Circuit Court of Appeals halted contempt proceedings brought by Chief Judge James Boasberg against government officials involved in deportations of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trump-drops-the-hammer-on-socialist-country-says-they-sent-undercover-agents\/\" title=\"... Drops the Hammer on Socialist Country, Says They Sent &#039;Undercover&#039; Agents\">suspected venezuelan gang members<\/a>. Judge Neomi Rao criticized Boasberg\u2019s handling as an abuse of discretion and an improper assertion of jurisdiction against the Executive Branch. The piece argues this win exposes a larger issue: republicans have largely allowed Boasberg to abuse his authority without consequences.<\/p>\n<p>The article links Boasberg to broader concerns about anti-Trump judicial activism, including his alleged involvement in Jack Smith\u2019s Arctic Frost inquiry and attempts to seize phone records of GOP members of Congress without informing them. Margot Cleveland is cited as saying Boasberg should have ordered Smith\u2019s team to show cause for concealing that lawmakers were targeted, yet he has not done so.<\/p>\n<p>it also notes that Republicans have done little to punish Boasberg: Rep.Chip Roy\u2019s January bid to slash funding for the D.C. courts failed when manny House Republicans joined Democrats,and impeachment articles filed by Rep. Brandon Gill have not been acted on by leadership. But the win raises a far greater issue that most Republicans would like to sweep under the rug. <\/p>\n<p>The victory in question happened on Tuesday, when the D.C. Circuit Court of Appeals terminated contempt proceedings launched by Chief District Judge <a href=\"https:\/\/thefederalist.com\/tag\/james-boasberg\/\" target=\"_blank\" rel=\"noreferrer noopener\">James Boasberg<\/a> against government officials involved in the deportation of suspected Venezuelan gang members. In her scathing opinion, Judge Neomi Rao excoriated the Obama-appointed Boasberg for his &ldquo;clear abuse of discretion&rdquo; and assuming an &ldquo;improper jurisdiction antagonistic to the Executive Branch.&rdquo;<\/p>\n<p>While the ruling was undoubtedly a win for the president and his immigration agenda, it raises an important question Republicans don&rsquo;t want voters asking. That is, why have they continued to allow Boasberg to abuse his authority with zero consequences up to this point?<\/p>\n<p>After all, it&rsquo;s not a new phenomenon that the <a href=\"https:\/\/thefederalist.com\/2025\/07\/16\/exclusive-memo-reveals-d-c-judges-are-predisposed-against-trump-administration\/\" target=\"_blank\" rel=\"noreferrer noopener\">anti-Trump<\/a> Boasberg boasts a <a href=\"https:\/\/thefederalist.com\/tag\/james-boasberg\/\" target=\"_blank\" rel=\"noreferrer noopener\">track<\/a> <a href=\"https:\/\/pjmedia.com\/matt-margolis\/2025\/04\/06\/activist-judge-caught-red-handed-in-setup-against-trump-n4938644\" target=\"_blank\" rel=\"noreferrer noopener\">record<\/a> of egregious conduct on the bench. Not just in his handling of cases involving the Trump administration, but in matters pertaining to Democrat lawfare against Trump and other Republicans.<\/p>\n<p>It was Boasberg who played a key role in Jack Smith&rsquo;s <a href=\"https:\/\/thefederalist.com\/tag\/arctic-frost\/\" target=\"_blank\" rel=\"noreferrer noopener\">Arctic Frost<\/a> probe, which ultimately became his elector lawfare campaign against the then-former president and his allies. As The Federalist previously <a href=\"https:\/\/thefederalist.com\/2025\/11\/20\/exclusive-gop-leaders-grill-judge-boasberg-for-allowing-jack-smith-to-spy-on-the-senate\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a>, the Obama appointee signed off on efforts by Smith&rsquo;s team to seize the phone records of GOP members of Congress and not inform them of such subpoenas.