Ali pleaded guilty in 2022 to one count of conspiracy to commit wire fraud as part of the Feeding Our future\/Youth Inventors Lab scheme,which prosecutors said took more than $3 million in subsidies intended to feed underprivileged children. The case involved using Youth Inventors Lab as a shell nonprofit sponsored by Feeding Our Future, with dozens of food-distribution sites that claimed to serve hundreds or thousands of meals daily, while in reality most meals were never provided.Prosecutors said the scheme generated over $18 million in administrative fees for sponsor organizations.<\/p>\n<p>U.S. District Judge Nancy Brasel, who was nominated by President Donald trump in 2018, sentenced Ali well below federal sentencing guidelines (which called for roughly 2\u00bd years) and below the prosecution\u2019s recommended term. The judge cited Ali\u2019s cooperation, remorse, and the fact that he faced potential hardship for his six children as part of her decision to impose a shorter sentence. Ali expressed remorse in court, apologizing to those he hurt and stating he would try to fix the damage for the rest of his life. order to cut NPR and PBS funding<\/a><\/li>\n<li><a href=\"https:\/\/www.washingtonexaminer.com\/policy\/healthcare\/4510521\/what-to-know-medicare-hemp-pilot-program-challenge-court\/\">What to know about Medicare&#8217;s new <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/judge-blocks-trump-administration-order-to-cut-npr-and-pbs-funding\/\" title=\"Judge blocks ... order to cut NPR and PBS funding\">hemp pilot program<\/a> that drug safety groups are challenging in court<\/a><\/li>\n<\/ul>\n<\/div>\n<div class=\"article-paywall\">\n<h2 class=\"wp-block-heading\" id=\"h-one-year-in-federal-prison-for-a-3-million-scam\">One year in federal prison for a $3 million scam<\/h2>\n<p>Ali, a foreign national from Somalia, <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.justice.gov\/usao-mn\/pr\/st-paul-man-pleads-guilty-his-role-250-million-feeding-our-future-fraud-scheme\">pleaded guilty<\/a> in 2022 to defrauding a <a href=\"https:\/\/amzn.to\/3YuVZYV\" >federally funded child nutrition program<\/a> in what was known as the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/mn-attorney-general-says-he-was-duped-by-feeding-our-future-fraudsters\/\" title=\"MN ... general says he was duped by Feeding Our ... fraudsters\">largest pandemic-era fraud scheme<\/a> in U.S. history.<\/p>\n<p>According to <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.justice.gov\/archives\/opa\/pr\/us-attorney-announces-federal-charges-against-47-defendants-250-million-feeding-our-future\">charging documents<\/a>, Ali admitted to fraudulently raking in more than $3 million in federal assistance funds that were supposed to help feed underprivileged children during the COVID-19 crisis.<\/p>\n<p>Shortly after immigrating to the United States, Ali set up a nonprofit organization called Youth Inventors Lab as a shell company and enrolled the entity in the Federal Child Nutrition Program under the sponsorship of Feeding Our Future, prosecutors said.<\/p>\n<p>Feeding Our Future, another Minnesota nonprofit group, served as a sponsor organization to dozens of food distribution sites that it recruited to receive meal reimbursements under the auspices of the Federal Child Nutrition Program. Food distributors that received meal reimbursements had to be sponsored by an authorized agency, which retained a cut of the funds as an administrative fee. In exchange for sponsoring these entities, most of them fraudulent, Feeding Our Future accrued more than $18 million in administrative fees.<\/p>\n<p>Ali&rsquo;s registered food distribution site, Youth Inventors Lab, raked in more than $3 million in reimbursements meant to cover the cost of prepared meals, despite never actually feeding any children.<\/p>\n<p>Alongside other co-conspirators, Ali forged fake invoices purporting to document the purchase of food from a catering company also indicted in the scheme and falsely claimed that Youth Inventors Lab fed hundreds, and at times thousands, of children a day, amounting to over 1.5 million meals supposedly served over a seven-month period.<\/p>\n<p><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/investigations\/4417747\/somali-fraudster-feeding-our-future-scheme-ties-recent-recipient-minnesota-funding\/\"><strong>SOMALI FRAUDSTER CONVICTED IN FEEDING OUR FUTURE SCHEME TIED TO RECENT RECIPIENT OF MINNESOTA FUNDING<\/strong><\/a><\/p>\n<p>Ali confessed to one count of conspiracy to commit wire fraud, although he was originally charged with two additional felonies, including conspiring to commit money laundering. At the time, the government granted Ali a plea deal for his cooperation early on in the investigation, which helped officials secure other guilty pleas and build a broader case.<\/p>\n<p>The sentencing guidelines accordingly set Ali&rsquo;s recommended punishment at 30 to 37 months of imprisonment, or up to three years, with a total offense level of 19 out of <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.ussc.gov\/sites\/default\/files\/pdf\/about\/overview\/Overview_Federal_Sentencing_Guidelines.pdf\">43 levels of offense seriousness<\/a>.<\/p>\n<p>Brasel, the judge who presided over Ali&rsquo;s criminal case, however, sentenced him on Monday below the federal sentencing guidelines and the prosecution&rsquo;s <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.mnd.203040\/gov.uscourts.mnd.203040.488.0.pdf\">recommendation<\/a> of 2 1\/2 years in prison.