Brunswick Judicial Court District Attorney Keith Higgins also has not revealed whether he will pursue prosecution, much less stated whether he will cite Georgia&rsquo;s LIFE Act or Moore&rsquo;s alleged possession and use of an illicitly-obtained opioid as justification for the murder charges.<\/p>\n<p>&ldquo;Ms. Moore is not being charged with crimes under Georgia&rsquo;s LIFE Act. This innocent baby girl was born alive and under Georgia law, her death is being investigated and prosecuted like any other,&rdquo; Georgia Life Alliance Executive Director Elizabeth Edmonds <a href=\"https:\/\/archive.ph\/IQ72l#selection-531.131-531.216\" target=\"_blank\" rel=\"noreferrer noopener\">told<\/a> the Atlanta Journal-Constitution. <\/p>\n<h2>More to the Story<\/h2>\n<p>Moore was allegedly rushed to the hospital for severe pain in December 2025 after taking 200 milligrams of misoprostol and an opioid painkiller. Medical records <a href=\"https:\/\/www.cbsnews.com\/news\/georgia-woman-charged-murder-abortion-pills\/\" target=\"_blank\" rel=\"noreferrer noopener\">indicated<\/a> Moore was more than halfway through her pregnancy, around 22 to 24 weeks, when she delivered her baby alive.<\/p>\n<p>At that point in pregnancy, Moore&rsquo;s unborn daughter was developed enough to potentially survive outside of the womb with medical intervention. After an hour of &ldquo;struggling to breathe,&rdquo; however, the <a href=\"https:\/\/www.reuters.com\/world\/georgia-woman-faces-murder-charge-after-taking-abortion-pill-2026-03-21\/\" target=\"_blank\" rel=\"noreferrer noopener\">born-alive baby girl<\/a> with a &ldquo;beating heart&rdquo; died. The <a href=\"https:\/\/www.cbsnews.com\/news\/georgia-woman-charged-murder-abortion-pills\/\" target=\"_blank\" rel=\"noreferrer noopener\">warrant<\/a> for Moore&rsquo;s arrest indicates the oxycodone she reportedly took was detected in her deceased daughter&rsquo;s blood.<\/p>\n<p>Despite the fact that prosecutors have yet to act on Moore&rsquo;s case, corporate media across the nation have declared the 31-year-old is sitting in jail because <a href=\"https:\/\/www.cbsnews.com\/news\/georgia-woman-charged-murder-abortion-pills\/\" target=\"_blank\" rel=\"noreferrer noopener\">&ldquo;she took abortion pills to end pregnancy.&rdquo;<\/a><\/p>\n<p>&ldquo;Pregnant Georgian took an abortion drug. Now she&rsquo;s in jail on murder charge,&rdquo; The Atlanta Journal-Constitution&rsquo;s <a href=\"https:\/\/archive.ph\/IQ72l#selection-289.0-289.76\" target=\"_blank\" rel=\"noreferrer noopener\">headline declares<\/a>. <\/p>\n<p>The implication from outlets such as CBS, <a href=\"https:\/\/www.reuters.com\/world\/georgia-woman-faces-murder-charge-after-taking-abortion-pill-2026-03-21\/\" target=\"_blank\" rel=\"noreferrer noopener\">Reuters<\/a>, <a href=\"https:\/\/www.usatoday.com\/story\/news\/nation\/2026\/03\/21\/georgia-police-accuse-woman-murder-abortion-law\/89262671007\/\" target=\"_blank\" rel=\"noreferrer noopener\">USA Today<\/a>, and others is that Georgia is using its <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/americans-remember-the-48th-annual-march-for-life\/\" title=\"Americans remember the 48th annual March for Life\">pro-life protections<\/a> to wage a war on women. They also featured quotes from abortion activists declaring the charges <a href=\"https:\/\/www.reuters.com\/world\/georgia-woman-faces-murder-charge-after-taking-abortion-pill-2026-03-21\/\" target=\"_blank\" rel=\"noreferrer noopener\">&ldquo;cruel and unjust.&rdquo;<\/a> <\/p>\n<p>The warrant for Moore&rsquo;s arrest acknowledged the baby was &ldquo;a human being who was born alive and survived for one hour.&rdquo; Yet <a href=\"https:\/\/www.cbsnews.com\/news\/georgia-woman-charged-murder-abortion-pills\/\" target=\"_blank\" rel=\"noreferrer noopener\">CBS <\/a>and <a href=\"https:\/\/people.com\/veteran-31-charged-with-murder-on-suspicion-of-taking-abortion-pill-11930820\" target=\"_blank\" rel=\"noreferrer noopener\">People<\/a> repeatedly refused to recognize the premature infant&rsquo;s personhood or sex, instead inaccurately referring to the delivered baby as a &ldquo;fetus.