<\/p>\n<p>Federalist Senior Legal Correspondent Margot Cleveland observed in her recent <a href=\"https:\/\/thefederalist.com\/2026\/03\/24\/cleveland-jack-smith-and-his-lawfare-team-must-be-held-accountable\/\" target=\"_blank\" rel=\"noreferrer noopener\">testimony<\/a> before a Senate subcommittee that Smith&rsquo;s team &ldquo;apparently&rdquo; didn&rsquo;t inform Boasberg of who they were targeting with the subpoenas. She noted, however, that despite this purported stance, Boasberg has thus far declined to order Smith and his team to &ldquo;show cause for why they should not be held in contempt for concealing that members of Congress were the subpoena targets.&rdquo;<\/p>\n<p>&ldquo;This fact&nbsp;should not be ignored &mdash; if you are to believe Smith and the Administrative Office of the Courts&rsquo;&nbsp;testimony that Judge Boasberg did not know your identities, then it makes absolutely no sense that Boasberg would not enter a show cause order to hold Smith accountable for violating your rights,&nbsp;given Judge Boasberg&rsquo;s nearly year-long&nbsp;<a href=\"https:\/\/www.judiciary.senate.gov\/imo\/media\/doc\/94466aeb-e8bf-feb0-1eb8-9f68d0fa28b0\/2025-12-03_Testimony_Luther.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">crusade<\/a>&nbsp;to hold a member of the Trump Administration in&nbsp;contempt,&rdquo; Cleveland told the senators. <\/p>\n<p>And yet, despite this trail of abuse on the bench, Republicans have done virtually nothing to punish Boasberg. In fact, when opportunities have arisen to do so, many elected GOPers have sided with Democrats to oppose them. <\/p>\n<p>Rep. Chip Roy, R-Texas, <a href=\"https:\/\/thefederalist.com\/2026\/01\/14\/46-house-republicans-help-democrats-defeat-measure-defunding-activist-judges-boasberg-boardman\/\" target=\"_blank\" rel=\"noreferrer noopener\">introduced<\/a> a bill amendment in January that sought to slash the budgets of the D.C. District Court (where Boasberg is based) and Court of Appeals by 20 percent. The measure would also have ensured that &ldquo;[n]one of the funds made available&rdquo; by the bill would &ldquo;be obligated or expended for the salary and expenses&rdquo; for Boasberg&rsquo;s staff and that of Maryland District Judge&nbsp;<a href=\"https:\/\/thefederalist.com\/tag\/deborah-boardman\/\" target=\"_blank\" rel=\"noreferrer noopener\">Deborah Boardman<\/a>, who gave a lenient sentence to Supreme Court Justice Brett Kavanaugh&rsquo;s attempted assassin &mdash; seemingly based on her affinity for &ldquo;trans&rdquo; ideology.<\/p>\n<p>But rather than advance the measure, 46 House Republicans joined Democrats in defeating it. <\/p>\n<p>The House GOP has also sat on articles of impeachment against Boasberg <a href=\"https:\/\/gill.house.gov\/media\/press-releases\/rep-gill-files-impeachment-articles-against-judge-boasberg-following-arctic\" target=\"_blank\" rel=\"noreferrer noopener\">filed<\/a> by Rep. Brandon Gill, R-Texas. Speaker Mike Johnson <a href=\"https:\/\/thefederalist.com\/2025\/10\/30\/speaker-johnson-silent-after-gop-senators-urge-house-hearings-impeachment-over-arctic-frost\/\" target=\"_blank\" rel=\"noreferrer noopener\">did not res<\/a><a href=\"https:\/\/thefederalist.com\/2025\/10\/30\/speaker-johnson-silent-after-gop-senators-urge-house-hearings-impeachment-over-arctic-frost\/\">pond<\/a> to The Federalist&rsquo;s prior comment request on whether the House would initiate such proceedings against the Obama appointee.<\/p>\n<p><strong>[READ:[READ:<a href=\"https:\/\/thefederalist.com\/2025\/06\/30\/we-still-have-an-imperial-judiciary-yet-trump-continues-to-exercise-extreme-restraint\/\" target=\"_blank\" rel=\"noreferrer noopener\">We Still Have An Imperial Judiciary, Yet Trump Continues To Exercise Extreme Restraint<\/a>]<\/strong><\/p>\n<p>Relying on higher courts to correct the abusive actions of rogue judges is not an excuse for Republicans to abdicate their responsibility to judicial oversight. Nor is it an effective long-term strategy that will prevent partisan actors like Boasberg from acting out in the future.<\/p>\n<p>Only by exercising their <a href=\"https:\/\/constitution.congress.gov\/constitution\/article-3\/\" target=\"_blank\" rel=\"noreferrer noopener\">constitutional authority<\/a> over the federal courts can Republicans rein in the <a href=\"https:\/\/thefederalist.com\/tag\/judicial-coup\/\" target=\"_blank\" rel=\"noreferrer noopener\">judicial activism<\/a> subverting American governance.
