Supporters argue the policy is meant to address the larger reality that homelessness has decreased overall in the state,but the number of people living directly on the streets has risen,creating ongoing health and safety crises.<\/p>\n<p>Critics and advocacy groups strongly oppose the bill, using charged comparisons to past systems of racial oppression and punishment (including rhetoric likening it to Jim Crow, debtors\u2019 prisons, and other ancient injustices). The article counters that these reactions do not match the actual design of the proposals, pointing to similar measures enacted elsewhere and arguing that most affected individuals are not simply funneled into jail.<\/p>\n<p>It further claims the bill provides a \u201cpathway out\u201d of the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/president-trump-please-pardon-jon-woods-a-victim-of-process-crimes-like-michael-flynn\/\" title=\"President Trump, Please Pardon Jon Woods, a Victim of Process Crimes Like Michael Flynn\">criminal justice system<\/a> by requiring participation in treatment for underlying behavioral health issues, while allowing courts discretion and diversion rather than purely punitive outcomes. The piece notes rising levels of addiction among people living on the street and argues that treatment access should not be limited only to those who are already ready to accept it. It describes how \u201chomeless courts\u201d and specialized dockets typically operate to connect people with services while still holding more culpable offenders accountable.<\/p>\n<p>the article argues that participants are asked to engage with services and, when possible, contribute modestly toward costs or through community service, emphasizing dignity and self-sufficiency. It concludes that the approach is framed as a balance of accountability and compassion, with potential benefits for both individuals living on the streets and the communities around them.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>Lawmakers in Louisiana are weighing new policies that align with the vision for addressing America\u2019s homelessness crisis outlined by <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/07\/ending-crime-and-disorder-on-americas-streets\/\" target=\"_blank\" rel=\"noreferrer noopener\">President Donald Trump last summer<\/a>. This approach breaks with a misguided, decades-old national practice of <a href=\"https:\/\/amzn.to\/3YuVZYV\" >offering homeless people publicly funded support<\/a> without also asking them to help themselves. In response, outraged activists have compared Louisiana\u2019s proposals to nothing less than the Jim Crow laws that mandated racial segregation in the era before the 1964 Civil Rights Act.<\/p>\n<p>In a statement about the Louisiana bill, the activist coalition <a href=\"https:\/\/housingnothandcuffs.org\/2026\/04\/16\/statement04162026\/\" target=\"_blank\" rel=\"noreferrer noopener\">Housing Not Handcuffs referenced<\/a> \u201cchain gangs\u201d and \u201centrenched white supremacy.\u201d The <a href=\"https:\/\/x.com\/homeless_law\/status\/2044838531315470845\" target=\"_blank\" rel=\"noreferrer noopener\">National Homelessness Law Center declared<\/a> that the bill evokes \u201cdebtors\u2019 prisons, convict leasing, and Jim Crow.\u201d Other activists <a href=\"https:\/\/www.youtube.com\/watch?v=OJhrsV0kZRs\" target=\"_blank\" rel=\"noreferrer noopener\">compared the bill<\/a> to slavery.<\/p>\n<p>What monstrous policy could justify such over-the-top comparisons? Apparently, one that merely prohibits homeless people from sleeping on the streets and offers them treatment and services in lieu of criminal adjudication.<\/p>\n<h2>States\u2019 Crisis<\/h2>\n<p>Like many states, Louisiana is not experiencing a homelessness crisis as much as an <em>unsheltered <\/em>homelessness crisis. Homelessness has actually <a href=\"https:\/\/www.hudexchange.info\/programs\/coc\/coc-homeless-populations-and-subpopulations-reports\/?filter_Year=&#038;filter_Scope=State&#038;filter_State=LA&#038;filter_CoC=&#038;program=CoC&#038;group=PopSub\" target=\"_blank\" rel=\"noreferrer noopener\">decreased by 34 percent overall<\/a> statewide, but those improvements have not helped homeless people who live on the streets instead of in shelter. The share of homeless people in Louisiana who are living physically on the streets <a href=\"https:\/\/www.hudexchange.info\/programs\/coc\/coc-homeless-populations-and-subpopulations-reports\/?filter_Year=&#038;filter_Scope=State&#038;filter_State=LA&#038;filter_CoC=&#038;program=CoC&#038;group=PopSub\" target=\"_blank\" rel=\"noreferrer noopener\">rose by 50 percent<\/a> over that same period.<\/p>\n<p>Louisiana state Rep. Debbie Villio\u2019s bill, <a href=\"https:\/\/legis.la.gov\/legis\/ViewDocument.aspx?d=1460671\" target=\"_blank\" rel=\"noreferrer noopener\">House Bill 211<\/a>, aims to address this subpopulation specifically by giving people in encampments a choice between shelter, treatment, or the criminal justice system.\u00a0Communities around the country \u2014 from San Francisco to Austin and Salt Lake City to Miami \u2014 have enacted similar laws in response to the humanitarian disasters playing out on the streets of cities that do not regulate camping.<\/p>\n<p>Each effort has met the incendiary rhetoric that has become a trademark of homelessness activists. In The New York Times, the National Homelessness Law Center compared Utah\u2019s proposal to offer psychiatric services to homeless people to both <a href=\"https:\/\/www.nytimes.com\/2025\/10\/29\/us\/politics\/utah-trump-homeless-campus.html#:~:text=%E2%80%9CIt's%20what%20they%20did%20in,badly%20broken%2C%E2%80%9D%20he%20wrote.