Texas&rsquo; politically vulnerable Rep. Henry Cuellar was the lone Democrat voting for the measure.<\/p>\n<p>&ldquo;I support the SAVE America Act because I believe in the fundamental principle: American citizens should decide American elections,&rdquo; Cuellar wrote on X. He&rsquo;s not alone. The <a href=\"https:\/\/www.pewresearch.org\/politics\/2025\/08\/22\/majority-of-americans-continue-to-back-expanded-early-voting-voting-by-mail-voter-id\/#:~:text=Requiring%20all%20voters%20to%20show%20government-issued%20photo%20identification%20(83%25)\" target=\"_blank\" rel=\"noreferrer noopener\">vast majority of Americans<\/a> support the two pillars of the bill: Documentary proof of U.S. citizenship to register to vote and voter ID to cast a ballot in federal elections.&nbsp;<\/p>\n<figure><\/figure>\n<p>Most of Cuellar&rsquo;s liberal congressional colleagues hate the bill. Senate Minority Leader Chuck Schumer, repeating the Democrat Party&rsquo;s inane talking point that the SAVE America Act is<a href=\"https:\/\/www.foxnews.com\/politics\/mike-lee-calls-schumers-jim-crow-2-0-attack-voter-id-bill-paranoid-fantasy\" target=\"_blank\" rel=\"noreferrer noopener\"> &ldquo;Jim Crow 2.0,&rdquo;<\/a> has said the bill is <a href=\"https:\/\/www.democrats.senate.gov\/newsroom\/press-releases\/leader-schumer-says-save-act-will-be-dead-on-arrival-in-the-senate-and-warns-of-another-gop-shutdown\" target=\"_blank\" rel=\"noreferrer noopener\">&ldquo;dead on arrival&rdquo;<\/a> in the Senate. The New York Democrat can make such bold assurances because of the feckless Senate&rsquo;s 60-vote rule &mdash; and RINOs like <a href=\"https:\/\/thefederalist.com\/2026\/02\/11\/conservatives-cant-beat-democrats-until-they-defeat-the-rinos-in-their-own-party-first\/\" target=\"_blank\" rel=\"noreferrer noopener\">Lisa Murkowski <\/a>of Alaska who crave approbation from a corporate media that hates Republicans and collegiality from Senate Democrats incapable of such quaint political niceties.&nbsp;<\/p>\n<p>But these elites of the upper house should know what most of their fellow Americans believe: State voter registration lists include noncitizens ineligible to vote.&nbsp;<\/p>\n<h2>&lsquo;Honor System&rsquo;<\/h2>\n<p>A new Rasmussen Reports <a href=\"https:\/\/www.rasmussenreports.com\/public_content\/politics\/trump_administration_second_term\/most_suspect_foreigners_are_registered_to_vote_in_u_s_elections?utm_campaign=RR02122026DN&amp;utm_source=criticalimpact&amp;utm_medium=email\" target=\"_blank\" rel=\"noreferrer noopener\">poll<\/a> finds 55 percent of likely voters believe that noncitizens are illegally registered to vote in the state where they live, including 32 percent who say it&rsquo;s very likely. Just a third (34 percent) of the 1,100 respondents surveyed on the phone and online said they don&rsquo;t think foreign nationals are on the voter lists, including 16 percent who said it&rsquo;s not likely at all. The remaining 11 percent weren&rsquo;t sure.&nbsp;<\/p>\n<p>Memo to the unsure and the doubters: There are noncitizens on voter rolls &mdash; <a href=\"https:\/\/thefederalist.com\/2024\/10\/08\/the-federal-government-is-fighting-to-keep-noncitizens-on-voter-rolls\/\" target=\"_blank\" rel=\"noreferrer noopener\">thousands of them<\/a> &mdash; as states and election-integrity watchdogs have found. Some of those foreign nationals <a href=\"https:\/\/www.justice.gov\/usao-edmi\/pr\/chinese-national-university-michigan-charged-illegally-voting-2024-election\" target=\"_blank\" rel=\"noreferrer noopener\">end up voting<\/a>, which, Democrats will hastily note, is already illegal under the <a