The Biden appointee <a href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/4471956\/biden-judge-strikes-third-country-deportation-high-court-allowed\/\" target=\"_blank\" rel=\"noreferrer noopener\">issued<\/a> a ruling last month declaring the administration&rsquo;s efforts to deport illegal aliens to &ldquo;third countries&rdquo; (nations other than the individual&rsquo;s country-of-origin) to be unlawful and blocked its enforcement. <\/p>\n<div class=\"fdrlst__b89e9-paragraph-2 d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-1317996620\">\n<div id=\"div-gpt-ad-1463670073398-0\" class=\"mb-30\"><\/div>\n<\/div>\n<p>The 1st Circuit panel of two Biden appointees and a Bush 43 appointee determined &ldquo;[a]fter careful review&rdquo; that an administrative stay temporarily pausing Murphy&rsquo;s order &ldquo;is appropriate.&rdquo; The judges further indicated their intent to &ldquo;promptly&rdquo; issue a complete ruling on revoking the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/justice-alito-moves-up-deadline-for-supreme-court-briefing-in-pennsylvania-lawsuit-to-flip-the-election\/\" title=\"Justice Alito Moves Up Deadline For ... Briefing in Pennsylvania Lawsuit to Flip the Election\">lower court&#038;rsquo<\/a>;s blockade. <\/p>\n<p>The appellate court&rsquo;s decision authorizes the Trump administration to move forward with its deportation policy as litigation on the matter continues. <\/p>\n<p>Wednesday&rsquo;s ruling comes as another humiliating moment for Murphy, who has a history of openly defying the U.S. Supreme Court on the matter.<\/p>\n<p>The nation&rsquo;s highest court <a href=\"https:\/\/thefederalist.com\/2025\/06\/24\/scotus-agrees-trump-admin-can-carry-out-third-country-deportations\/\" target=\"_blank\" rel=\"noreferrer noopener\">temporarily stayed<\/a> (6-3) a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/judge-halts-biden-vaccine-mandate-for-federal-contractors\/\" title=\"Judge Halts Biden Vaccine Mandate For Federal Contractors\">preliminary injunction issued<\/a> by Murphy last year on the administration&rsquo;s &ldquo;third country&rdquo; deportations. Not to be outdone, the Biden appointee issued a directive to the federal government hours later, in which he <a href=\"https:\/\/thefederalist.com\/2025\/06\/24\/rogue-federal-judge-openly-defies-supreme-court-ruling-on-deportation-of-violent-criminal-illegals\/\" target=\"_blank\" rel=\"noreferrer noopener\">claimed<\/a> that his initial block on the policy was not affected by the Supreme Court&rsquo;s ruling. <\/p>\n<p>The Trump administration subsequently asked the Supreme Court to clarify its order. This time, in a 7-2 decision, the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/scotus-needs-to-extend-reverse-discrimination-ban-to-schools\/\" title=\"SCOTUS Needs To Extend Reverse Discrimination Ban To Schools\">high court affirmed<\/a> that its ruling did, in fact, cover Murphy&rsquo;s initial injunction. <\/p>\n<p>The <a href=\"https:\/\/amzn.to\/3YuVZYV\" >incident prompted stinging criticisms<\/a> from Associate Justice Elena Kagan. In a statement <a href=\"https:\/\/thefederalist.com\/2025\/07\/07\/if-justice-kagan-wants-respect-from-lower-courts-she-should-shut-down-their-judicial-coup\/\" target=\"_blank\" rel=\"noreferrer noopener\">concurring<\/a> with the high court&rsquo;s clarification, the Obama appointee noted that while she disagreed with the Supreme Court&rsquo;s initial decision to block Murphy&rsquo;s injunction, she does &ldquo;not see how a district court can compel compliance with an order that this Court has stayed.&rdquo;<\/p>\n<p>The legal battle over the Trump administration&rsquo;s deportation policies is one of many playing out in federal courtrooms across America, as left-wing activists wage a full-throated judicial coup against the sitting president. <\/p>\n<p>Filing lawsuits in district courts <a href=\"https:\/\/thefederalist.com\/2025\/06\/18\/80-percent-of-anti-trump-lawsuits-are-filed-in-courts-ruled-by-democrat-appointees\/\" target=\"_blank\" rel=\"noreferrer noopener\">dominated<\/a> by Democrat-appointed judges, these leftists have sought to weaponize the legal system to grind the administration&rsquo;s policy agenda to a halt. And in many cases, these rogue judges have played along with such a strategy. <\/p>\n<p>Just last week, a three-judge panel on the D.C. Circuit Court of Appeals <a href=\"https:\/\/thefederalist.com\/2026\/03\/10\/year-into-trump-2-0-judicial-insurrectionists-reign-supreme\/\" target=\"_blank\" rel=\"noreferrer noopener\">shot down<\/a> a request by the government to freeze a lower court blockade on its revocation of Temporary Protected Status for hundreds of thousands of Haitian nationals residing in the United States.
