It highlights recent actions by a DC Circuit panel (mostly Biden- and Democrat-appointed) that refused to pause a ruling by judge Ana Reyes, who blocked the governance\u2019s revocation of Temporary Protected Status (TPS) for Haitians. The article portrays Reyes as a partisan actor-noting her past political donations and her stance on gender and military service policies-and argues her injunction exemplifies a broader pattern of judicial activism in which lower courts circumvent Supreme Court guidance.<\/p>\n<p>The author argues that the Supreme Court has twice allowed the Trump administration to revoke TPS designations, and that lower courts should follow that precedent. Citing Justice Neil Gorsuch, the piece contends that judges must respect the hierarchy of the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/army-vet-plans-to-appeal-ninth-circuit-ruling-against-gun-carry\/\" title=\"Army Vet Plans to Appeal Ninth Circuit Ruling Against Gun Carry\">federal court system<\/a> and not defy Supreme Court guidance. It criticizes Reyes\u2019 reasoning for blocking TPS revocation as politically charged and inconsistent with established procedure, suggesting similar behavior by other Democrat-appointed judges who have blocked immigration reforms, impeded deportations to third countries, or blocked energy projects.<\/p>\n<p>the article claims this pattern demonstrates a judicial \u201ccoup\u201d or usurpation of power by activists in the bench, arguing that the separation of powers is being eroded as the judiciary expands beyond its constitutional boundaries. It laments the lack of pushback from Congress and Republican leaders, arguing that without stronger action from the other branches, the judiciary will effectively rule the country.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>When Democrats&rsquo; lawfare failed to keep Donald Trump out of the White House, the party of &ldquo;democracy&rdquo; turned to the last available lever of power they possessed to stop Orange Man Bad: the lower judiciary. <\/p>\n<p>Through the art of judge-shopping, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/kamala-harris-condemns-d-c-demonstrators-despite-past-encouragement-of-violent-blm-mobs\/\" title=\"Kamala Harris condemns D.C. demonstrators despite past encouragement of violent BLM mobs\">left-wing activists<\/a> and groups have spent the past year strategically filing lawsuits in districts <a href=\"https:\/\/thefederalist.com\/2025\/06\/18\/80-percent-of-anti-trump-lawsuits-are-filed-in-courts-ruled-by-democrat-appointees\/\" target=\"_blank\" rel=\"noreferrer noopener\">dominated<\/a> by Democrat and liberal Republican appointees to challenge virtually every aspect of Trump&rsquo;s agenda. And with little convincing rationale, many of these rogue judges have eagerly <a href=\"https:\/\/thefederalist.com\/tag\/judicial-coup\/\" target=\"_blank\" rel=\"noreferrer noopener\">issued<\/a> overreaching orders blocking the president from enacting it.<\/p>\n<p>The latest example of this phenomenon came on Friday, when a three-judge panel comprised mostly of Democrat appointees <a href=\"https:\/\/media.cadc.uscourts.gov\/orders\/docs\/2026\/03\/26-5050Final.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">rejected<\/a> (2-1) a request by the Trump administration to pause a <a href=\"https:\/\/www.courtlistener.com\/docket\/70965949\/124\/lesly-miot-v-trump\/\" target=\"_blank\" rel=\"noreferrer noopener\">ruling<\/a> by D.C. District Judge <a href=\"https:\/\/thefederalist.com\/tag\/ana-reyes\/\" target=\"_blank\" rel=\"noreferrer noopener\">Ana Reyes<\/a>. In her order, the Biden-appointed Reyes <a href=\"https:\/\/www.newsweek.com\/judge-blocks-trump-haiti-tps-termination-11455548?utm_term=Autofeed&amp;utm_medium=Social&amp;utm_source=Twitter#Echobox=1770080717\" target=\"_blank\" rel=\"noreferrer noopener\">blocked<\/a> the government from revoking <a href=\"https:\/\/www.uscis.gov\/humanitarian\/temporary-protected-status#Countries%20Currently%20Designated%20for%20TPS\" target=\"_blank\" rel=\"noreferrer noopener\">Temporary Protected Status (TPS)<\/a> for more than 350,000 Haitian nationals residing in the United States under the program.