The suit arose from an ad during Moore\u2019s 2017 U.S. Senate bid that cited reporting about <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/andrew-cuomo-to-face-no-charges-after-sexual-harassment-investigation\/\" title=\"Andrew Cuomo To Face No Charges After Sexual Harassment Investigation\">alleged inappropriate conduct<\/a> and aired hundreds of times against Democrat Doug Jones. The court ruled Moore failed to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/roy-moores-defamation-victory-sends-a-message-about-the-actual-malice-standard\/\" title=\"Roy ...s Defamation Victory Sends A Message About The \u2018Actual Malice\u2019 Standard\">prove actual malice<\/a>, finding the ads did not present the statements as facts and included citations for viewers to read the articles, with the PAC also noting it had fact-checked the ad. SMP\u2019s attorney called the decision a vindication, while Moore\u2019s lawyer said the ruling was disappointing and will likely be challenged on appeal.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<p>A federal appeals court overturned the $8.2 million in damages awarded to former Alabama Supreme Court Justice Roy Moore in 2022.<\/p>\n<p>Moore launched a lawsuit in 2019 against the Senate Majority PAC over their ad that cited claims of Moore &ldquo;soliciting sex from young girls&rdquo; during his 2017 run for U.S. Senate.<\/p>\n<p>The PAC&rsquo;s ad <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/media.ca11.uscourts.gov\/opinions\/pub\/files\/202313531.pdf\">displayed quotes from new articles<\/a> about Moore&rsquo;s alleged behavior, including one suggesting he approached a young girl working as &ldquo;Santa&rsquo;s helper.&rdquo; The ads were aired over 500 times in the final weeks of the campaign, where he was facing off against Democrat Doug Jones. Jones <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.nytimes.com\/elections\/results\/alabama-senate-special-election-roy-moore-doug-jones\">won the election with 49.9% <\/a>of the vote. <\/p>\n<div>\n<p><strong><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/white-house\/4537346\/former-presidents-unite-hopeful-message-america-250\/\">FORMER PRESIDENTS UNITE WITH HOPEFUL MESSAGE AHEAD OF AMERICA 250: &lsquo;AMERICA HEALS ITSELF&rsquo;<\/a><\/strong><\/p>\n<p>Moore sued the PAC for defamation and &ldquo;false-light invasion of privacy.&rdquo; The case went to a jury, and they awarded him the $8.2 million. <\/p>\n<p>However, a three-judge panel of the U.S. 11th Circuit Court of Appeals ruled on Friday that in fact Moore did not present clear and convincing evidence that the SMP published the ad with actual malice, a legal term that established in the 1964 case <em>New York Times v. Sullivan<\/em>. <\/p>\n<p>Actual malice is the legal standard by which courts determine if someone is liable for libel. To prove actual malice, a public figure must prove that the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/supreme-court-takes-usps-appeal-over-black-womans-bias-claims\/\" title=\"Supreme Court takes USPS appeal over black woman\u2019s bias claims\">offending party acted &#038;ldquo<\/a>;with knowledge that it was&nbsp;false&nbsp;or with reckless disregard of whether it was false or not.&rdquo;<\/p>\n<p>The judges said the ads did not make the assertions that Moore said they did, and included citations of the articles for viewers to read the claims themselves.
