"https:\/\/tile.loc.gov\/storage-services\/service\/ll\/usrep\/usrep567\/usrep567519\/usrep567519.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">struck down that move<\/a> as an unconstitutional dragooning of states.<\/p>\n<p>The welfare-industrial complex spent most of this past fall <a href=\"https:\/\/thefederalist.com\/2025\/09\/30\/chuck-schumer-has-no-leverage-in-the-shutdown-showdown\/\" target=\"_blank\" rel=\"noreferrer noopener\">shutting down the government<\/a> and, in the process, blaming Republicans for a health care \u201ccrisis\u201d created by Democrats.
