Rule<\/em>, the DOJ agreed to a permanent injunction forbidding the warden of <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.bop.gov\/locations\/institutions\/crw\/\">Federal Medical Center-Carswell<\/a>, a specialized prison in Fort Worth for women primarily with medical and mental health needs, from placing transgender prisoners in the same unit as the plaintiffs.<\/p>\n<p>The ruling is considered the first of its kind that would order federal officials to move biological males who identify as women permanently away from the female prison population.<\/p>\n<p>However, the plaintiffs told the <em>Washington Examiner<\/em> that negotiations are currently held up over the DOJ&rsquo;s willingness, or what they say is its apparent reluctance, to award damages to the injured women.<\/p>\n<p>The standoff has left some women&rsquo;s rights advocates puzzled by what they see as an about-face. Under former President <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/joe-biden\/\">Joe Biden<\/a>, prison assignments adhered to self-asserted gender identity.<\/p>\n<div class=\"wp-block-image\">\n<figure class=\"alignright size-large is-resized\"><figcaption class=\"wp-element-caption\">Rhonda Fleming (Courtesy of Jeanette Driever, a friend of Fleming and former FMC Carswell inmate)<\/figcaption><\/figure>\n<\/p><\/div>\n<p>&ldquo;I am very surprised that the government does not want to compensate me, who was true to the cause for over a decade,&rdquo; lead plaintiff <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/rhondaannfleming.com\/\">Rhonda Fleming<\/a>, a longtime litigant fighting the infiltration of biological males in women&rsquo;s prisons, told the <em>Washington Examiner<\/em>. &ldquo;Basically, the government wants to admit women were harmed, but give nothing in compensation and\/or protection.&rdquo;<\/p>\n<p>Fleming, 60, suspects that the federal government does not want to grant them what they are owed in damages under the <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.bop.gov\/policy\/progstat\/1320.07.pdf\">Federal Tort Claims Act<\/a>, as doing so might mean that authorities would be compelled to recompense thousands of women who were wrongly imprisoned with male inmates over the past decade.<\/p>\n<p>&ldquo;The government is afraid that by compensating us, because so many women were harmed, it will cause the government to compensate 10,000 or more women,&rdquo; Fleming said.<\/p>\n<p>Elspeth Cypher, a retired Massachusetts Supreme Court <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.mass.gov\/news\/supreme-judicial-court-justice-elspeth-b-cypher-to-retire\">justice<\/a> serving as <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/womensliberationfront.org\/staff-and-board\">president<\/a> of the Women&rsquo;s Liberation Front, a women&rsquo;s rights advocacy organization, offered a similar explanation as to why the Trump administration may be so hesitant about awarding compensation.<\/p>\n<p>&ldquo;It would set a precedent for other women in similar situations,&rdquo; Cypher told the <em>Washington Examiner<\/em>. &ldquo;There are a lot of women in these situations, some in state courts.&rdquo;<\/p>\n<p>Cypher noted that it is not &ldquo;a one-to-one problem&rdquo; since the women are forced to share intimate spaces, such as communal showers and changing areas, with biological males assigned to the same living quarters. &ldquo;One <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/missouri-executes-transgender-inmate-for-2003-murder-of-ex-girlfriend\/\" title=\"Missouri Executes Transgender Inmate For 2003 Murder Of Ex...Girlfriend\">trans-identifying male prisoner<\/a> does not just bother one woman, but as many as there are in the unit,&rdquo; she said.<\/p>\n<p><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/investigations\/3890471\/trans-inmates-separated-from-females-following-sexual-abuse-claims\/\"><strong>TRANSGENDER INMATES SEPARATED FROM FEMALES AT SPECIAL NEEDS WOMEN&rsquo;S PRISON FOLLOWING SEXUAL ABUSE CLAIMS<\/strong><\/a><\/p>\n<p>Indeed, five more women who allege unsafe housing conditions at FMC Carswell recently came forward to ask the court to be added <span style=\"box-sizing: border-box; margin: 0px; padding: 0px;\">as co-plaintiffs to Fleming&rsquo;s&nbsp;<a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.txnd.400241\/gov.uscourts.txnd.400241.61.0.pdf\">civil rights complaint<\/a><\/span>. The female inmates, like Fleming, reported being sexually abused by some of the trans-identifying males.