That magistrate <a href=\"https:\/\/www.westernjournal.com\/deep-dive-learned-appointed-magistrate-let-decarlos-brown-allegedly-kill-iryna-zaruska-makes-sense-now\/\" target=\"_blank\" rel=\"noopener\">owed her seat<\/a> to an elected Democratic judge and was supervised by another Democratic judge.<\/p>\n<p>Now, according to a psychiatric evaluation, Brown is considered not capable of being tried for the killing.<\/p>\n<p>According to <a href=\"https:\/\/www.charlotteobserver.com\/news\/local\/crime\/article315340121.html\" target=\"_blank\" rel=\"noopener\">The Charlotte Observer<\/a>, the examination that found Brown incapable took place on Dec. 29 at Central Regional Hospital, a <a href=\"https:\/\/www.ncdhhs.gov\/divisions\/state-operated-healthcare-facilities\/facilities\/state-psychiatric-hospitals\" target=\"_blank\" rel=\"noopener\">psychiatric facility<\/a>. Its findings were revealed Tuesday when his <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/judge-grants-activist-john-sullivans-request-to-subpoena-california-filmmaker-for-jan-6-trial\/\" title=\"Judge approves activist John Sullivan&#039;s subpoena request for California filmmaker in Jan. 6 trial.\">defense attorney filed<\/a> a motion seeking to delay a hearing on Brown&rsquo;s capacity to stand trial.<\/p>\n<p>The state-level murder charge against Brown will not be adjudicated until his competency can be &ldquo;restored,&rdquo; according to WBTV.<\/p>\n<p>&ldquo;Restoring a defendant&rsquo;s competency can be an extremely lengthy process in North Carolina because of a lack of available space in psychiatric facilities.