\" target=\"_blank\" rel=\"noreferrer noopener\">Japanese internment camps <em>and <\/em>the Holocaust<\/a>. And in each of these cases, the rhetoric of activists could not be further divorced from the reality of the policies being proposed.<\/p>\n<p>In the year following Kentucky\u2019s implementation of a similar street camping ban, despite outcry about \u201ccriminalizing homelessness\u201d from activists, the vast majority of homeless people living on the street were not funneled into the criminal justice system. Only <a href=\"https:\/\/www.courier-journal.com\/story\/opinion\/contributors\/2026\/03\/24\/safer-kentucky-act-homelessness-camping-ban-jail-law-enforcement\/89199931007\/?gnt-cfr=1&#038;gca-cat=p&#038;gca-uir=true&#038;gca-epti=z114221p002450n11----l115650c11----e1181xxv114221b0030xxd003065&#038;gca-ft=147&#038;gca-ds=sophi\" target=\"_blank\" rel=\"noreferrer noopener\">32 individuals<\/a> \u2014 out of more than 1,700 people living on the street \u2014 were charged with misdemeanors for repeated violations. Another <a href=\"https:\/\/www.courier-journal.com\/story\/opinion\/contributors\/2026\/03\/24\/safer-kentucky-act-homelessness-camping-ban-jail-law-enforcement\/89199931007\/?gnt-cfr=1&#038;gca-cat=p&#038;gca-uir=true&#038;gca-epti=z114221p002450n11----l115650c11----e1181xxv114221b0030xxd003065&#038;gca-ft=147&#038;gca-ds=sophi\" target=\"_blank\" rel=\"noreferrer noopener\">393 people were charged with non-jailable<\/a> first offenses, many of whom were also offered diversionary services.<\/p>\n<p>Louisiana\u2019s supposed \u201cNew Jim Crow\u201d bill is a far cry from the punitive fever dream purported by these groups. Instead, it aligns with Kentucky\u2019s proportionate and compassionate response to unregulated homeless encampments. <\/p>\n<h2>A Pathway out of the Criminal Justice System<\/h2>\n<p>HB 211 regulates street camping in a similar way to how Louisiana regulates <a href=\"https:\/\/house.louisiana.gov\/pubinfo\/FYI\/litter_law_98.htm#:~:text=The%20law%20includes:%20*%20**First%20offense**%20$500%E2%80%93$1%2C000,fine%20and%2024%20hours%20of%20community%20servi\" target=\"_blank\" rel=\"noreferrer noopener\">the \u201ccrime\u201d of littering<\/a>. In fact, the maximum fines for both offenses are the same. But unlike those \u201cpunitive\u201d littering laws, HB 211 offers homeless people arrested for crimes \u2014 including both misdemeanors and felonies unrelated to street camping regulations \u2014 a pathway out of the criminal justice system if they accept treatment and services for their underlying behavioral health problems.<\/p>\n<p>Although the activists won\u2019t admit it, the need for such treatment is significant. In Louisiana, the number of people living on the street with <a href=\"https:\/\/files.hudexchange.info\/reports\/published\/CoC_PopSub_State_LA_2019.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">addiction issues has climbed by 25 percent<\/a> in just the past five years. Many others have <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/blm-cofounder-nuclear-family-for-me-not-for-thee\/\" title=\"BLM Cofounder: Nuclear Family for Me, Not for Thee\">severe mental illness<\/a>, or both addictions and mental illness. Few of these individuals are well enough to willingly accept the treatment they need. To only give treatment to those who are willing is a cruel underestimation of the debilitation caused by addiction and mental illness.<\/p>\n<p>Pathways to assistance are built into policies like Louisiana\u2019s. When cities ban street camping, local courts often set up specialized dockets that focus on homelessness. These dockets, commonly known as \u201chomeless courts,\u201d help disentangle vulnerable people (who are often both victims and perpetrators of crimes) from the criminal justice system. <\/p>\n<p>Not all homeless people would participate in this program; it would engage only those who have broken the law. Not all homeless people who break the law would be eligible, either. These courts have considerable discretion to match people who are primarily homeless and secondarily criminals with support while ensuring that those who are primarily criminals and secondarily homeless are held fully responsible for their crimes.<\/p>\n<h2>Rebuilding Self-Sufficiency<\/h2>\n<p>What is asked of participants in return for this publicly funded support and diversion from the criminal justice system? That they participate in the services and that they contribute, whenever possible, to the cost of the program through their modest funds or community service. If they are totally unable to contribute, the court has discretion to waive the costs in full. <\/p>\n<p>These requirements are about more than reciprocity. Requiring individuals to contribute to their own sustenance and rehabilitation helps rebuild a sense of purpose, dignity, and self-sufficiency among a population that sorely needs all of those.<\/p>\n<p>No one can deny that life on the street is a nightmare. Policies like this are our best chance at helping the homeless get the treatment and services they need to build stable, flourishing lives. Does that sound like the New Jim Crow to you?<\/p>\n<p>Louisiana\u2019s lawmakers are not the first to come under fire from polemical activists who resist common-sense approaches to homelessness in favor of protecting the failing status quo. But policymakers and the public alike understand that ultimately lives are at stake, and that it is irresponsible to allow people to remain in the throes of unsheltered homelessness and addiction.
