U.S. District Judge Brian E. Murphy issued a 45\u2011page ruling halting the goverment\u2019s lead vaccine advisory group from meeting and staying vaccine recommendations issued under HHS Secretary Robert F. Kennedy,after kennedy removed certain groups from the Covid\u201119 vaccine list and reconstituted the ACIP. The AAP and other plaintiffs argued that the changes bypassed ACIP and violated the Administrative Procedure Act; Murphy found procedural flaws in replacing members and in how the schedule was revised. The decision followed a stay of one of Murphy\u2019s orders by the Supreme Court, and the March ACIP meeting to address injury and process was postponed. HHS said it would appeal,while supporters of the ruling argued the government had undermined ACIP\u2019s role. The broader dispute centers on ACIP\u2019s influence over the pediatric vaccine schedule,the balance between federal guidance and parental decision\u2011making,and related efforts to curb vaccine mandates,liability protections for manufacturers,and vaccine\u2011safety review initiatives.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>A powerful medical organization and its backers won a legal victory last week in an ongoing struggle against federal efforts to alter vaccine recommendations and return decision-making to parents.<\/p>\n<p>On March 16 U.S. District Judge Brian E. Murphy issued a <a href=\"https:\/\/childrenshealthdefense.org\/wp-content\/uploads\/PIorder.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">ruling<\/a> that effectively halted the government&rsquo;s lead vaccine recommendation group from <a href=\"https:\/\/www.cdc.gov\/acip\/meetings\/index.html\" target=\"_blank\" rel=\"noreferrer noopener\">meeting<\/a> and stayed vaccine recommendations published under U.S. Health and Human Services Secretary Robert F. Kennedy.<\/p>\n<p>The American Academy of Pediatrics (AAP) and other <a href=\"https:\/\/thefederalist.com\/2026\/02\/12\/leftist-medical-orgs-try-to-shut-down-debate-on-vaccines\/\" target=\"_blank\" rel=\"noreferrer noopener\">left-wing medical groups<\/a> sued Kennedy in July in response to his removal of pregnant women and healthy children from the Covid-19 vaccine recommended list. The group then amended its suit, filing multiple complaints challenging&nbsp; Kennedy&rsquo;s reconstituted immunization advisory panel and its votes. The AAP also challenged the revised pediatric schedule that the CDC published in January, which aligned the U.S. schedule with most developed nations by removing six vaccinations from the current schedule.<\/p>\n<p>The American Academy of Pediatrics <a href=\"https:\/\/thefederalist.com\/2026\/02\/12\/leftist-medical-orgs-try-to-shut-down-debate-on-vaccines\/\" target=\"_blank\" rel=\"noreferrer noopener\">requested<\/a> a <a href=\"https:\/\/publications.aap.org\/aapnews\/news\/34142?autologincheck=redirected\" target=\"_blank\" rel=\"noreferrer noopener\">ban<\/a> on Advisory Committee on Immunization Practices (ACIP) meetings; Murphy acquiesced in part, granting a stay on the ACIP appointment rather than an injunction, the same day the Supreme Court stayed <a href=\"https:\/\/x.com\/foxnewspolitics\/status\/2034277457243828652\" target=\"_blank\" rel=\"noreferrer noopener\">another<\/a> of his decisions. The March meeting of ACIP, at which the committee was poised to <a href=\"https:\/\/www.federalregister.gov\/documents\/2026\/02\/26\/2026-03877\/meeting-of-the-advisory-committee-on-immunization-practices\" target=\"_blank\" rel=\"noreferrer noopener\">address<\/a> Covid-19 vaccine injuries and recommendation processes, is now indefinitely postponed.<\/p>\n<p>&ldquo;The same day he is stayed for repeatedly refusing to follow the law, he issues another activist decision,&rdquo; wrote Deputy Attorney General Todd Blanche <a href=\"https:\/\/x.com\/DAGToddBlanche\/status\/2033689252777582908\" target=\"_blank\" rel=\"noreferrer noopener\">on X<\/a>. &ldquo;We will keep appealing these lawless decisions, and we will keep winning.&rdquo;<\/p>\n<p>In his <a href=\"https:\/\/childrenshealthdefense.org\/wp-content\/uploads\/PIorder.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">45-page ruling<\/a>, Murphy wrote that the government has &ldquo;undermined the integrity of its actions&rdquo; by sidestepping ACIP in the vaccine schedule revision process and replacing members without the use of &ldquo;rigorous screening.&rdquo; The newly appointed members, Murphy wrote, represent a &ldquo;procedural failure &hellip; that &hellip; fails to comport with governing law.&rdquo; Violation of the Administrative Procedure Act will likely be proven, he concluded.<\/p>\n<p>Responding to Murphy&rsquo;s decision, HHS spokesman Andrew Nixon said that the department &ldquo;looks forward to this judge&rsquo;s decision being overturned&rdquo; in a <a href=\"https:\/\/childrenshealthdefense.org\/defender\/federal-court-blocks-acip-meeting-childhood-vaccine-schedule-changes\/?utm_source=x&amp;utm_medium=social&amp;utm_campaign=defender&amp;utm_id=20260316\" target=\"_blank\" rel=\"noreferrer noopener\">statement<\/a> to The Defender.