<\/p>\n<div class=\"wp-block-image\">\n<figure class=\"alignleft size-full is-resized\"><figcaption class=\"wp-element-caption\">Nancy Brasel, President Donald Trump&rsquo;s nominee to be a District Court Judge for the District Court of Minnesota, gives testimony during a Senate Judiciary Committee hearing on Wednesday, April 11, 2018, on Capitol Hill in Washington. (AP Photo\/Harry Hamburg)<\/figcaption><\/figure>\n<\/p><\/div>\n<p>Ali &ldquo;took money intended to feed children who no longer could get regular, nutritious meals at school, and used it to enhance his lifestyle,&rdquo; prosecutors wrote in their sentencing petition. &ldquo;He knew he was not entitled to the money and that it was obtained by lying to the government about the number of children he allegedly served at a non-existent meal site. Simply put, he took advantage of a once-in<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/cnn-shrugs-off-report-that-chris-cuomo-received-special-treatment-from-gov-brother-any-human-being-would\/\" title=\"CNN Shrugs Off Report That Chris Cuomo Received Special Treatment From Gov Brother: \u2018Any Human Being Would\u2019\">-a-century global pandemic<\/a> and the generosity of American taxpayers to enrich himself.&rdquo;<\/p>\n<p>At the sentencing hearing, Brasel <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.kare11.com\/article\/news\/local\/feeding-our-future-investigation\/feeding-our-future-defendant-apologizes-before-sentencing-i-will-attempt-to-fix-it-for-the-rest-of-my-life\/89-6135ec9f-3574-4054-828c-165a6de804ac\">reportedly<\/a> agreed with Ali&rsquo;s defense attorney, Kevin Gregorius, that he had shown genuine remorse.<\/p>\n<p>&ldquo;Your honor, I just want to say I&rsquo;m sorry to everyone that my actions have hurt,&rdquo; Ali told the judge just before she handed down a lighter sentence. &ldquo;This was a mistake. I will try to correct it for the rest of my life. It&rsquo;s not something that&rsquo;s in the past. I&rsquo;ve let down a lot of people. I promise I will attempt to fix it for the rest of my life. So, I&rsquo;m sorry.&rdquo;<\/p>\n<p>In the defense&rsquo;s <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.mnd.203040\/gov.uscourts.mnd.203040.486.0.pdf\">sentencing request<\/a>, Gregorius said that imprisoning Ali, a father of six, for a lengthy amount of time would put his family in financial hardship and &ldquo;(ironically) remove food from the mouths of his own children.&rdquo;<\/p>\n<p>Following sentencing, Gregorius told reporters, &ldquo;I truly believe that when this began, Mr. Ali had the best of intentions, and I think he was involving himself in what he thought was still a legitimate program. By the time he realized it was not, I think it was a situation that he was already in.&rdquo;<\/p>\n<p>Ali has the opportunity to be let out on good behavior, spending the rest of his sentence at a halfway house.<\/p>\n<h2 class=\"wp-block-heading\" id=\"h-judge-said-she-believes-black-people-are-disproportionately-represented-in-state-prison-population\">Judge said she believes black people are &lsquo;disproportionately represented&rsquo; in state prison population<\/h2>\n<p>When she faced questions during her confirmation hearing in 2018, Brasel promised Senate Democrats that she would consider &ldquo;alternatives to incarceration,&rdquo; be particularly mindful of black people&rsquo;s overrepresentation in the prison population, and work to combat &ldquo;implicit racial bias&rdquo; while on the judicial bench.<\/p>\n<p>During questioning, Sen. Cory Booker (D-NJ) asked Brasel, &ldquo;Do you believe there is implicit racial bias in our criminal justice system?&rdquo; The senator cited statistics showing that black offenders are more likely than white convicts to be incarcerated.<\/p>\n<p>&ldquo;I am aware of and have reviewed studies demonstrating racial disparity in the criminal justice system,&rdquo; <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.judiciary.senate.gov\/imo\/media\/doc\/Brasel%20Responses%20to%20QFRs.pdf\">Brasel replied<\/a>.<\/p>\n<p>Brasel added that she has attended training on the subject of &ldquo;implicit racial bias&rdquo; and remains &ldquo;committed &hellip; to otherwise work within my role and ethical obligations to combat racism and implicit racial bias.&rdquo;<\/p>\n<p><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/3799728\/judge-who-ruled-against-laken-riley-act-is-a-democratic-donor\/\"><strong>JUDGE WHO RULED AGAINST LAKEN RILEY ACT IS A DEMOCRATIC DONOR<\/strong><\/a><\/p>\n<p>&ldquo;Do you believe people of color are disproportionately represented in our nation&rsquo;s jails and prisons?&rdquo; Booker pressed. Brasel affirmed, noting later on that black people account for approximately 6% of Minnesota&rsquo;s population but comprise about 37% of the state&rsquo;s prison population.<\/p>\n<p>Then-Sen. Kamala Harris (D-CA) questioned if Brasel would &ldquo;commit to taking into account alternatives to incarceration.&rdquo; Brasel pledged to do so, also agreeing with Harris that judges must ensure the justice system is &ldquo;equitable.&rdquo;<\/p>\n<p>Brasel has ruled against the second Trump administration in several key immigration cases, including <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/courthousenews.com\/minnesota-judge-blasts-trump-admin-in-order-protecting-detainees-right-to-counsel\/\">a preliminary injunction<\/a> she issued Thursday ordering Immigration and Customs Enforcement to immediately change its detention practices in Minnesota regarding out-of-state transfers.<\/p>\n<p>Prior to her nomination, Brasel had donated <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.fec.gov\/data\/receipts\/individual-contributions\/?contributor_name=Brasel%2C+Nancy&amp;contributor_state=MN\">considerable sums<\/a> to the 2006 campaign of Sen.
