a so-called &ldquo;secret operation&rdquo; involving various activist organizations in the Minneapolis area barging into the sanctuary together to shut down church services.<\/p>\n<p>In a Thursday <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.mnd.231102\/gov.uscourts.mnd.231102.135.0.pdf\">court filing<\/a>, the defense opposed a recent prosecution motion to treat the case as a grand conspiracy rather than a simple snap protest.<\/p>\n<p>Prosecutors told the court earlier this week that they expect the case to be a large-scale undertaking due to the massive volume of records, victim interviews, communications data tied to the defendant, and <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.youtube.com\/live\/v4ctuhv-cck\">incident footage<\/a> to sort through.<\/p>\n<p>&ldquo;The indictment arises from a single incident lasting approximately one hour at one location,&rdquo; the defense attorneys collectively wrote in response. &ldquo;It alleges no multi-year scheme, no enterprise spanning jurisdictions, [and] no extraordinary evidentiary scope.&rdquo;<\/p>\n<p><strong><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/4457764\/don-lemon-pleads-not-guilty-charges-storming-minnesota-church\/\">DON LEMON PLEADS NOT GUILTY TO CHARGES FOR STORMING MINNESOTA CHURCH<\/a><\/strong><\/p>\n<p>Federal officials are seeking to classify the case as a &ldquo;complex&rdquo; prosecution, one that necessitates a time-consuming examination of all the evidence, &ldquo;given the volume, complexity, and scope of the investigative materials.&rdquo;<\/p>\n<p>A &ldquo;complex case&rdquo; designation is a formal classification indicating that a case is too intricate to proceed within the normal 70-day timeline of the <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.justice.gov\/archives\/jm\/criminal-resource-manual-628-speedy-trial-act-1974\">Speedy Trial Act<\/a>, which mandates that a trial must commence within 70 days after a defendant is criminally charged or makes an initial courtroom appearance, whichever date is more recent.<\/p>\n<p>Alternatively, the DOJ&rsquo;s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/bidens-choice-to-lead-dojs-civil-rights-division-melanin-endows-blacks-with-greater-mental-physical-and-spiritual-abilities-video\/\" title=\"Biden\u2019s Choice to Lead ...s Civil Rights Division: \u201cMelanin Endows Blacks with Greater Mental, Physical and Spiritual Abilities\u201d (VIDEO)\">civil rights division<\/a> is requesting that the court at least extend the discovery deadline so prosecutors can adequately prepare for trial.<\/p>\n<p>Investigators estimate that the discovery process will entail prosecutors poring over approximately 2,000 pages of reports, <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.tiktok.com\/@dawokefarmer2\/video\/7596766088742833463\">multiple<\/a> <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.tiktok.com\/@dawokefarmer2\/video\/7596781668535422263\">videos<\/a> of the incident, <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.facebook.com\/nekimalevyarmstrong\/posts\/pfbid0c3mvA2mRUpZrdq6tvqVdTan1kKpEgyYJJTfmHMokGkE8YD5zkXJ1hYEsxoeurBWdl\">social media posts<\/a>, data collected from <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/investigations\/4439173\/arrested-ringleader-anti-ice-church-protest-asks-court-return-cellphone\/\">seized cellphones<\/a>, and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/must-be-dismantled-ben-jerrys-attacks-americas-police-system\/\" title=\"\u2018Mu... Be Dismantled\u2019: Ben &amp; Jerry\u2019s Attacks America\u2019s Police Sy...em\">body-worn camera footage<\/a> of St. Paul Police Department interviews with parishioners.<\/p>\n<p>In <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.mnd.231102\/gov.uscourts.mnd.231102.131.0.pdf\">a motion<\/a> filed on Tuesday, prosecutors also pointed to the large number of co-defendants as well as witnesses and church members victimized that morning. According to court documents, about 300 worshippers and parish staff were present at Cities Church on the day of the protest. (AP Photo\/Angelina Katsanis)<\/figcaption><\/figure>\n<p>&ldquo;As the investigation remains active, the number of defendants could increase,&rdquo; prosecutors added.<\/p>\n<p>The Speedy Trial Act <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/18\/3161\">says<\/a> a continuance in a case may be based on &ldquo;[w]hether the case is so unusual or so complex, due to the number of defendants, the nature of the prosecution, or the existence of novel questions of fact or law, that it is unreasonable to expect adequate preparation for pretrial proceedings or for the trial itself within the time limits.&rdquo;<\/p>\n<p>Prosecutors also cited novel legal issues that defense counsel plans to raise, including constitutional challenges under the <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/first-amendment\/\">First Amendment<\/a>.