The RNC argues the measure violates the state constitution and would unfairly target specific localities, effectively making redistricting partisan and benefiting Democrats, who control both chambers. The suit seeks to block the forthcoming special election (set for April 21) and to halt transmission and posting of the ballot question, arguing there was no <a href=\"https:\/\/amzn.to\/3YuVZYV\" >intervening general election<\/a> as required by the constitution. The Virginia Supreme Court recently allowed the statewide referendum to proceed while courts review the measure\u2019s legality, and gov. Plaintiffs say Tazewell is the &ldquo;proper&rdquo; venue for any potential litigation concerning the proposed amendment, despite Democrats&rsquo; insistence on <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/justice-alito-launches-preemptive-strike-on-leftist-hit-piece\/\" title=\"Alito counters leftist attack with preemptive strike.\">hearing cases related<\/a> to the amendment in Richmond.<\/p>\n<p>The lawsuit asks the Tazewell County court to block state officials from holding the special election, transmitting and posting the bill&rsquo;s &ldquo;defective ballot question,&rdquo; or bringing the proposed amendment before voters this spring. It maintains that the redistricting push fails to comply with the state constitution&rsquo;s amendment process.<\/p>\n<p>The plaintiffs argue there was no &ldquo;intervening [general] election&rdquo; separating the state legislature&rsquo;s votes in favor of the amendment, as required by a clause under the Virginia Constitution.<\/p>\n<p>Last week, the Supreme Court of Virginia <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/4457454\/virginia-supreme-court-gives-go-ahead-statewide-referendum-redistricting\/\">ruled<\/a> that the statewide referendum on the proposed constitutional amendment can move forward while courts settle the measure&rsquo;s legality.<\/p>\n<p>Gov. <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/abigail-spanberger\/\">Abigail Spanberger<\/a> (D-VA) signed the legislation earlier this month, <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/4448796\/abigail-spanberger-sends-abortion-same-sex-marriage-amendments-voters\/\">beginning the process<\/a> to send the constitutional amendment to voters.<\/p>\n<p>The special election is currently scheduled for April 21, with early voting set to start March 6.<\/p>\n<p><strong><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/campaigns\/congressional\/4462436\/virginia-dan-helmer-house-seat-redistricting\/\">VIRGINIA DEMOCRAT RUNNING FOR NEW HOUSE SEAT CREATED BY HIS OWN REDISTRICTING PLAN<\/a><\/strong><\/p>\n<p>Joining the RNC in filing the lawsuit are the <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/nrcc\/\">National Republican Congressional Committee<\/a> and Reps.
