He ruled <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/house\/4428980\/malliotakis-district-at-risk-after-judge-approves-new-york-redistricting-plan\/\"><\/a>that the state&rsquo;s redistricting commission must redraw its 2024 congressional map in February, halting any elections scheduled under the current map.<\/p>\n<figure class=\"wp-block-embed aligncenter is-type-rich is-provider-canva wp-block-embed-canva\">\n<div class=\"wp-block-embed__wrapper\"> <iframe loading=\"lazy\" title=\"Full map redistricting plans\" src=\"https:\/\/www.canva.com\/design\/DAGvTpHBZTw\/bvEPiT5sKcnV-y_p007mMA\/view?embed&amp;meta\" height=\"464\" width=\"696\" style=\"border: none; border-radius: 8px; width: 696px; height: 464px;\" allowfullscreen=\"allowfullscreen\" allow=\"fullscreen\"><\/iframe> <\/div>\n<\/figure>\n<p>The Republicans&rsquo; Supreme Court filing is in response to Pearlman&rsquo;s ruling, which Rep. <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/house\/4428980\/malliotakis-district-at-risk-after-judge-approves-new-york-redistricting-plan\/\">Nicole Malliotakis<\/a> (R-NY) appealed. She is at risk of losing her seat under new maps.<\/p>\n<p>&ldquo;The decision by Justice Pearlman prevents any congressional election in the entire State of New York and will result in extreme disruption of the election process in our state,&rdquo; New York GOP Chairman Ed Cox said in a <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/x.com\/NewYorkGOP\/status\/2022125544880656462?s=20\">statement<\/a>. &ldquo;The decision is flawed on many bases, as the submissions to the Supreme Court of the United States make clear.&rdquo;<\/p>\n<p>Republicans initially contested Pearlman&rsquo;s ruling <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/campaigns\/congressional\/4434829\/republicans-appeal-new-york-city-house-district\/\">to the state&rsquo;s Court of Appeals<\/a>. By filing that motion, the Republicans put a stay on the order in the ruling that required the redistricting commission convene to redraw the map by Feb. 6.<\/p>\n<p>Republicans filed the Thursday emergency application with the federal Supreme Court in order to put a stay on the order in Pearlman&rsquo;s ruling that no future elections can be held under the 2024 map. The state&rsquo;s Republicans <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/drive.google.com\/file\/d\/108LD9ZwbsZYYPiFCsPGYE3-4Ad_C89_-\/view\">argued<\/a> that failure to grant a stay on this aspect of the ruling &ldquo;will prevent the election from beginning on time, inflicting &lsquo;serious and irreparable harm&#8217;&rdquo; on New York voters.<\/p>\n<p>Cox continued calling the current makeup of NY-11 one that is &ldquo;compact, reflects communities of interest, and is politically competitive.&rdquo;<\/p>\n<p>Malliotakis has served in the House since 2021. She defeated her last two Democratic opponents by 23.5% and 28% margins in 2022 and 2024.<\/p>\n<p>&ldquo;Despite having a voter registration advantage in New York&rsquo;s 11th Congressional District, Democrats can&rsquo;t beat me on merit, policy, and debate. So what do they do? They file a meritless lawsuit claiming our district disenfranchises minorities to take out the first minority to represent the district and steal our seat,&rdquo; Malliotakis&nbsp;<a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/x.com\/NMalliotakis\/status\/2014331823753412878?s=20\">wrote&nbsp;<\/a>on X in January.<\/p>\n<p><strong><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/4449079\/redistrict-court-battles-where-things-stand\/\">REDISTRICTING COURT BATTLES: WHERE THINGS STAND<\/a><\/strong><\/p>\n<p>New York currently has 19 Democratic and seven Republican seats in the House of Representatives based on its 2024 map.<\/p>\n<p>This motion makes New York the latest state in the national redistricting saga battling over its congressional map to reach the Supreme Court.