<\/p>\n<p>Two of the women <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.txnd.400241\/gov.uscourts.txnd.400241.69.1.pdf\">alleged<\/a> that they had witnessed male prisoners peeking into the shower stalls, standing at the bathroom sinks with &ldquo;visible erections,&rdquo; and &ldquo;rubbing&rdquo; on female inmates in the medical area against their consent.<\/p>\n<p>Three others, in a separate <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.txnd.400241\/gov.uscourts.txnd.400241.107.1.pdf\">motion<\/a> to be included in Fleming&rsquo;s lawsuit, said the women at FMC Carswell live in &ldquo;constant fear of sexual assault,&rdquo; many of them too afraid to use the bathroom by themselves.<\/p>\n<p>Fleming&rsquo;s original co-plaintiff, Miriam &ldquo;Mimi&rdquo; Herrera, said she has been a victim of voyeurism and sexual predation inside FMC Carswell&rsquo;s restroom facilities. &ldquo;They can see us shower,&rdquo; Herrera previously told the <em>Washington Examine<\/em>r. &ldquo;I have been stalked in the showers before.&rdquo;<\/p>\n<p>Other than the potential domino effect of paying damages, the Trump administration could be tiptoeing around the delicate matter on account of <em>Jane Doe v. Pam Bondi<\/em>, another transgender prison housing case.<\/p>\n<p>Nineteen male inmates, who identify as women, are <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/rbgg.com\/wp-content\/uploads\/013-4-Exhibit-Declaration-of-Jane-Doe-Redacted.pdf\">anonymously<\/a> challenging <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/01\/defending-women-from-gender-ideology-extremism-and-restoring-biological-truth-to-the-federal-government\/\">Trump&rsquo;s directive<\/a> to separate federal detention facilities by biological sex. The transgender plaintiffs, all residing in female-only penitentiaries, filed a class action lawsuit against the Trump administration to prevent their transfer to men&rsquo;s prisons.<\/p>\n<p>&ldquo;Theoretically, they should be on the side of the women given the executive orders from President Trump,&rdquo; Cypher said of the DOJ, &ldquo;but the stay from <em>Doe v. Bondi<\/em> is still in effect.&rdquo;<\/p>\n<p><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/investigations\/3909280\/lawfare-targeting-trumps-gender-order-threatens-protected-status-for-women\/\"><strong>LAWFARE TARGETING TRUMP&rsquo;S GENDER ORDER THREATENS PROTECTED STATUS FOR WOMEN<\/strong><\/a><\/p>\n<p>Cypher explained that some attorneys interpret the injunctions in <em>Doe<\/em>, which temporarily bar the Federal Bureau of Prisons from <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.gladlaw.org\/cases\/doe-v-bondi\/\">removing the biological males from women&rsquo;s prisons<\/a> pending resolution of the case, as a nationwide restraint.<\/p>\n<p>&ldquo;I think that was why [Fleming&rsquo;s] case was carefully handled so that it wouldn&rsquo;t violate those injunctions,&rdquo; Cypher said.<\/p>\n<p>As written, the order of protection <span style=\"box-sizing: border-box; margin: 0px; padding: 0px;\">issued in&nbsp;<em>Fleming<\/em><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.txnd.400241\/gov.uscourts.txnd.400241.137.0.pdf\">&nbsp;on Feb. 2<\/a>&nbsp;stipulates that males are not to be removed entirely from FMC Carswell, but are to be<\/span> relocated to a different block within the facility.<\/p>\n<p>Judge Sidney A. Fitzwater, an appointee of President Ronald Reagan, indicated in the partial final judgment that he is being careful not to overstep his authority before <em>Doe v. Bondi<\/em> is decided <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.courtlistener.com\/docket\/69835212\/jane-doe-v-pamela-bondi\/\">at the appellate level<\/a>.<\/p>\n<p>&ldquo;Nothing in this Order requires or authorizes action that would contravene any existing, valid federal court order,&rdquo; Fitzwater wrote.