The charges began as a <a href=\"https:\/\/amzn.to\/3YuVZYV\" >felony civil rights violation<\/a> under 18 U.S.C. \u00a7 242 but, after multiple rulings, a federal judge reduced them to a misdemeanor and later struck the felony allegations. Dept. to Support Controversial Donor Disclosure Rule\">shaky legal footing<\/a> after repeated rulings during the <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/biden-administration\/\">Biden administration<\/a>. Prosecutors originally brought the indictment in August 2023, alleging a felony civil rights violation under <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/18\/242\">18 U.S.C. &sect; 242<\/a>. But in August 2024, <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3133016\/court-throws-out-charges-police-officers-who-shot-breonna-taylor\/\">a federal judge struck<\/a> the felony allegations and reduced the charge to a misdemeanor, finding the government had not sufficiently linked the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/cruz-responds-to-faucis-attack-on-him-in-scathing-statement-doubles-down-on-call-for-criminal-probe\/\" title=\"Cruz Responds To Fauci\u2019s Attack On Him In Scathing Statement, Doubles Down On Call For Criminal Probe\">alleged false statements<\/a> in the warrant to Taylor&rsquo;s death.<\/p>\n<p>Rather than appeal, Biden-era prosecutors pursued a superseding indictment in October 2024 in an attempt to bolster the case with additional factual allegations. That effort also failed. In August, the court again struck the felony component, once more reducing the charge to a misdemeanor and dealing a second blow to the prosecution&rsquo;s central theory.<\/p>\n<p>Following that ruling, the <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/trump-administration\/\">Trump administration<\/a>&rsquo;s DOJ conducted a further review and ultimately opted to abandon the case altogether. (Louisville Police via AP, File)<\/figcaption><\/figure>\n<\/p><\/div>\n<p>Attorneys for Jaynes and Meany were notified of the motion and do not oppose dismissal, according to the filing, which was signed by Assistant Attorney General for the Civil Rights Division Harmeet Dhillon and Acting Chief of the Criminal Section, Katie Neff.<\/p>\n<p>The charges centered on allegations that Jaynes falsified information in a warrant affidavit tied to a no-knock drug raid targeting a suspect who no longer lived at Taylor&rsquo;s apartment, while Meany was accused of approving the warrant despite the alleged inaccuracies. The March 2020 raid ended when Taylor&rsquo;s boyfriend fired at officers, who returned fire and fatally shot Taylor.<\/p>\n<p>Taylor&rsquo;s death became a national flashpoint and coincided with public outcry in 2020 over the death of <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/george-floyd\/\">George Floyd<\/a>, and the <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/black-lives-matter\/\">Black Lives Matter<\/a> protests and riots that followed. Her death led to sweeping federal civil rights investigations during the Biden administration, including charges against multiple officers involved in the case.<\/p>\n<p><strong><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/4498807\/justice-department-sues-harvard-university-antisemitism-flourishing-campus\/\">DOJ SUES HARVARD FOR ALLOWING &lsquo;FLOURISH&rsquo; OF ANTISEMITISM ON CAMPUS<\/a><\/strong><\/p>\n<p>The DOJ has also sought the release of the only officer currently serving prison time related to Taylor&rsquo;s death, Brett Hankison, while his appeal is pending.
