The question is: Will they take it?<\/p>\n<p>There is currently a pair of companion bills making their way through the GOP-controlled Tennessee Legislature (<a href=\"https:\/\/wapp.capitol.tn.gov\/apps\/BillInfo\/Default?BillNumber=SB0836&amp;GA=114\" target=\"_blank\" rel=\"noreferrer noopener\">SB 836<\/a> and <a href=\"https:\/\/wapp.capitol.tn.gov\/apps\/BillInfo\/Default?BillNumber=HB0793&amp;GA=114\" target=\"_blank\" rel=\"noreferrer noopener\">HB 793<\/a>) that would authorize <a href=\"https:\/\/law.justia.com\/codes\/tennessee\/title-49\/chapter-1\/part-1\/section-49-1-103\/\" target=\"_blank\" rel=\"noreferrer noopener\">Local Education Agencies<\/a> (aka &ldquo;public school systems&rdquo;) &ldquo;and public charter schools to refuse to enroll students who are unlawfully present in the United States.&rdquo; While SB 836 passed the Senate during last year&rsquo;s session and is currently awaiting consideration in the House, HB 793 is tied up in the lower chamber&rsquo;s committees. <\/p>\n<div class=\"fdrlst__b89e9-paragraph-2 d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-1793983490\">\n<div id=\"div-gpt-ad-1463670073398-0\" class=\"mb-30\"><\/div>\n<\/div>\n<p>The primary reason this legislation is so significant is because it tees up a direct challenge to decades-long Supreme Court precedent that has granted illegal aliens access to America&rsquo;s public education system. Known as <em><a href=\"https:\/\/www.oyez.org\/cases\/1981\/80-1538\" target=\"_blank\" rel=\"noreferrer noopener\">Plyler v. Doe<\/a><\/em>, the 1982 (5-4) ruling by Associate Justice William Brennan <a href=\"https:\/\/thefederalist.com\/2025\/11\/20\/its-past-time-red-states-challenge-scotus-decision-that-opened-americas-schools-to-illegal-aliens\/\" target=\"_blank\" rel=\"noreferrer noopener\">declared<\/a> that a revised Texas law permitting school districts to &ldquo;deny enrollment&rdquo; to illegal alien children violated the 14th Amendment&rsquo;s <a href=\"https:\/\/www.law.cornell.edu\/constitution\/amendmentxiv\" target=\"_blank\" rel=\"noreferrer noopener\">equal protection clause<\/a>. The decision effectively opened up the country&rsquo;s schoolhouse doors to unauthorized foreign nationals and their kids.  <\/p>\n<p>As The Federalist previously <a href=\"https:\/\/thefederalist.com\/2025\/11\/20\/its-past-time-red-states-challenge-scotus-decision-that-opened-americas-schools-to-illegal-aliens\/\" target=\"_blank\" rel=\"noreferrer noopener\">observed<\/a>, the high court&rsquo;s ruling has led to American taxpayers having to &ldquo;<a href=\"https:\/\/thefederalist.com\/2025\/06\/05\/nearly-one-quarter-of-u-s-public-school-enrollment-could-be-anchor-babies\/\" target=\"_blank\" rel=\"noreferrer noopener\">subsidize<\/a>&nbsp;the education of these individuals&rdquo; and schools&nbsp;&ldquo;<a href=\"https:\/\/www.heritage.org\/sites\/default\/files\/2024-02\/FS263.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">expend[ing] additional resources<\/a>&nbsp;to grapple with the issue, such as working to accommodate those students who don&rsquo;t speak English as a primary language.&rdquo; The Volunteer State &ldquo;spent $571 million on K-12 education for illegal aliens and the U.S.-born children of illegal&nbsp;aliens&rdquo; in 2023 alone, according to an <a href=\"https:\/\/www.fairus.org\/sites\/default\/files\/2023-03\/tennessee2023.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">analysis<\/a> by the <a href=\"https:\/\/www.fairus.org\/tennessee-legislature-pauses-bill-meant-challenge-taxpayer-funded-education-illegal-aliens\" target=\"_blank\" rel=\"noreferrer noopener\">Federation for American Immigration Reform<\/a>.