Wade and Planned Parenthood v. Casey in Dobbs v. Jackson Women\u2019s Health Organization. It argues that while all majority members call themselves originalists, each justice brings a different approach, and Alito had to synthesize these varying views into a single, workable opinion. The 5\u20114 majority consisted of Thomas,Alito,Gorsuch,Kavanaugh,and Barrett,with Thomas assigning the Dobbs opinion to Alito after Chief Justice Roberts did not support overturning roe and Casey. Hemingway explains that Alito balanced <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/group-of-nyc-teachers-file-emergency-request-with-u-s-supreme-court-to-block-vaccine-mandate\/\" title=\"Group of NYC teachers file emergency request with U.S. ... to block vaccine mandate\">substantive due process<\/a> concerns and the perspectives of justices like Thomas and Kavanaugh to produce an opinion strong enough to overturn the precedents,while incorporating other viewpoints without weakening the core argument. After weeks of drafting and edits,Alito\u2019s draft reportedly surprised the other justices with its forceful and cohesive reasoning. Wade<\/em> and its made-up &ldquo;constitutional right&rdquo; to abortion. How he was able to hold his majority together despite their differing approaches to legal interpretation, however, has always remained a bit of a mystery.<\/p>\n<p>That is, until now. <\/p>\n<p>In her newly released book, <em><a href=\"https:\/\/www.amazon.com\/Alito-Justice-Reshaped-Restored-Constitution\/dp\/1541607139\/ref=sr_1_1?dib=eyJ2IjoiMSJ9.P5P5LnowfFGwzqligbaViKg1GxkKY6_oF8_Ypw8T1rJhSXEzjmRx5ZBg4H_7uPaLLH0aPTK9w-UBATQoepc71gSyEqZ4C0V67m_ZVgsci6qMtG2iZyHN6dKJLrnEgzlWJKZrF5xfFtzL7mz2SSm5HZgLq9kSabu68tc9OsrTzfTFdFxW1nUj6J3R1Y-XcDw1U9Pqjvo8aVdogEkKAQYDxJ_366ZLOIahzFc8_nbyoU0.ngbGRHQz3F-96BuY6felA5B4r5fsWmFsuVVG5i0Fdts&amp;dib_tag=se&amp;keywords=alito&amp;qid=1776715278&amp;s=books&amp;sr=1-1\" target=\"_blank\" rel=\"noreferrer noopener\">Alito: The Justice Who Reshaped the Supreme Court and Restored the Constitution<\/a><\/em>, Federalist Editor-in-Chief Mollie Hemingway peels back the curtain on how the Bush appointee constructed the court&rsquo;s majority opinion in <em><a href=\"https:\/\/www.oyez.org\/cases\/2021\/19-1392\" target=\"_blank\" rel=\"noreferrer noopener\">Dobbs v. Jackson Women&rsquo;s Health Organization<\/a><\/em>  (2022). <\/p>\n<p>While each justice in the majority are self-described originalists, Hemingway details how each has their own secret sauce when it comes to their respective approaches to the law. This means that it was up to Alito to find a way to incorporate their varying views into the final decision overturning <em>Roe<\/em> and its successor, <em><a href=\"https:\/\/www.oyez.org\/cases\/1991\/91-744\" target=\"_blank\" rel=\"noreferrer noopener\">Planned Parenthood of Southeastern Pennsylvania v. Casey<\/a><\/em>  (1992). <\/p>\n<p>Hemingway notes that in the days after oral arguments, the justices met for a conference to express their views on <em>Dobbs<\/em> and indicate how they would vote on the case. The final vote margin came down to 5-4 to overturn <em>Roe<\/em> and <em>Casey<\/em>, with the majority being comprised of Associate Justices Clarence Thomas, Alito, Neil Gorsuch, Brett Kavanaugh, and Amy Coney Barrett.<\/p>\n<p>At the Supreme Court, the most senior justice in the majority assigns the opinion. While the chief justice is always considered to be the most senior, the <a href=\"https:\/\/amzn.to\/3YuVZYV\" >majority assignment ultimately fell<\/a> upon Thomas since Chief Justice John Roberts did not support overturning <em>Roe<\/em> and <em>Casey<\/em>.<\/p>\n<p>Hemingway writes that, despite his decades-long criticisms of <em>Roe<\/em> and <em>Casey<\/em>, it was &ldquo;an easy call for Thomas&rdquo; to assign Alito the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/its-up-to-moms-to-crush-target\/\" title=\"Moms must crush Target.\">seemingly insurmountable task<\/a> of authoring the <em>Dobbs<\/em> decision. Unlike Thomas, who holds <a href=\"https:\/\/thefederalist.com\/2026\/04\/09\/this-new-study-shreds-a-phony-media-hatchet-job-against-the-supreme-court\/\" target=\"_blank\" rel=\"noreferrer noopener\">differing views<\/a> on <a href=\"https:\/\/www.law.cornell.edu\/wex\/stare_decisis\" target=\"_blank\" rel=\"noreferrer noopener\">stare decisis<\/a> and &ldquo;will not trim his views to attract other justices to join his opinions,&rdquo; Alito was seen as the &ldquo;best person for the job&rdquo; because &ldquo;one of his greatest strengths is keeping a majority opinion together and incorporating arguments from everyone.&rdquo;<\/p>\n<p>&ldquo;That is all the more important when the vote is 5-4,&rdquo; Hemingway writes. &ldquo;Alito is known for being generous, humble, and ecumenical in his opinion writing. Over his decades on the Court, he has learned to be bold as prudence allows. Alito is not upset when another justice wants to include something that he believes is unnecessary or that tinkers with his prose.&rdquo;<\/p>\n<p>One of the chief areas in which Alito was all but required to perform a judicial balancing act was on the issue of <a href=\"https:\/\/www.law.cornell.edu\/wex\/substantive_due_process\" target=\"_blank\" rel=\"noreferrer noopener\">substantive due process<\/a>. <\/p>\n<p>Hemingway notes that when writing the <em>Dobbs<\/em> opinion, the Bush appointee had to account for Thomas&rsquo; position that the Supreme Court &ldquo;was in error when it kept finding rights&rdquo; in the 14th Amendment&rsquo;s <a href=\"https:\/\/www.law.cornell.edu\/constitution\/amendmentxiv\" target=\"_blank\" rel=\"noreferrer noopener\"><a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/breaking-kraken-released-attorney-sidney-powell-files-104-page-bombshell-complaint-of-massive-fraud-in-georgia-election-update-michigan-too\/\" title=\"BREAKING: KRAKEN RELEASED! At the same time, she writes, Alito also had to consider the beliefs of justices like Kavanaugh, &ldquo;whose concurrence emphasized how singular <em>Dobbs<\/em> was among substantive due process cases and how important precedent was.&rdquo;<\/p>\n<p>After taking these points into consideration, Hemingway details how Alito spent weeks crafting a majority opinion that incorporated these varying views but that didn&rsquo;t sacrifice the core legal argumentation necessary to overturning <em>Roe<\/em> and <em>Casey<\/em>.