<\/p>\n<p>Reyes is <a href=\"https:\/\/thefederalist.com\/2025\/03\/19\/biden-judge-blocking-the-militarys-trans-policy-donated-thousands-to-democrat-candidates-causes\/\" target=\"_blank\" rel=\"noreferrer noopener\">known for<\/a> previously donating to Democrat candidates and causes prior to becoming a judge. Since Trump&rsquo;s return to office, she&rsquo;s also <a href=\"https:\/\/thefederalist.com\/2025\/03\/20\/valley-girl-federal-judge-cites-broadway-play-rips-up-constitution-in-trans-soldiers-screed\/\" target=\"_blank\" rel=\"noreferrer noopener\">attempted<\/a> to block the president&rsquo;s policy barring gender dysphoric individuals from military service.<\/p>\n<p>On its face, Reyes&rsquo; injunction and the D.C. Circuit panel&rsquo;s temporary affirmation of it are par for the course for the judicial activist crowd. But a closer examination of the situation shows how truly egregious leftists&rsquo; judicial coup has become.<\/p>\n<p>As Iowa Solicitor General Eric Wessan <a href=\"https:\/\/x.com\/EWess92\/status\/2030276827239858511?s=20\" target=\"_blank\" rel=\"noreferrer noopener\">observed<\/a>, the U.S. Supreme Court has already given the thumbs up to the Trump administration&rsquo;s revocation of TPS for foreign nationals throughout the past year. Not once, but twice. On both occasions, the justices <a href=\"https:\/\/thefederalist.com\/2025\/10\/03\/scotus-agrees-trump-can-strip-temporary-protected-status-of-venezuelan-nationals-in-america\/\" target=\"_blank\" rel=\"noreferrer noopener\">granted<\/a> <a href=\"https:\/\/thefederalist.com\/2025\/05\/19\/scotus-trump-can-deport-350k-venezuelans-biden-allowed-to-break-the-law\/\" target=\"_blank\" rel=\"noreferrer noopener\">emergency requests<\/a> to temporarily stay lower court injunctions barring the government from axing TPS designations for hundreds of thousands of Venezuelans.<\/p>\n<p>Critics will argue that, because these decisions came from the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/scotus-overturns-chevron-doctrine-upends-administrative-state\/\" title=\"SCOTUS Overturns Chevron Doctrine, Upends Administrative State\">high court&#038;rsquo<\/a>;s <a href=\"https:\/\/thefederalist.com\/2025\/09\/16\/in-listening-to-the-law-justice-barrett-gives-americans-a-peek-inside-the-supreme-court\/\" target=\"_blank\" rel=\"noreferrer noopener\">emergency docket<\/a> and did not include lengthy legal explanations, there is no precedent for the lower courts to abide by. But any logical person would conclude that if the Supreme Court agrees &mdash; even temporarily &mdash; that the president can terminate TPS for one group of foreign nationals, then such a standard should be applied by lower courts to the administration&rsquo;s axing of TPS for other groups of foreign nationals in similar cases.<\/p>\n<p>Justice Neil Gorsuch all but <a href=\"https:\/\/thefederalist.com\/2025\/08\/22\/justice-gorsuch-gives-rogue-lower-courts-the-smackdown-they-deserve\/\" target=\"_blank\" rel=\"noreferrer noopener\">said as much<\/a> in a separate case dealing with Trump&rsquo;s efforts to curtail DEI throughout the federal government. Noting rogue judges&rsquo; repeated attempts to sidestep the Supreme Court&rsquo;s guidance on the issue, the justice wrote, &ldquo;All these interventions should have been unnecessary, but together they underscore a basic tenet of our judicial system: Whatever their own views, judges are duty-bound to respect &lsquo;the hierarchy of the <a href=\"https:\/\/amzn.to\/3YuVZYV\" >federal court system created<\/a> by the Constitution and Congress.&rsquo;&rdquo;<\/p>\n<p>Put another way, lower courts are not free to defy SCOTUS. <\/p>\n<p>But let&rsquo;s take the Supreme Court out of the equation and examine Reyes&rsquo; justification for blocking Trump&rsquo;s revocation of TPS for Haitians. <\/p>\n<p>As <a href=\"https:\/\/www.nytimes.com\/2026\/03\/06\/us\/haiti-tps-appeals-court.html\" target=\"_blank\" rel=\"noreferrer noopener\">described<\/a> by the hoax-peddling New York Times, the Biden appointee &ldquo;noted that the Trump administration had rescinded the designation for 12 countries since last year <em>without conducting individualized analyses<\/em>, which she said backed the plaintiffs&rsquo; claims that stripping Haitians of the status had been preordained&rdquo; [emphasis added]. She also &ldquo;concluded that the Trump administration&rsquo;s decision was motivated by racial or national origin animus, citing statements by senior government officials about Haitian and other nonwhite immigrants.