href=\"https:\/\/www.justice.gov\/crt\/national-voter-registration-act-1993-nvra\" target=\"_blank\" rel=\"noreferrer noopener\">National Voter Registration Act<\/a>. What they won&rsquo;t say is that the NVRA is an <a href=\"https:\/\/publicinterestlegal.org\/foreign-nationals-voting\/\" target=\"_blank\" rel=\"noreferrer noopener\">&ldquo;honor system&rdquo;<\/a> that requires checking a box to affirm U.S. citizenship. It is a felony to dishonestly check that box, but tracking illegal votes in real-time is difficult to do. &nbsp;<\/p>\n<p>An <a href=\"https:\/\/thefederalist.com\/2025\/03\/21\/the-left-says-it-doesnt-happen-but-noncitizens-voted-in-iowas-election\/\" target=\"_blank\" rel=\"noreferrer noopener\">audit<\/a> last year by the Iowa Secretary of State&rsquo;s office found 35 noncitizens cast ballots that were counted in the 2024 presidential election. The same state saw a congressional incumbent win her 2020 election by a mere <a href=\"https:\/\/www.iowapublicradio.org\/political-news\/2022-09-28\/1st-congressional-district-2022-election-miller-meeks-bohannan\" target=\"_blank\" rel=\"noreferrer noopener\">six votes<\/a>. It makes a big difference who is and isn&rsquo;t voting in elections.&nbsp;<\/p>\n<p>&ldquo;&hellip;[S]tates have been engaging in list maintenance efforts and working to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-harris-admin-is-fighting-to-keep-noncitizens-on-voter-rolls\/\" title=\"Biden-Harris Admin Is Fighting To Keep ... On ...\">remove ineligible noncitizen voters<\/a> on the rolls by the thousands this cycle &mdash; in the face of the Biden-Harris immigration policy of invasion, under which millions of illegal aliens have crossed into the country,&rdquo; Ben Weingarten <a href=\"https:\/\/thefederalist.com\/2024\/10\/08\/the-federal-government-is-fighting-to-keep-noncitizens-on-voter-rolls\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a> for The Federalist a month before the 2024 general election.&nbsp;<\/p>\n<p>In swing state Pennsylvania, state officials admitted that the Department of Motor Vehicles allowed non-U.S. citizens to register to vote via Pennsylvania&rsquo;s &ldquo;<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/noncitizens-on-voter-rolls-assure-election-will-be-unsafe-unfair\/\" title=\"... On ... Assure Election Will Be Unsafe, Unfair\">motor voter&#038;rdquo<\/a>; system, <a href=\"https:\/\/publicinterestlegal.org\/press\/pilf-petitions-scotus-after-pennsylvania-blocks-access-to-noncitizen-voter-registration-records\/\" target=\"_blank\" rel=\"noreferrer noopener\">according to<\/a> the Public Interest Legal Foundation. A Pennsylvania elections official&rsquo;s initial analysis identified approximately 100,000 registered voters &ldquo;who may potentially be non-citizens or may have been non-citizens at some point in time.&rdquo;<\/p>\n<p>Now, the Senate can do something about dirty voter rolls. The SAVE America Act also <a href=\"https:\/\/www.americafirstpolicy.com\/issues\/the-save-america-act-strengthening-protections-for-federal-elections\" target=\"_blank\" rel=\"noreferrer noopener\">requires<\/a> states to remove foreign nationals from their databases of registered voters through strengthened list maintenance processes.