At a San Francisco hearing, U.S. District Judge Rita Lin reviewed Anthropic’s two federal lawsuits challenging the designation after tense negotiations over the use of Claude, the company’s AI chatbot. The Pentagon argued the label targets risk management and authorization for DoD use, while Anthropic contends the move amounts to retaliation aimed at suppressing scrutiny of government contracting. The hearing ended without a ruling, wiht Lin indicating an order would likely be issued in a few days; lawyers debated the scope of authority under 10 U.S.C. § 3252 and whether DoD could categorically bar contractors from using Anthropic’s products for non-DoD work. The case highlights broader questions about how much control the military should exert over AI technology and how private AI firms should accommodate government demands.

Judge suggests Pentagon’s ‘supply-chain risk’ label for Anthropic attempts to ‘cripple’ company

A California judge said on Tuesday that it appears the Department of War’s decision to label Anthropic a “supply-chain risk” amid a dispute about how the department can use the platform “looks like an attempt to cripple” the company.

U.S. District Judge Rita Lin started the Tuesday hearing by saying in part, “It looks like DoW is punishing Anthropic for trying to bring public scrutiny to this contracting dispute, which, of course, would be a violation of the First Amendment.”

Recommended Stories

Mamdani chows on Taco Bell and Dunkin’s mukbang celebrating franchisee settlement

Biden DOJ sought more subpoenas for Patel and Republicans than previously known, records show

Transgender inmates, including MS-13 member, join lawsuit to continue taxpayer-funded sex change procedures

Anthropic has filed two federal lawsuits arguing the Trump administration’s decision to label it a security risk amounted to illegal retaliation.
