\t\t\t\t\tobserveElement(paragraphToObserve); \t\t\t\t}); \t\t\t} \t\t<\/script> <\/p>\n<p>The judge in question is Judge Sara Ellis, <a href=\"https:\/\/www.fjc.gov\/history\/judges\/Ellis-Sara-Lee\" target=\"_blank\" rel=\"noopener\">nominated to the bench<\/a> in 2013 by that old Chicago pol Obama.<\/p>\n<p>In October, according to the <a href=\"https:\/\/media.ca7.uscourts.gov\/cgi-bin\/OpinionsWeb\/processWebInputExternal.pl?Submit=Display&amp;Path=Y2026\/D03-05\/C:25-3023:J:PerCuriam:aut:T:fnOp:N:3503186:S:0\" target=\"_blank\" rel=\"noopener\">appeals court decision<\/a> Thursday, she issued a <a href=\"https:\/\/www.westernjournal.com\/obama-appointed-judge-trying-take-control-border-patrol-chicago\/\" target=\"_blank\" rel=\"noopener\">wide-ranging injunction<\/a> against the DHS&rsquo;s use of crowd-control techniques as part of Operation Midway Blitz, the Trump administration&rsquo;s crackdown on illegal immigration and crime in Chicago.<\/p>\n<p>The ruling amounted to a &ldquo;a sweeping preliminary injunction regulating all federal immigration enforcement efforts districtwide,&rdquo; the appeals ruling stated.<\/p>\n<p>As part of it, Ellis ordered the then-head of DHS operations in Chicago, Gary Bovino, to appear before her daily to explain the agency&rsquo;s compliance.<\/p>\n<p>In November, she issued a novelistic <a href=\"https:\/\/www.courtlistener.com\/docket\/71559589\/281\/chicago-headline-club-v-noem\/\" target=\"_blank\" rel=\"noopener\">233-page ruling<\/a> (that started with a paean to Chicago writer Carl Sandberg) supporting her injunction and excoriating, at length, the DHS and its personnel.<\/p>\n<p>As the <a href=\"https:\/\/www.legalnewsline.com\/site\/about.html\" target=\"_blank\" rel=\"noopener\">court-oriented website<\/a> Legalnewsline summarized in a <a href=\"https:\/\/www.legalnewsline.com\/cook-county-record\/appeals-panel-erases-judge-s-anti-ice-order-warns-against-similar-rulings\/article_afcb910a-c7e0-49da-bee0-7b0b7f022eea.html\" target=\"_blank\" rel=\"noopener\">piece on Friday<\/a>:<\/p>\n<p>&ldquo;In her ruling, Ellis famously sided almost entirely with the anti-government position, blocking ICE and Border Patrol agents associated with the now-ended &lsquo;Operation Midway Blitz&rsquo; and other immigration enforcement operations from using physical force or riot control weapons or even from &lsquo;issuing a crowd dispersal order&rsquo; requiring so-called protestors &lsquo;to leave a public place that they lawfully have a right to be.&rsquo;<\/p>\n<p>&ldquo;The <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/facing-appeals-loss-activists-withdraw-suit-that-had-frozen-ice\/\" title=\"Facing appeals loss, activists withdraw suit that had frozen ICE\">order prohibited federal agents<\/a> from &lsquo;using hands-on physical force such as pulling or shoving to the ground, tackling, or body slamming&rsquo; anyone &lsquo;who is not causing an immediate threat of physical harm to others &hellip;&rsquo;<\/p>\n<p>&ldquo;The order also granted those claiming to be journalists the right to remain in an area undisturbed, even after an otherwise lawful dispersal order was given.&rdquo;<\/p>\n<p>The Trump administration appealed, and the appeals court stayed Ellis&rsquo; ruling while arranging to hear the case in full.<\/p>\n<p>But things took a turn in December when the plaintiffs in the case &mdash; protesters and journalists who accused the DHS of violating First Amendment and Fourth Amendment rights &mdash; asked Ellis to dismiss their case &mdash; allegedly because clashes from <a href=\"https:\/\/www.westernjournal.com\/trump-drops-new-chicago-crime-stats-midway-blitz-continues-cut-crime-dramatically-despite-state-city-leaders-supporting-criminals\/\" target=\"_blank\" rel=\"noopener\">Midway Blitz<\/a> had died down in the Chicago area and the point was &ldquo;moot,&rdquo; legally.<\/p>\n<p>As Legalnewsline noted, however, the motive was far more likely that the plaintiffs knew the appeals court would not be as malleable as Ellis, and didn&rsquo;t want to lose a precedent-setting case.<\/p>\n<p>The Justice Department also wanted the appeal dismissed, but under a deliberate legal strategy that would have kept its points intact.<\/p>\n<p>In the end, Ellis tried to dismiss the case but did so &ldquo;without prejudice,&rdquo; meaning it could be activated again.
