Gavin Newsom’s attempt to regulate federal ICE officers-requiring visible identification and banning masks-was struck down by a unanimous Ninth Circuit panel. The court ruled that California’s No Vigilantes Act directly regulates the United States in its performance of federal duties, wich the Supremacy Clause forbids. The decision, authored by U.S. Circuit Judge Mark Bennett and joined by Judges Daniel Collins and Jacqueline Nguyen, emphasized that the act tries to regulate conduct reserved to sovereigns and cannot impose any requirements on federal officers. The ruling followed the act’s passage last year and related laws, and it contrasted the state’s goals with the constitutional authority of federal law. News accounts and commentary from outlets such as The Washington Times and Fox News highlighted the breadth of the ruling and its implications for state-federal regulatory power.

California Democratic Gov.
