Just Democrat Rep. Henry Cuellar of Texas voted to pass the legislation alongside his Republican colleagues. A similar version, known as the SAVE Act, passed the House last year with the&nbsp;<a href=\"https:\/\/thefederalist.com\/2025\/04\/10\/208-democrats-vote-against-legislation-to-keep-noncitizens-out-of-elections\/\" target=\"_blank\" rel=\"noreferrer noopener\">support<\/a>&nbsp;of four Democrats.<\/p>\n<div class=\"fdrlst__b89e9-paragraph-2 d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-1274099561\">\n<div id=\"div-gpt-ad-1463670073398-0\" class=\"mb-30\"><\/div>\n<\/div>\n<p>The legislation now heads to the Senate, though it would need 60 votes to reach cloture. Self-described &ldquo;Republican&rdquo; Lisa Murkowski <a href=\"https:\/\/thefederalist.com\/2026\/02\/11\/conservatives-cant-beat-democrats-until-they-defeat-the-rinos-in-their-own-party-first\/\" target=\"_blank\" rel=\"noreferrer noopener\">has already stated<\/a> she would oppose the election integrity legislation, while Democrat Chuck Schumer <a href=\"https:\/\/www.democrats.senate.gov\/news\/press-releases\/leader-schumer-floor-remarks-on-how-the-save-act-would-disenfranchise-millions-of-american-voters-says-it-is-dead-on-arrival-in-the-senate\" target=\"_blank\" rel=\"noreferrer noopener\">has suggested<\/a> the legislation is &ldquo;dead on arrival.&rdquo;<\/p>\n<p>But as The Federalist&rsquo;s Matt Kittle <a href=\"https:\/\/thefederalist.com\/2026\/02\/10\/rino-senators-could-sink-the-save-act\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a>, Republicans &mdash; who control the Senate &mdash; could invoke the &ldquo;talking filibuster,&rdquo; which would force Democrats to keep talking to stall a vote on the legislation. Legislators would have no opportunity for a break and, as Kittle points out, would have to &ldquo;explain to the&nbsp;<a href=\"https:\/\/roy.house.gov\/media\/press-releases\/rep-roys-save-america-act-hit-house-floor-next-week\" target=\"_blank\" rel=\"noreferrer noopener\">80 percent&nbsp;<\/a>of Americans (including a&nbsp;<a href=\"https:\/\/www.cnbc.com\/2026\/02\/06\/save-act-trump-congress-elections-voting.html\" target=\"_blank\" rel=\"noreferrer noopener\">significant number of Democrats<\/a>) who support citizenship and ID requirements, why they so <a href=\"https:\/\/amzn.to\/3YuVZYV\" >vehemently oppose basic election integrity<\/a>.&rdquo;<\/p>\n<p>Some Republicans, however, don&rsquo;t want to force a vote on the popular legislation, as Kittle reported &mdash; but they should. <\/p>\n<p>While it&rsquo;s already illegal for noncitizens to vote, the law is largely toothless. The SAVE America Act would amend the 1993 National Voter Registration Act to require documentary proof of citizenship to register to vote in federal elections. Right now, the only thing standing between a noncitizen and our free and fair elections is a tiny square box on the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/official-election-data-drops-2020-bombshell-thousands-of-ballots-may-have-been-illegally-cast\/\" title=\"Official Election Data Drops 2020 Bombshell: Thousands of Ballots May Have Been Illegally Cast\">federal voter registration form<\/a> asking prospective voters to attest under penalty of perjury that they are citizens. In other words, the honor system.<\/p>\n<p>That honor system has allowed thousands of noncitizens to register to vote &mdash; including some who ended up casting a ballot. A&nbsp;<a href=\"https:\/\/thefederalist.com\/2024\/10\/24\/georgia-audit-finds-nine-noncitizens-voted-in-past-elections\/\" target=\"_blank\" rel=\"noreferrer noopener\">Georgia<\/a>&nbsp;<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/208-democrats-vote-against-save-act\/\" title=\"208 Democrats ... Against ...\">audit found 20 noncitizens registered<\/a> to vote &mdash; nearly half of whom cast a ballot in previous elections,&nbsp;<a href=\"https:\/\/www.ajc.com\/politics\/election-audit-shows-20-noncitizens-registered-to-vote-in-georgia\/NRORAL7Z3RDSNMQ3QDLVEARPSY\/\" target=\"_blank\" rel=\"noreferrer noopener\">according<\/a>&nbsp;to the Atlanta Journal-Constitution.<\/p>\n<p>Pennsylvania previously found 11,198 noncitizens registered to vote, according to The&nbsp;<a href=\"https:\/\/www.washingtontimes.com\/news\/2019\/jan\/30\/pennsylvania-11000-non-citizens-registered-vote\/\" target=\"_blank\" rel=\"noreferrer noopener\">Washington Times<\/a>, despite &mdash; as Democrats are fond of repeating &mdash; it being illegal for noncitizens to vote. In September 2024 Oregon&rsquo;s secretary of state&nbsp;<a href=\"https:\/\/thefederalist.com\/2024\/09\/24\/oregon-secretary-of-state-registered-1200-possible-noncitizens-to-vote-insists-noncitizen-voting-is-rare\/\" target=\"_blank\" rel=\"noreferrer noopener\">found<\/a>&nbsp;nine noncitizens who had voted in past elections after discovering &ldquo;more than 300 noncitizens were erroneously registered to vote.&rdquo; Alabama GOP Secretary of State Wes Allen&nbsp;<a href=\"https:\/\/thefederalist.com\/2026\/01\/06\/25-noncitizens-voted-in-alabama-officials-find-after-trump-gave-states-access-to-alien-database\/\" target=\"_blank\" rel=\"noreferrer noopener\">announced<\/a>&nbsp;in January that his office found 25 noncitizens had allegedly voted unlawfully, with 186 noncitizens registered to vote.<\/p>\n<hr class=\"wp-block-separator\">\n<div class=\"article-author-description fst-italic\">      Brianna Lyman is an elections correspondent at The Federalist.