<\/p>\n<h2>The Battle over ACIP<\/h2>\n<p>The Advisory Committee on Immunization Practices&rsquo; decisions have historically dictated the pediatric vaccine schedule, which is then deployed in pediatric offices across the country, shaping mandates in states and within public institutions. Federal law <a href=\"https:\/\/www.congress.gov\/crs-product\/IF12317\" target=\"_blank\" rel=\"noreferrer noopener\">requires<\/a> the <a href=\"https:\/\/www.cdc.gov\/vaccines-for-children\/about\/index.html\" target=\"_blank\" rel=\"noreferrer noopener\">Vaccines for Children program<\/a> to adhere to ACIP&rsquo;s recommendations, and large payouts are associated with the panel&rsquo;s decisions.<\/p>\n<p>But Kennedy has distanced the process from governmental pressure by <a href=\"https:\/\/www.hhs.gov\/press-room\/hhs-protects-parents-rights-in-childrens-health-decisions.html\" target=\"_blank\" rel=\"noreferrer noopener\">deferring decision-making<\/a> to parents and their physicians and altering recommendations, not barring access. When the ACIP made modest adjustments to the vaccine schedule, HHS <a href=\"https:\/\/www.hhs.gov\/press-room\/fact-sheet-cdc-childhood-immunization-recommendations.html\" target=\"_blank\" rel=\"noreferrer noopener\">committed <\/a>to maintaining health care coverage for the 2025 schedule for children enrolled in federal health programs, offering continued access to the vaccine schedule previously in place.<\/p>\n<p>An <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/12\/aligning-united-states-core-childhood-vaccine-recommendations-with-best-practices-from-peer-developed-countries\/\" target=\"_blank\" rel=\"noreferrer noopener\">investigation<\/a> of the vaccine schedule following a December executive order <a href=\"https:\/\/www.hhs.gov\/sites\/default\/files\/assessment-of-the-us-childhood-and-adolescent-immunization-schedule-compared-to-other-countries.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">found<\/a> that the U.S. demands far more injections than other industrialized countries, including several vaccines that had <a href=\"https:\/\/www.hhs.gov\/sites\/default\/files\/assessment-of-the-us-childhood-and-adolescent-immunization-schedule-compared-to-other-countries.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">never undergone<\/a> large-scale, double-blind, placebo-controlled, randomized trials before use in the population.<\/p>\n<p>This is in large part due to the passage of the <a href=\"https:\/\/www.congress.gov\/bill\/99th-congress\/house-bill\/5546\" target=\"_blank\" rel=\"noreferrer noopener\">1986 National Childhood Vaccine Injury Act<\/a>, which <a href=\"https:\/\/amzn.to\/3YuVZYV\" >granted vaccine makers broad liability shields<\/a> from injury and death from their products.<\/p>\n<p>HHS only recently reinstated a <a href=\"https:\/\/www.hhs.gov\/press-room\/hhs-reinstates-task-force-on-safer-childhood-vaccines.html\" target=\"_blank\" rel=\"noreferrer noopener\">task force<\/a> created to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/chaos-agent-rfk-jr-challenges-biden-for-2024\/\" title=\"\u2018Chaos Agent\u2019 RFK Jr. Challenges Biden for 2024\">review vaccine safety<\/a> after it was disbanded nearly two decades ago. The disbandment left parents with a stark absence of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/peer-reviewed-cdc-study-deaths-represent-1-3-of-covid-vaccine-side-effects\/\" title=\"Peer Reviewed CDC Study: Deaths Represent 1.3% of COVID Vaccine Side Effects\">vaccine safety data<\/a>, but multiple efforts to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/minnesota-teacher-diversity-bill-could-push-out-hundreds-of-minority-educators\/\" title=\"Minnesota Teacher-Diversity Bill Could Push Out Hundreds of Minority Educators\">roll back decades<\/a> of vaccine makers&rsquo; health care market dominance are underway. The <a href=\"https:\/\/www.hhs.gov\/press-room\/hhs-reinstates-task-force-on-safer-childhood-vaccines.html\" target=\"_blank\" rel=\"noreferrer noopener\">reinstatement<\/a> of the Task Force on Safer Childhood Vaccines, congressional efforts to repeal the 1986 Act, and a RICO <a href=\"https:\/\/childrenshealthdefense.org\/wp-content\/uploads\/aap-lawsuit-complaint-redacted.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">lawsuit <\/a><a href=\"https:\/\/childrenshealthdefense.org\/defender\/chd-rico-lawsuit-against-aap-fraudulent-vaccine-safety-claims\/?itm_term=homebanner\" target=\"_blank\" rel=\"noreferrer noopener\">claiming<\/a> a &ldquo;decades-long racketeering scheme&rdquo; between the AAP and vaccine manufacturers are applying significant pressure to the status quo.<\/p>\n<hr>\n<p>      Ashley Bateman is a policy writer for The Heartland Institute.