&nbsp;<\/p>\n<h2>A Test of Wills<\/h2>\n<p>Republicans, who hold a 53-47 advantage in the Senate, effectively hit the 51-vote threshold for simple majority passage when another notorious RINO, Susan Collins of Maine, <a href=\"https:\/\/www.newscentermaine.com\/article\/news\/politics\/national-politics\/maine-senator-susan-collins-support-for-republican-voting-reform-bill-save-america-act\/97-d1a22a85-451b-4e8a-8190-587a6be230dc\" target=\"_blank\" rel=\"noreferrer noopener\">announced<\/a> she would support the bill. Vice President JD Vance would be the tie-breaking vote. &nbsp;<\/p>\n<p>&ldquo;The law is clear that in this country, only American citizens are eligible to vote in federal elections,&rdquo; Collins wrote in a statement. &ldquo;In addition, having people provide an ID at the polls, just as they have to do before boarding an airplane, checking into a hotel, or buying an alcoholic beverage, is a simple reform that will improve the security of our federal elections and will help give people more confidence in the results.&rdquo;<\/p>\n<figure>\n<p><span><\/p>\n<blockquote data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Thank you for your support for the SAVE Act, <a href=\"https:\/\/twitter.com\/SenatorCollins?ref_src=twsrc%5Etfw\">@SenatorCollins<\/a>! Laurel Libby (@laurel_libby) <a href=\"https:\/\/twitter.com\/laurel_libby\/status\/2022440156351893908?ref_src=twsrc%5Etfw\">February 13, 2026<\/a><\/p><\/blockquote>\n<p><\/span> <\/p>\n<\/figure>\n<p>But the GOP will have to earn it.&nbsp;<\/p>\n<p>As The Federalist has reported, the majority could force Democrats into a so-called <a href=\"https:\/\/thefederalist.com\/2026\/02\/10\/rino-senators-could-sink-the-save-act\/\" target=\"_blank\" rel=\"noreferrer noopener\">&ldquo;talking filibuster&rdquo;<\/a> &mdash; a test of wills for sure. It really is the standard filibuster, long employed by the Senate until rule changes in the 1970s <a href=\"https:\/\/constitutioncenter.org\/blog\/filibustering-in-the-modern-senate\" target=\"_blank\" rel=\"noreferrer noopener\">watered down <\/a>the process. NBC News, taking a page from <a href=\"https:\/\/thefederalist.com\/2026\/02\/17\/what-the-wall-street-journal-gets-wrong-about-the-talking-filibuster\/\" target=\"_blank\" rel=\"noreferrer noopener\">the Wall Street Journal<\/a>, hyperbolically <a href=\"https:\/\/www.nbcnews.com\/politics\/congress\/trumps-election-bill-save-america-act-50-senate-votes-democrats-block-rcna259351\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a> that the tactic is &ldquo;doomed to fail if attempted.&rdquo;&nbsp;<\/p>\n<p>The talking or standing filibuster forces those opposed to a bill to continuously debate until they run out of patience or energy to stand and talk. While the 47 Senate Democrats could eat up a lot of time telling their fellow citizens why they don&rsquo;t support a bill aimed at preventing noncitizens from voting, Majority Leader John Thune, R-S.D., has more latitude in limiting debate thanks to how the House <a href=\"https:\/\/thefederalist.com\/2026\/02\/17\/what-the-wall-street-journal-gets-wrong-about-the-talking-filibuster\/\" target=\"_blank\" rel=\"noreferrer noopener\">moved the legislation<\/a> to the Senate.&nbsp;<\/p>\n<p>&ldquo;The play here is just to exhaust the other side and talk about this for so long that they finally give up, or some deal is made&rdquo; to pass a bill containing a proposal that is supported by 80 percent of Americans, Thomas Lane, director for Election Integrity at the America First Policy Institute, said this week on <a href=\"https:\/\/www.spreaker.com\/episode\/the-truth-about-the-senate-s-stalling-of-the-save-america-act--70099222\" target=\"_blank\" rel=\"noreferrer noopener\"><em>The Federalist Radio Hour<\/em><\/a>  podcast. Invoking cloture would still require the usual 60 votes, but the fatiguing debate could bring some Dem defectors to break ranks with their party, as <a href=\"https:\/\/www.abc27.com\/pennsylvania-politics\/fetterman-backs-save-act-says-voter-id-not-jim-crow\/\" target=\"_blank\" rel=\"noreferrer noopener\">Sen.
