However, the rate of such rulings has increased during Trump&rsquo;s second term.<\/p>\n<p>The second Trump administration filed 19 emergency docket applications in its first 20 weeks last year, equaling the total filed by the Biden administration over four years, per an <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.stevevladeck.com\/p\/bonus-157-why-the-supreme-court-keeps\" type=\"link\" id=\"https:\/\/www.stevevladeck.com\/p\/bonus-157-why-the-supreme-court-keeps\">analysis<\/a> by Georgetown University law professor Stephen Vladeck. About 33 emergency applications have been filed so far since Trump&rsquo;s return to office, <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.brennancenter.org\/our-work\/analysis-opinion\/supreme-court-abuse-shadow-docket-under-trump\" type=\"link\" id=\"https:\/\/www.brennancenter.org\/our-work\/analysis-opinion\/supreme-court-abuse-shadow-docket-under-trump\">according to<\/a> the Brennan Center for Justice.<\/p>\n<p>Kavanaugh noted his and the other justices&rsquo; distaste for the emergency docket while acknowledging that the high court has to &ldquo;have the same position regardless of who is president.&rdquo; Jackson agreed.<\/p>\n<p>But where she differs is that the rulings in favor of the <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/trump-administration\/\" type=\"post_tag\" id=\"339\">Trump administration<\/a> further bolster its executive power and potentially shift the law. Justice Amy Coney Barrett <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.courthousenews.com\/barrett-spurns-supreme-court-bias-claims-after-string-of-trump-shadow-docket-wins\/\" type=\"link\" id=\"https:\/\/www.courthousenews.com\/barrett-spurns-supreme-court-bias-claims-after-string-of-trump-shadow-docket-wins\/\">disputed this claim<\/a> while promoting her book last fall.<\/p>\n<p>In a landmark 6-3 decision last month, the Supreme Court ruled against the Trump administration regarding the future of <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/tariffs\/\" type=\"post_tag\" id=\"584\">tariffs<\/a> implemented under the International Emergency Economic Powers Act. The court quickly drew Trump&rsquo;s ire over the ruling.
