\t\t\t\t\tobserveElement(paragraphToObserve); \t\t\t\t}); \t\t\t} \t\t<\/script> <\/p>\n<p>He now leads homeland security and immigration policy at the America First Policy Institute, a conservative think tank.<\/p>\n<p>Democrats and groups such as the American Civil Liberties Union argue that local law enforcement should focus on local offenses, while supporters of 287(g) partnerships say they let ICE take migrants from jails without hunting them down in neighborhoods.<\/p>\n<h3>Building The Deportation Machine<\/h3>\n<p>Congress <a href=\"https:\/\/www.congress.gov\/crs-product\/IF11898\" target=\"_blank\" rel=\"noopener noreferrer\">created the 287(g) program<\/a> through a 1996 law, years before the Bush administration formed the first agreement in 2002 during its post-9\/11 counterterrorism efforts.<\/p>\n<p>ICE later grew the 287(g) program from 35 jurisdictions to nearly 150 under Wolf&rsquo;s leadership, he noted in comments to the DCNF.<\/p>\n<p>The contracts fall into <a href=\"https:\/\/www.ice.gov\/287g\" target=\"_blank\" rel=\"noopener noreferrer\">three categories<\/a>: one allowing jail authorities to <a href=\"https:\/\/cdn01.dailycaller.com\/wp-content\/uploads\/2026\/02\/287gJEM_FrederickCoMD2020-06-09.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">identify and transfer<\/a> deportable migrant inmates to ICE, another letting police <a href=\"https:\/\/cdn01.dailycaller.com\/wp-content\/uploads\/2026\/02\/287g-MOA-TFM-Mille-Lacs-SO.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">interrogate or arrest<\/a> based on immigration violations during normal duties, and a third that involves ICE <a href=\"https:\/\/cdn01.dailycaller.com\/wp-content\/uploads\/2026\/01\/LoudounCountySO_WSO_MOA_032625.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">training officers<\/a> to execute immigration warrants on migrants in jail.<\/p>\n<p>&ldquo;The agreements force-multiply immigration enforcement and create safer conditions for federal agents, local law enforcement, and detainees,&rdquo; Wolf said.<\/p>\n<p>Former President Joe Biden acted against 287(g) contracts &ldquo;to open our borders and limit immigration enforcement,&rdquo; Wolf said. Biden&rsquo;s officials&nbsp;put a <a href=\"https:\/\/web.archive.org\/web\/20230816011743\/https:\/\/www.ice.gov\/identify-and-arrest\/287g\" target=\"_blank\" rel=\"noopener noreferrer\">freeze<\/a> on any new contracts while terminating others, according to an archived ICE webpage. Washington Examiner\">local law enforcement work<\/a> with us including 40,000 arrests in Florida,&rdquo; DHS spokeswoman Tricia McLaughlin told the DCNF.<\/p>\n<p>&ldquo;Elected officials who refuse to cooperate with DHS law enforcement are wasting law enforcement time, energy, and resources, while putting their own constituents in danger,&rdquo; McLaughlin said.<\/p>\n<h3>Anti-ICE Left Gets Wise<\/h3>\n<p>Washington state, Oregon, California, Illinois, New Jersey, Connecticut, Maine, and <a href=\"https:\/\/www.nmlegis.gov\/Legislation\/Legislation?Chamber=H&amp;LegType=B&amp;LegNo=9&amp;year=26\" target=\"_blank\" rel=\"noopener noreferrer\">New Mexico<\/a> already have state-level policies banning 287(g) partnerships, ICE&rsquo;s website and state records show. Democrats in other states aim to follow suit.<\/p>\n<p>Maryland&rsquo;s <a href=\"https:\/\/ballotpedia.org\/Party_control_of_Maryland_state_government\" target=\"_blank\" rel=\"noopener noreferrer\">Democrat-led legislature<\/a> passed legislation on Tuesday that would ban the contracts despite nine local agencies signing them, and Democratic Maryland Gov. Wes Moore said on Friday that he is &ldquo;looking forward to&rdquo; approving it, <a href=\"https:\/\/marylandmatters.org\/2026\/02\/06\/bills-to-ban-287g-agreements-in-maryland-could-be-on-governors-desk-next-week\/\" target=\"_blank\" rel=\"noopener noreferrer\">local<\/a> <a href=\"https:\/\/www.wbaltv.com\/article\/sheriffs-urge-governor-veto-maryland-ice-bills-287g\/70292023\" target=\"_blank\" rel=\"noopener noreferrer\">media outlets<\/a> reported. &ldquo;We are going to do everything in our power to keep people safe, but that does not mean deputizing the people who are keeping people safe to go perform functions by a rogue ICE agency,&rdquo; Moore reportedly said.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">Proud to stand with Sheriff&rsquo;s from across the state in opposition to SB 0245 that would prohibit Maryland counties from entering into 287(g) agreements with ICE. <a href=\"https:\/\/t.co\/GpZRLorUEI\">pic.twitter.com\/GpZRLorUEI<\/a><\/p>\n<p>&mdash; Jason Gallion (@SenatorJGallion) <a href=\"https:\/\/twitter.com\/SenatorJGallion\/status\/2013687445754106182?\">January 20, 2026<\/a><\/p>\n<\/blockquote>\n<p>Democrats in <a href=\"https:\/\/malegislature.gov\/Bills\/194\/H1588\" target=\"_blank\" rel=\"noopener noreferrer\">Massachusetts<\/a> and <a href=\"https:\/\/www.governor.ny.gov\/news\/keeping-new-yorkers-safe-governor-hochul-introduces-local-cops-local-crimes-act-stop-ice-co\" target=\"_blank\" rel=\"noopener noreferrer\">New York<\/a> also proposed bills to abolish the ICE agreements in 2025.<\/p>\n<p>Other liberal governors are taking action on their own. Democratic Massachusetts Gov. Maura Healey, whose state <a href=\"https:\/\/cdn01.dailycaller.com\/wp-content\/uploads\/2026\/02\/287g_JEM_MassDOC_06-08-2020.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">has a 287(g) jail partnership<\/a> established in 2020, <a href=\"https:\/\/www.mass.gov\/executive-orders\/no-650-protecting-access-to-essential-services-and-keeping-massachusetts-communities-safe\" target=\"_blank\" rel=\"noopener noreferrer\">signed a January executive order<\/a> telling state agencies not to sign new ones unless they are &ldquo;based on a specific, articulable public safety risk or need&rdquo; and expire after 12 months. Democratic Virginia Gov. Abigail Spanberger ordered state law enforcement agencies on Feb. 4 to scrap the five 287(g) agreements they signed in 2025 under former Republican Virginia Gov. Glenn Youngkin.<\/p>\n<p>Spanberger cannot get rid of the others signed in 2025 by over two dozen county sheriff&rsquo;s offices and two county jail authorities.
