The author contends the case amounts to a Strategic Lawsuit Against Public Participation (SLAPP) designed to silence pro-life voices, and notes that heartbeat and itS affiliates have filed their own suit, claiming James has shown no evidence of fraud or harm. The article cites the U.S.Supreme Court’s Chiles v. Salazar decision to defend counseling as protected speech and warns against censoring medical discussions, arguing that medical consensus is not static and should not be silenced by goverment action. It also points to Colorado’s similar prior actions and settlements, urging James to respect First Amendment rights while arguing the broader aim is to protect unborn children and free speech rather then suppress them. The piece is attributed to Jessica Prol Smith, who serves as director of government relations for Heartbeat International.

State attorneys general are duty-bound to seek justice for the weak and powerless, not to use their immense power to harass them. On Wednesday, April 15, their attorneys argued that James’ hostile lawsuit should be dismissed because it targets free speech and participation in public debate. James’ lawsuit is a classic Strategic Lawsuit Against Public Participation (SLAPP). Or, more bluntly, James’ efforts amount to a bully’s legal slap in the face to keep small pro-life nonprofits from sharing a life-saving message she doesn’t like.

Her friends have called her a “voice for the voiceless.” She claims to “speak truth to power, and challenge the status quo.” And she frequently talks of “using [her] position to address the needs of those who are locked out of the sunshine of opportunity.”

But the attorney general ought not ignore the U.S. Supreme Court’s recent defense of free speech rights, even when offering medical services. At the end of March, the court delivered an 8-1 decision in Chiles v. Salazar, noting that counseling conversations are speech and Colorado cannot silence viewpoints in the counseling room. The majority warned that “[t]oday, tomorrow, and forever, too, any professional speech that deviates from ‘current beliefs about the safety and efficacy of various medical treatments’ could be silenced with relative ease.”

Sensitive to the danger of stifling innovation in medicine, they continued, “Medical consensus, too, is not static; it evolves and always has. The majority closed with these words: “Colorado may regard its policy as essential to public health and safety. Certainly, censorious governments throughout history have believed the same. But the First Amendment stands as a shield against any effort to enforce orthodoxy in thought or speech in this country.”

This isn’t Colorado’s first misstep on matters of political and medical censorship. Yet New York Attorney General Letitia James’ handling of private discussions about the abortion-pill reversal (APR) protocol appears to be a cynical abuse of state authority. Two years ago, James sued Heartbeat International and 11 New York pregnancy centers, alleging false advertising and deception about APR’s safety and effectiveness. APR is presented as a safe, effective way to improve the chances of carrying a pregnancy to term after taking mifepristone, the first drug in an abortion regimen that blocks progesterone. A global network of more than 1,500 healthcare professionals can prescribe bioidentical progesterone to counteract mifepristone, and supporters claim that more than 8,000 babies have been saved through APR. The piece highlights many positive testimonials from smiling, thriving babies and grateful mothers and argues that James has no business intruding on intimate medical decisions. Heartbeat and its New York affiliates counter that James has offered no evidence of fraud, misrepresentation, material omissions, or harm from providing free services or discussing APR. This week, the groups argued in court that James’ lawsuit targets free speech and participation in public debate; the article characterizes the case as a classic Strategic Lawsuit Against Public Participation (SLAPP) and describes James’ actions as a bully’s attempt to silence small pro-life nonprofits promoting a life-saving message she dislikes. The attorney general is portrayed as being backed by allies who call her a “voice for the voiceless” who “speaks truth to power” and aims to help those denied access to opportunity. Yet the author argues James should heed the U.S. Supreme Court’s recent defense of free speech in medical contexts. In late March, Chiles v. Salazar (8-1) held that counseling conversations constitute speech and that Colorado cannot silence viewpoints in the counseling room. The Court warned that professional speech that deviates from prevailing beliefs about the safety and efficacy of treatments could be easily silenced, and it emphasized that medical consensus is not static; the standard of care can evolve, so the outer boundary of what professionals may say tomorrow cannot be fixed by today’s consensus. The piece suggests New Yorkers may resist lessons from “flyover country,” but James would be wise not to repeat Colorado’s missteps. The majority opinion stresses that while policies may be viewed as essential to public health, the First Amendment protects against efforts to enforce orthodoxy in thought or speech. The article notes Colorado’s prior missteps on issues of political and medical censorship, including a January settlement that paid more than $6 million after an unlawful attempt to ban APR-the very protocol James targets. James’ campaign against pregnancy centers and mothers seeking another option is troubling; if she truly aims to be a “voice for the voiceless” and uphold the First Amendment, she should stop shutting out unborn children who are at greatest risk of being “left in the sunshine” of opportunity lost.