<\/p>\n<p>In its opposition filing, the defense said the government&rsquo;s motion did not explain why the amount of evidence &ldquo;exceeds the norm in multi-defendant federal prosecutions.&rdquo;<\/p>\n<p>As examples of &ldquo;appropriately designated&rdquo; complex cases, the defense lawyers referenced an 86-count retrial, a Racketeer Influenced and Corrupt Organizations Act prosecution of a major organized crime family, and an eight-defendant, 470-count indictment resulting in a three-month trial and more than 2,500 separate offenses. The defense countered that there is &ldquo;no comparable circumstance here.&rdquo;<\/p>\n<p>The <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/4429020\/doj-arrests-nekima-levy-armstrong-suspect-minnesota-church-storming\/\">jointly charged<\/a> defendants include former CNN host <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/4457764\/don-lemon-pleads-not-guilty-charges-storming-minnesota-church\/\">Don Lemon<\/a>, who filmed himself with the anti-ICE activists before, during, and after the planned protest; <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/investigations\/4427561\/organizer-of-gofundme-for-agitating-the-nazis-involved-in-anti-ice-uprising-at-minneapolis-church\/\">William Kelly<\/a>, a traveling left-wing provocateur paid to &ldquo;agitate Nazis&rdquo; at sites of political conflict across the country; BLM Twin Cities founder Chauntyll Allen, an elected <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.spps.org\/profile\/~const-id\/2867\">member<\/a> of the St. Paul Board of Education; and alleged ringleader <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.nekimalevyarmstrong.com\/\">Nekima Levy Armstrong<\/a>, head of the Minnesota-based Racial Justice Network.<\/p>\n<p><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/investigations\/4424440\/blm-coalition-anti-ice-shutdown-minneapolis-church-service\/\"><strong>BLM COALITION BEHIND ANTI-ICE SHUTDOWN OF MINNEAPOLIS CHURCH SERVICE<\/strong><\/a><\/p>\n<p>Late last month, a grand jury <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.mnd.231106\/gov.uscourts.mnd.231106.39.0_7.pdf\">indicted<\/a> Lemon, Kelly, Allen, Armstrong, and five others allegedly involved in the occupation of Cities Church on conspiracy charges. They are accused of conspiring to infringe on the religious rights of the Christian congregants in violation of the <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/4427495\/what-is-face-act-federal-charges-minnesota-church-protest\/\">FACE Act<\/a>, a federal law protecting both houses of worship and abortion clinics from political acts of intimidation, and <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/18\/241\">18 U.S.C. &sect; 241<\/a>, a Reconstruction-era civil rights conspiracy statute closely associated with the <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/history.house.gov\/Historical-Highlights\/1851-1900\/hh_1871_04_20_KKK_Act\/\">Ku Klux Klan Act<\/a>.<\/p>\n<p>Armstrong, in <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.mnd.231102\/gov.uscourts.mnd.231102.132.0.pdf\">a separate submission<\/a> to the court on Wednesday, asking for the judge to modify her conditions of release, similarly disputed the DOJ&rsquo;s characterization of events.<\/p>\n<p>&ldquo;It is critical to recognize that, unlike a more typical federal case, Ms. Levy Armstrong is not accused of being a leader of a drug trafficking conspiracy, a gang, a fraud ring, a terrorism plot, or anything that would normally be considered criminal activity or dangerous,&rdquo; Armstrong&rsquo;s defense attorney wrote. &ldquo;She was the leader of a nonviolent political protest.&rdquo;<\/p>\n<p>The court had imposed additional conditions of release on Armstrong, treating her differently from the other co-defendants, as the <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.startribune.com\/activists-interrupt-sunday-church-service-say-pastor-works-for-ice\/601566591\">self-identified<\/a> architect of the &ldquo;#ICEOut&rdquo; protest that she and other organizers <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.facebook.com\/RacialJusticeNetwork1\/posts\/pfbid035DEq2Vg2i4f9g5uEa98dcvUKs69FntbsSzpKs9cwQWbBDcsX7db75r1WaKwFi8KNl\">dubbed Operation Pull Up<\/a>.<\/p>\n<figure class=\"wp-block-image size-large is-resized\"><figcaption class=\"wp-element-caption\">Civil rights attorney Nekima Levy Armstrong poses on March 19, 2021, in Minneapolis. Kushner, argued that &ldquo;her leadership of the action is irrelevant to whether she poses any danger to the community or risk of flight.&rdquo;<\/p>\n<p>&ldquo;There is no dangerousness or risk of flight demonstrated by leading a non-violent political protest,&rdquo; Kushner, a prominent Minnesota activist <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.startribune.com\/jordan-kushner-the-pro-for-the-protester\/102195684\">known to assist anti-police protesters<\/a>, continued. &ldquo;It is fundamentally wrong and a constitutional affront to label her as dangerous for exercising her First Amendment rights.