<\/p>\n<p>Republican lawmakers specifically <a href=\"https:\/\/wpln.org\/post\/tennessee-advances-a-challenge-to-education-rights-for-immigrant-students-despite-mounting-opposition\/\" target=\"_blank\" rel=\"noreferrer noopener\">introduced<\/a> SB 836 and HB 793 as a means of contesting the Supreme Court&rsquo;s <em>Plyler<\/em> precedent. During remarks on the legislation last year, SB 836 sponsor and GOP Sen. Bo Watson <a href=\"https:\/\/www.npr.org\/2025\/05\/01\/nx-s1-5382375\/immigration-schools-republicans-tennessee-plyler\" target=\"_blank\" rel=\"noreferrer noopener\">reportedly<\/a> said that the court&rsquo;s 1982 decision &ldquo;was the voice of the court being imposed on the people,&rdquo; and that his bill &ldquo;is the voice of the people being exercised through their elected representatives.&rdquo;<\/p>\n<p>A representative for Watson acknowledged The Federalist&rsquo;s request for comment, but the senator did not provide a response.<\/p>\n<p>The legislation&rsquo;s progress during Tennessee&rsquo;s 2025 session hit a roadblock, however, when HB 793 sponsor and House Majority Leader William Lamberth &ldquo;pulled it from consideration&rdquo; after a <a href=\"https:\/\/www.capitol.tn.gov\/Bills\/114\/Fiscal\/HB0793.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">state review<\/a> found that passage of the bill could cost the state up to $1.1 billion in federal education funding, according to <a href=\"https:\/\/www.npr.org\/2025\/05\/01\/nx-s1-5382375\/immigration-schools-republicans-tennessee-plyler\" target=\"_blank\" rel=\"noreferrer noopener\">NPR<\/a>. The <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/report-the-biden-administration-has-plans-to-quash-anti-trans-legislation-in-various-states\/\" title=\"Report: The Biden Administration Has Plans To Quash \u2018Anti-Trans\u2019 Legislation In Various States\">left-wing outlet reported<\/a> that the majority leader sent a letter to the U.S. Department of Education &ldquo;asking how much of the potential $1.1 billion in federal funding would be at risk&rdquo; should the legislature enact the proposal. <\/p>\n<p>According to a February 17 <a href=\"https:\/\/www.chalkbeat.org\/tennessee\/2026\/02\/17\/undocumented-students-bill-schools-immigration-enforcement\/\" target=\"_blank\" rel=\"noreferrer noopener\">report<\/a> by Chalkbeat Tennessee, &ldquo;Lamberth said earlier this year&rdquo; that guidance from the agency &ldquo;is forthcoming.&rdquo; He also reportedly confirmed that GOP leadership wants to advance the bill this year.<\/p>\n<p>Neither the Education Department nor Lamberth responded to The Federalist&rsquo;s request for comment about the status of the requested guidance. <\/p>\n<p>If the legislature fails to pass either SB 836 and\/or HB 793 before the <a href=\"https:\/\/www.multistate.us\/resources\/2025-legislative-session-dates\" target=\"_blank\" rel=\"noreferrer noopener\">end<\/a> of the current session (April 22), the bills will <a href=\"https:\/\/sycamoretn.org\/6-things-to-know-about-legislative-session\/\" target=\"_blank\" rel=\"noreferrer noopener\">have<\/a> to be re-introduced during next year&rsquo;s session and reconsidered by both chambers. The legislation&rsquo;s passage and enactment into law, however, would likely tee up lawsuits from left-wing activists seeking to challenge its legality.<\/p>\n<p>These legal challenges could make their way to the Supreme Court for a potential reexamination of <em>Plyler<\/em>.
