A Tazewell County judge ruled that the referendum votes where ineffective and void ab initio, while Virginians had narrowly approved the measure to redraw the congressional map, perhaps shifting the state from a 6-5 Republican-Democratic balance to a far more Democratic-leaning map. cuccinelli told CNN that even though the trial court win is meaningful, the Virginia Supreme Court will ultimately decide the issue, and he predicted the high court is highly likely to overturn the lower court ruling.

Cuccinelli outlined four constitutional challenges he said the Democrats’ referendum faced: (1) the first passage was invalid because it occurred during a special session not allowed by law; (2) the amendment requires two separate legislative votes with an election between them, which did not occur due to early voting; (3) the proposed maps violate the contiguity and compactness requirements of the Virginia Constitution; and (4) the timeline did not meet the 90-day submission requirement after final passage. He suggested the Supreme Court could issue a 7-0 ruling throwing the referendum out, and noted that the state supreme Court had previously allowed the election to proceed but had not ruled on the underlying issues. The article also notes that the Associated Press reported the high court’s stance was provisional, and that oral arguments were anticipated in the case.

Former Virginia Attorney General Ken Cuccinelli told CNN’s Jake Tapper, following a court ruling invalidating Tuesday’s congressional redistricting vote, that the state Supreme Court will likely uphold the judge’s decision.

Virginians voted Tuesday, approximately 51.5 percent to 48.5 percent, to allow the redrawing of the state’s congressional districts, taking the current party breakdown from a 6-5 split to a potential 10-1 Democratic Party advantage.

Tazewell County Circuit Court Judge Jack Hurley issued an injunction late Wednesday, concluding, “Any and all votes for or against the proposed constitutional amendment in the April 21, 2026, special election are ineffective.”

The judge said the referendum question was void “ab initio” Virginians had narrowly approved the redrawing plan (about 51.5% to 48.5%), which would shift the congressional map toward a Democratic majority. Judge Jack Hurley later ruled that the referendum on the constitutional amendment for the April 21, 2026, election is void ab initio and that votes for or against the proposed amendment are ineffective. Cuccinelli said a trial-court win is not decisive; the ultimate decision will come from the Virginia Supreme Court.

He argued that although the Supreme Court allowed the election to proceed, that does not mean the referendum is legal, and he predicted the high court will likely overturn the lower-court ruling-perhaps in May. Cuccinelli maintained that the referendum violated several constitutional processes, listing four issues: (1) the amendment process was moved in a special session and required a two-thirds vote that never occurred; (2) the amendment requires two separate votes with an election in between, which was not satisfied since early voting had already begun; (3) the maps violate contiguity/compactness requirements; and (4) the timeline required the amendment to be submitted no sooner than 90 days after final passage, which was not met. He suggested the four constitutional questions would lead the Virginia Supreme Court to strike down the referendum, possibly in a 7-0 ruling

[33651
16985,20766,70735,5468
post-2594421","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-the-western-journal","tag-redistricting","tag-referendum","tag-supreme-court-2","tag-virginia
["GET
