The ruling, by U.S. District Judge Brian Murphy of Massachusetts, said the DHS ended TPS “without regard for the process delineated by Congress.” The decision comes as TPS holders from various countries are challenging their status in federal court, marking another legal setback to efforts to terminate TPS as part of the Trump administration’s immigration policy.

Under Biden, TPS has allowed more than 1 million people who would otherwise be deportable to remain in the United States. Biden designated TPS for Ethiopians living in the U.S. in 2022, extended it in 2024, but Trump’s DHS terminated Ethiopia’s TPS designation in December 2025, arguing the country no longer met the criteria. Murphy emphasized that the president’s wishes do not override Congress or the agencies’ statutory obligations.

DHS has defended TPS as a temporary status, while critics quoted in the piece describe the ruling as part of a broader dispute over restoring what they see as integrity to the U.S. immigration system.