&rdquo; In <a href=\"https:\/\/thefederalist.com\/2025\/04\/02\/media-lie-about-deported-maryland-fathers-legal-status-downplay-his-gang-ties\/\" target=\"_blank\" rel=\"noreferrer noopener\">&ldquo;Maryland Father&rdquo; fashion<\/a>, some publications, such as People, even invoked Moore&rsquo;s <a href=\"https:\/\/people.com\/veteran-31-charged-with-murder-on-suspicion-of-taking-abortion-pill-11930820\" target=\"_blank\" rel=\"noreferrer noopener\">history as a U.S. Army veteran<\/a> in headlines to elicit sympathy for her case.<\/p>\n<p>The media&rsquo;s twisted coverage didn&rsquo;t stop there. One local publication even featured an attorney outlining his strategy for Moore&rsquo;s defense.  <\/p>\n<p>&ldquo;I would hit hard on a woman&rsquo;s right,&rdquo; he said. &ldquo;A woman&rsquo;s right to privacy. The woman&rsquo;s right to control her body. The woman&rsquo;s right to make those decisions.&rdquo;<\/p>\n<p>This particular attorney, <a href=\"https:\/\/www.wsav.com\/crime-safety\/local-attorney-reacts-to-georgia-abortion-murder-charge\/\" target=\"_blank\" rel=\"noreferrer noopener\">WSAV claimed<\/a>, said that &ldquo;it may be hard for the state to prove that Moore intended to kill her baby.&rdquo; <a href=\"https:\/\/www.fox5atlanta.com\/news\/georgia-woman-accused-murder-after-allegedly-using-pills-end-pregnancy\" target=\"_blank\" rel=\"noreferrer noopener\">FOX 5 Atlanta reported<\/a>, however, that Moore allegedly told nurses, &ldquo;I know my infant is suffering, because I am the one who did the abortion.&rdquo;<\/p>\n<p>&ldquo;I want her to die,&rdquo; Moore reportedly claimed.<\/p>\n<p>One of Moore&rsquo;s friends also allegedly told police &#8203;that the woman downed the abortion drugs because she <a href=\"https:\/\/www.reuters.com\/world\/georgia-woman-faces-murder-charge-after-taking-abortion-pill-2026-03-21\/\" target=\"_blank\" rel=\"noreferrer noopener\">&ldquo;did not want another child.&rdquo;<\/a><\/p>\n<p><a href=\"https:\/\/www.legis.ga.gov\/api\/legislation\/document\/20192020\/187013\" target=\"_blank\" rel=\"noreferrer noopener\">Georgia&rsquo;s LIFE Act<\/a> prohibits abortion once an unborn baby is determined to have a &ldquo;detectable human heartbeat,&rdquo; around six weeks gestation. And charging someone for violating the 2019 abortion limits is legally permissible, as at least one Georgia defense attorney has <a href=\"https:\/\/www.cbsnews.com\/news\/georgia-woman-charged-murder-abortion-pills\/\" target=\"_blank\" rel=\"noreferrer noopener\">conceded<\/a>.<\/p>\n<p><a href=\"https:\/\/law.justia.com\/codes\/georgia\/title-16\/chapter-5\/article-1\/section-16-5-1\/\" target=\"_blank\" rel=\"noreferrer noopener\">The more commonly invoked Peach State law<\/a> for charging someone with murder, however, declares that &ldquo;a person commits the offense of murder when, in the commission of a felony, he or she causes the death of another human being irrespective of malice.&rdquo; That means Moore&rsquo;s alleged possession and use of oxycodone, a serious felony punishable by prison time, automatically makes the woman eligible for murder charges.<\/p>\n<p>Even if she didn&rsquo;t repeatedly signal premeditated intent to end her pregnancy via abortion, Moore could still be charged and convicted under Georgia&rsquo;s murder statute.<\/p>\n<p>Moore&rsquo;s situation is not the first time media have twisted the facts about Georgia&rsquo;s lifesaving law to fearmonger and promote <a href=\"https:\/\/thefederalist.com\/2024\/08\/08\/corporate-media-claim-theres-no-such-thing-as-late-term-abortion-but-cry-when-it-is-paused\/\" target=\"_blank\" rel=\"noreferrer noopener\">radical<\/a> <a href=\"https:\/\/thefederalist.com\/2022\/09\/20\/media-activists-wont-grill-democrats-on-unpopular-abortion-extremism-because-they-agree-with-it\/\" target=\"_blank\" rel=\"noreferrer noopener\">abortion<\/a> narratives. Corporate media blamed the <a href=\"https:\/\/www.legis.ga.gov\/api\/legislation\/document\/20192020\/187013\" target=\"_blank\" rel=\"noreferrer noopener\">Peach State&rsquo;s pro-life law<\/a> for the death of Amber Thurman, a Georgia woman who&nbsp;<a href=\"https:\/\/thefederalist.com\/2024\/09\/20\/amber-thurman-died-from-the-abortion-pill-not-pro-life-laws\/\" target=\"_blank\" rel=\"noreferrer noopener\">died<\/a>&nbsp;alongside her twin babies after suffering the dangerous and fatal side effects associated with mifepristone.
