Asks Supreme Court to Save Obamacare\">legal filing<\/a> to having a sexual affair with her former bodyguard, Matthew Ammel, as part of a motion to dismiss a lawsuit filed by Ammel\u2019s ex-wife, Heather Ammel.The affair began in May 2024 while Sinema was in Congress and Ammel was still married; the couple separated five months later. Heather Ammel\u2019s lawsuit in North Carolina seeks damages under the state\u2019s alienation of affection statute and has been moved to the U.S. District Court for the Middle District of North Carolina.<\/p>\n<p>sinema is attempting to have the complaint dismissed on jurisdiction grounds,arguing that the <a href=\"https:\/\/amzn.to\/3YuVZYV\" >relationship largely occured<\/a> outside North Carolina and that NC law does not apply. It permits litigation against a third party if the plaintiff&rsquo;s relationship with their spouse was purposefully &ldquo;alienated and destroyed&rdquo; by said party.<\/p>\n<p><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/campaigns\/congressional\/4490626\/republican-congress-not-doing-enough-midterm-elections\/\"><strong>CONSERVATIVES COMPLAIN GOP CONGRESS ISN&rsquo;T DOING ENOUGH AHEAD OF MIDTERM ELECTIONS<\/strong><\/a><\/p>\n<p>In January, lawyers for Ammel&rsquo;s ex-wife <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.ncmd.103845\/gov.uscourts.ncmd.103845.1.0_1.pdf\" type=\"link\" id=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.ncmd.103845\/gov.uscourts.ncmd.103845.1.0_1.pdf\">requested that the case<\/a> be heard in federal court rather than the state court, because the dispute involves a former member of Congress. The lawsuit is now before the U.S. District Court for the Middle District of North Carolina for consideration.<\/p>\n<p>Sinema is now trying to dismiss the complaint, claiming that the relationship occurred &ldquo;exclusively outside of North Carolina&rdquo; and therefore the state&rsquo;s law did not have jurisdiction. <\/p>\n<p>But Heather Ammel disputes that claim.<\/p>\n<p>&ldquo;Plaintiff grounds her assertion of jurisdiction on romantic telephone calls and electronic messages she alleges Defendant initiated with Mr. Ammel while he was in North Carolina. The evidence, however, refutes her allegations,&rdquo; Sinema&rsquo;s attorney Steven Epstein wrote in the <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.ncmd.103845\/gov.uscourts.ncmd.103845.15.0.pdf\" type=\"link\" id=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.ncmd.103845\/gov.uscourts.ncmd.103845.15.0.pdf\">23-page motion<\/a>.<\/p>\n<p><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/campaigns\/congressional\/4460164\/trump-endorsement-tracker-gop-2026-election-primaries\/\"><strong>TRUMP ENDORSEMENT TRACKER: HERE&rsquo;S WHO THE PRESIDENT HAS PICKED IN GOP MIDTERM ELECTION PRIMARIES<\/strong><\/a><\/p>\n<p>&ldquo;During the relevant time period, Mr. Ammel was traveling outside of North Carolina for at least three different jobs all but a few days each month,&rdquo; he stated. &ldquo;Defendant documents each telephone call and email communication she had with him&mdash;none of which occurred while he was in North Carolina.&rdquo;<\/p>\n<p>In that view, Sinema and Ammel allegedly did not send &ldquo;romantic Signal messages&rdquo; in North Carolina. However, there was one romantic message transmitted between the two in the state after the bodyguard found a new home in October 2024. His then-wife told him to leave their house.<\/p>\n<p>Sinema&rsquo;s lawyer argues that one example &ldquo;did not give rise to Plaintiff&rsquo;s cause of action for alienation of affection and, therefore, cannot establish personal jurisdiction over Defendant.&rdquo;<\/p>\n<p>&ldquo;Because Defendant&rsquo;s conduct related to her romantic relationship with Mr. Ammel does not connect her to North Carolina in a meaningful way, jurisdiction over her in this action does not comport with due process,&rdquo; the court filing reads.<\/p>\n<p>Furthermore, the defense argues that Sinema&rsquo;s text message, sent from either Paris or Utah in October 2024, had no &ldquo;bearing on the destruction of marital love and affection&rdquo; between the Ammels.<\/p>\n<p>Because they were already planning to file for divorce by that point, per the motion, there is &ldquo;no room for argument that the marriage still had a heartbeat at the moment he received Defendant&rsquo;s message.&rdquo;<\/p>\n<p><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/4040585\/where-house-senate-retirements-stand-2026\/\"><strong>HERE&rsquo;S WHERE HOUSE AND SENATE RETIREMENTS STAND IN 2026<\/strong><\/a><\/p>\n<p>As a result of those reasons, the defendant wants to dismiss the lawsuit.<\/p>\n<p>Two months before starting the affair, Sinema decided to leave the <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/senate\/\" type=\"post_tag\" id=\"8765\">Senate<\/a> at the end of her sole term in 2024.