&rdquo;<\/p>\n<p>So, under Reyes&rsquo; logic (if one can even call it that), President Biden can unilaterally issue a <a href=\"https:\/\/apnews.com\/article\/temporary-protected-status-tps-haiti-haitians-biden-e92b8de782d2c1218dd1be1899aa926d\" target=\"_blank\" rel=\"noreferrer noopener\">blanket extension<\/a> of TPS for hundreds of thousands of Haitian nationals, but Trump must undertake thorough and rigorous &ldquo;individualized analyses&rdquo; before he can revoke it. And to top it all off, the Biden appointee not-so-subtly accused the administration&rsquo;s actions of being racially motivated.<\/p>\n<p>That&rsquo;s not sound argumentation from a judge. It&rsquo;s a political rant coated in legal language from a hyper left-wing activist who has no respect for the <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/28\/453\" target=\"_blank\" rel=\"noreferrer noopener\">oath<\/a> she took to &ldquo;faithfully and impartially&rdquo; administer justice in accordance with the Constitution. <\/p>\n<p>But Reyes is not alone in her conduct. There are dozens of Ana Reyeses in district courts across the country who are happily putting America&rsquo;s founding document through the paper shredder to give their political allies the outcomes they want. <\/p>\n<p>Within the past few weeks alone, Democrat-appointed judges have issued orders <a href=\"https:\/\/www.reuters.com\/legal\/government\/us-judge-blocks-trump-bid-fast-track-dismissals-immigration-appeals-2026-03-09\/\" target=\"_blank\" rel=\"noreferrer noopener\">blocking<\/a> the Trump administration from enacting new immigration reforms, <a href=\"https:\/\/www.foxnews.com\/politics\/doj-appeals-biden-appointed-judges-block-third-country-deportations-after-supreme-court-steps-twice\" target=\"_blank\" rel=\"noreferrer noopener\">halting<\/a> the deportation of illegal aliens to so-called &ldquo;third countries,&rdquo; and <a href=\"https:\/\/wyofile.com\/feds-broke-law-approving-massive-converse-gas-oil-field-court-finds\/\" target=\"_blank\" rel=\"noreferrer noopener\">nuking<\/a> a natural gas and oil project in Wyoming that was authorized by the federal government. <\/p>\n<p>Actions like these demonstrate how the judiciary has usurped basic separation of powers and extended its authority beyond what the Constitution prescribes. What was once <a href=\"https:\/\/thefederalist.com\/2025\/04\/22\/judicial-supremacy-is-a-poison-destroying-americas-constitutional-order\/\" target=\"_blank\" rel=\"noreferrer noopener\">viewed<\/a> to be the weakest branch has arguably become the most powerful. <\/p>\n<p><strong>[READ:[READ:<a href=\"https:\/\/thefederalist.com\/2026\/02\/18\/nyt-accidentally-confesses-theres-a-left-wing-judicial-coup-against-trump\/\" target=\"_blank\" rel=\"noreferrer noopener\">NYT Accidentally Confesses There&rsquo;s A Left-Wing Judicial Coup Against Trump<\/a>]<\/strong><\/p>\n<p>And yet, the primary reason this judicial tyranny has continued to persist is the lack of pushback from the other two branches. <\/p>\n<p>Despite holding majorities in both chambers of Congress and oversight of the lower judiciary, elected Republicans have <a href=\"https:\/\/thefederalist.com\/2026\/01\/14\/46-house-republicans-help-democrats-defeat-measure-defunding-activist-judges-boasberg-boardman\/\" target=\"_blank\" rel=\"noreferrer noopener\">declined<\/a> to punish activist judges and districts for their appalling conduct. <a href=\"https:\/\/thefederalist.com\/2025\/06\/26\/if-trump-doesnt-reject-judicial-supremacism-his-presidency-is-finished\/\" target=\"_blank\" rel=\"noreferrer noopener\">Trump<\/a> and his administration have also shirked away from confronting such insubordination. <\/p>\n<p>If members of the judiciary are usurping their authority and violating the Constitution, that does not require the other branches to play along. If anything, they have an obligation to reject such tyranny and uphold America&rsquo;s founding document. <\/p>\n<p>Thus far, that hasn&rsquo;t happened.
