The three-judge panel-two Biden appointees and one Bush appointee-granted an administrative stay of a February 25 order, indicating they will issue a fuller ruling soon. The decision preserves a key deportation tool for now, despite U.S. District Judge Brian Murphy’s earlier finding that the policy was not legal. The Supreme Court had previously allowed the policy to continue on an interim basis, so Wednesday’s stay represents a rare win for the administration in this circuit. If upheld on appeal, the policy would allow deportations to countries other than the migrants’ country of origin while the case proceeds.

Appeals court allows Trump to continue ‘third country’ deportations for now

A federal appeals court allowed the Trump administration to continue deporting illegal immigrants to third countries, temporarily blocking a lower court’s order that found the policy unlawful.

A three-judge panel on the U.S. Court of Appeals for the First Circuit issued an administrative stay of a Feb. 25 order that had blocked the policy, which was due to go into effect on Thursday.
