The inquiry follows a federal judge\u2019s dismissal of a challenge to California\u2019s Transgender Respect, Agency, and Dignity Act, which allows inmates to be housed in facilities designated for women based on self-identified gender, including some fully intact sex offenders. The DOJ will determine whether the California policy violates the constitutional rights of female inmates. California has seen more than 1,020 male inmates request transfers to female facilities since the policy was enacted.<\/p>\n<p>The investigation comes amid widespread reports of rape, sexual assault, and voyeurism in facilities were women <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/debunking-the-aclus-ridiculous-myths-and-facts-about-transgender-athletes\/\" title=\"Debunking The ACLU\u2019s Ridiculous \u2018Myths And Facts\u2019 About ... It covers facilities such as the California Institution for Women in San Bernardino County and the Central California Women\u2019s Facility in Madera County, and it also includes Maine\u2019s Maine Correctional Center in Windham. The DOJ\u2019s review is part of a broader effort to assess whether the policy burdens or endangers women inmates, and it references related legislative context, such as California\u2019s SB 132.<\/p>\n<p>In legal developments, the Women\u2019s Liberation Front (WoLF) had sued California over the law, but Judge Jennifer L. Thurston dismissed the case for lack of a proven causal link between past injuries and the law,while noting the injuries alleged are real. WoLF plans to appeal. and &lsquo;progress,&rsquo;&rdquo; added First Assistant U.S. Attorney Bill Essayli, of the Central District of California.&nbsp;<\/p>\n<p>The case, investigating if the California law unconstitutionally gives preferential treatment to transgender-identifying inmates over the safety of incarcerated women, centers on claims from female prisoners alleging that they have been deprived of equal protection and constitutional guarantees against cruel and unusual punishment.<\/p>\n<p>Under the Civil Rights of Institutionalized Persons Act, the DOJ has the authority to investigate such suspected civil rights violations. Past findings have resulted in settlement agreements that spur reforms within correctional systems.<\/p>\n<h2 class=\"wp-block-heading\" id=\"h-allegations-of-mistreatment\">Allegations of mistreatment<\/h2>\n<p>According to the DOJ, the investigation follows widespread reports of rape, sexual assault, and voyeurism at the California correctional facilities where women are forced to share intimate spaces, such as sleeping quarters and communal showers, with male inmates who identify as transgender.<\/p>\n<p><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/investigations\/3890471\/trans-inmates-separated-from-females-following-sexual-abuse-claims\/\"><strong>TRANSGENDER INMATES SEPARATED FROM FEMALES AT SPECIAL NEEDS WOMEN&rsquo;S PRISON FOLLOWING SEXUAL ABUSE CLAIMS<\/strong><\/a><\/p>\n<p>Federal investigators will look, in particular, at the California Institution for Women in San Bernardino County and the Central California Women&rsquo;s Facility in Madera County.<\/p>\n<p>In addition to the California case, the DOJ will also investigate whether Maine similarly engages in a pattern or practice of violating the constitutional rights of women incarcerated at the Maine Correctional Center in Windham.<\/p>\n<p><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.cdcr.ca.gov\/prea\/sb-132-faqs\/\">Senate Bill 132<\/a>, signed by Newsom in 2020, authorized California inmates to be admitted into state facilities of the opposite sex, regardless of biological reality.<\/p>\n<p>Since the bill was signed into law as the Transgender Respect, Agency, and Dignity Act, more than 1,020 male inmates have requested transfers to female-designated facilities, according to <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.cdcr.ca.gov\/research\/wp-content\/uploads\/sites\/174\/2026\/03\/STA472-032026-M.pdf\">data<\/a> from the California Department of Corrections and Rehabilitation.<\/p>\n<p>Feminist opponents of the law <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/womensliberationfront.org\/chandler-v-cdcr\">sued<\/a> the state in 2021 on constitutional grounds, arguing that it created a dangerous environment for women confined in the most vulnerable of settings by subjecting them to substantial risk of sexual violence and severe psychological distress.<\/p>\n<p>Judge Jennifer L. Thurston, an appointee of former President Joe Biden, issued <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/static1.squarespace.com\/static\/5f232ea74d8342386a7ebc52\/t\/69c47f3ae3a6806a55a4c1bb\/1774485307234\/Chandler+Order+on+Dismissal+01657.pdf\">a dismissal<\/a> on Monday in the case, <em>Chandler v. Macomb<\/em>, brought by the Women&rsquo;s Liberation Front on behalf of six incarcerated women.<\/p>\n<p>&ldquo;There is no doubt that these alleged injuries are concrete and personal, even wrenching,&rdquo; Thurston acknowledged.<\/p>\n<p>However, she ruled that the plaintiffs cannot <a href=\"https:\/\/amzn.to\/3YuVZYV\" >directly link past harms<\/a> to the state statute because California let some biological men into women&rsquo;s prisons before the law was enacted. &ldquo;For this reason, their complaint does not establish the necessary chain of cause and effect between past injuries and the law they challenge,&rdquo; Thurston wrote.<\/p>\n<p>As for claims of future harm, Thurston said those are speculative. &ldquo;Injuries and harm in the past do not alone give the plaintiffs standing to pursue an injunction,&rdquo; she said of redressing future injury.<\/p>\n<p>WoLF plans on appealing the decision in <em>Chandler<\/em>, its <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.caed.402928\/gov.uscourts.caed.402928.1.0.pdf\">second complaint<\/a> to be dismissed.<\/p>\n<p>&ldquo;We are very distressed about this at WoLF as we know the conditions the women there are undergoing and are very concerned for their physical and mental health,&rdquo; Elspeth Cypher, the president of WoLF, told the <em>Washington Examiner<\/em>. &ldquo;We are not stopping our advocacy and are considering our legal options.&rdquo;<\/p>\n<p>Cypher said that the women in California prisons have, for years, endured exhibitionism, sexual harassment, attempted rape, and rape at the hands of men housed alongside them.<\/p>\n<p>Sometimes they sleep in shifts to protect each other, Cypher said, especially when a woman is assigned a male cellmate. The sleep schedules among the women ensure that someone is always on watch.<\/p>\n<p>Cypher applauded the DOJ investigations into California&rsquo;s and Maine&rsquo;s mixed-sex housing assignments, which came days after the dismissal in <em>Chandler<\/em>.<\/p>\n<p>&ldquo;We are very glad that the Department of Justice has noticed and paid attention to the women in prison in California and Maine,&rdquo; Cypher said. &ldquo;It is encouraging to see women&rsquo;s rights to safety, dignity, and privacy being recognized.&rdquo;<\/p>\n<p>Assistant U.S. Attorney General Harmeet Dhillon, chief of the DOJ&rsquo;s civil rights division, <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/x.com\/AAGDhillon\/status\/2037255959823700199\">said<\/a> the probes are part of a new project called the Single-Sex Prison Initiative.
