Maduro\u2019s defense argued the payments violating his rights could lead to dismissal, but U.S. District Judge Alvin hellerstein indicated he did not plan to dismiss the case and criticized the government for blocking the payments, stressing the right to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/supreme-court-upholds-decision-to-overturn-utah-mans-death-sentence-washington-examiner\/\" title=\"Supreme Court upholds decision to overturn Utah man&#039;s death sentence - Washington Examiner\">effective legal counsel<\/a>. The judge noted improving U.S.-Venezuela relations, including IMF engagement, and, with the funds now available, the case will proceed as planned; Maduro and his wife are charged with narco-terrorism and related drug and weapons offenses after being captured in Caracas by Delta Force on Jan. 3.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<p>The United States adjusted sanctions to allow <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/venezuela\/\" type=\"post_tag\" id=\"910\">Venezuela<\/a> to pay former Venezuelan President <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/nicolas-maduro\/\" type=\"post_tag\" id=\"2252\">Nicolas Maduro&rsquo;s<\/a> legal fees during his drug trafficking case in New York.<\/p>\n<p>The U.S. caved to the demand after Maduro&rsquo;s defense lawyer, Barry Pollack, argued his client&rsquo;s rights were being violated, so the case should be dismissed. U.S. District Judge Alvin Hellerstein, an appointee of then-President <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/bill-clinton\/\" type=\"post_tag\" id=\"703\">Bill Clinton<\/a>, said at a March 26 hearing that he didn&rsquo;t intend to dismiss the case, but was critical of the government for blocking Caracas from paying the legal fees, <em>Reuters<\/em> reported.<\/p>\n<div id=\"wex-recommended-widget\">\n<h2>Recommended Stories<\/h2>\n<\/p><\/div>\n<p>Prosecutor Kyle Wirshba previously insisted that the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/exclusive-house-conservatives-introduce-sanctions-proposal-for-thousands-of-chinese-communist-party-officials\/\" title=\"Exclusive \u2014 House Conservatives Introduce ... Proposal for Thousands of Chinese Communist Party Officials\">sanctions blocking<\/a> the legal payments were based on national security concerns and that the court had no say over the matter, as foreign policy is the realm of the executive branch rather than the judiciary. Hellerstein wasn&rsquo;t convinced.<\/p>\n<div>\n<p>&ldquo;The defendant is here, Flores is here. They present no further national security threat,&rdquo; he said, referring to Maduro and his wife. &ldquo;The right that&rsquo;s implicated, paramount &#8203;over other &#8288;rights, is the right to <a href=\"https:\/\/amzn.to\/3YuVZYV\" >constitutional counsel<\/a>.&rdquo;<\/p>\n<p>Hellerstein also pointed out the improvement in relations between the U.S. and Venezuela since Maduro&rsquo;s capture. The U.S. recently lifted sanctions on Interim Venezuelan President Delcy Rodriguez and successfully pressured the International Monetary Fund to resume dealings with the country.<\/p>\n<p><strong><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/world\/4533471\/imf-resumes-relations-venezuelan-authorities-since-2019-us-pressure\/\" type=\"post\" id=\"4533471\">IMF RESUMES RELATIONS WITH VENEZUELAN AUTHORITIES FOR FIRST TIME SINCE 2019<\/a><\/strong><\/p>\n<p>With Maduro now able to pay his lawyers, the case will proceed as planned.