<\/p>\n<p>The order also applies only to plaintiffs explicitly named in the case, which is why several women sought to join Fleming&rsquo;s legal fight to receive protection as well.<\/p>\n<p>To comply with the court order, which is structured the same way as the previously issued <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.txnd.400241\/gov.uscourts.txnd.400241.83.0.pdf\">temporary restraining order<\/a>, federal officials are allowed, at their discretion, to reassign the male detainees away from the plaintiffs&rsquo; housing units or confine them to &ldquo;a secure, segregated area&rdquo; at FMC Carswell.<\/p>\n<p>Following the initial separation instructions, FMC Carswell simply moved the trans-identifying males into other women&rsquo;s housing units with inmates who were not named as co-plaintiffs. Those <a href=\"https:\/\/amzn.to\/3YuVZYV\" >women subsequently suffered sexual abuse<\/a> once the males were moved to their units, according to <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.txnd.400241\/gov.uscourts.txnd.400241.107.1.pdf\">exhibits filed in support of the intervention requests<\/a>.<\/p>\n<p>&ldquo;Instead of solving the problem, he chose to injure different women,&rdquo; the plaintiff attorneys said of Warden Tyal Rule in a December 2025 court filing.<\/p>\n<p>For now, the final housing order does not prohibit the males from accessing other parts of the prison. Fitzwater, nevertheless, may consider granting legal relief to the <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.txnd.400241\/gov.uscourts.txnd.400241.124.0.pdf\">joining plaintiffs<\/a>.<\/p>\n<p>Fleming said the attorneys were strategically adding additional plaintiffs to effectively fan out the protective order&rsquo;s coverage across the prison and ensure that the males are cordoned off in one area.<\/p>\n<p>The plaintiffs furthermore sought to include language in the permanent injunction specifying that it would apply to all BOP facilities.<\/p>\n<p>Ahead of a Jan. 30 preliminary injunction hearing, DOJ officials acknowledged that they &ldquo;do not want to house any male inmates with female inmates (regardless of what the institution is), but they have some operational concerns about Plaintiffs&rsquo; interpretation of the Court&rsquo;s Order (as well as Plaintiffs&rsquo; proposed language) in relation to the scope of this case.&rdquo;<\/p>\n<p>The government raised questions about how, if adopted, the plaintiffs&rsquo; language would apply at other institutions with different conditions of confinement. (AP Photo\/LM Otero)<\/figcaption><\/figure>\n<p>According to a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/us-judge-orders-that-dakota-access-oil-pipeline-can-remain-open\/\" title=\"US Judge ...s That Dakota Access Oil Pipeline Can Remain Open\">joint status report<\/a>, both parties agreed that <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/wp-content\/uploads\/2026\/02\/Fleming-joint-status-report.pdf\">moving all male inmates at FMC Carswell to a segregated unit<\/a> &ldquo;seemingly would be the most straightforward way of addressing all plaintiffs&rsquo; (including Intervening Plaintiffs&rsquo;) concerns in this case (short of removing the male inmates from FMC Carswell entirely).&rdquo;<\/p>\n<p>The plaintiffs, however, argued that the permanent injunction, if phrased to ensure full segregation, would not conflict with the existing <em>Doe v. Bondi <\/em>injunctions, while government officials believed that the <em>Bondi <\/em>case restrains BOP from fully segregating the males, a move which, according to the DOJ&rsquo;s argument, would require the activation of a new, all-male housing unit.<\/p>\n<p>When contacted by the <em>Washington Examiner<\/em> about the pending litigation, the DOJ reaffirmed the Trump administration&rsquo;s commitment to defending women, including incarcerated women, from the harms of gender ideology.<\/p>\n<p>&ldquo;For years, biological men convicted of serious violent crimes have been housed in women&rsquo;s prisons based solely on self-identified gender as female, raising documented safety concerns from staff and inmates about risks of sexual assault from biologically male prisoners,&rdquo; a DOJ official told the <em>Washington Examiner<\/em>, adding, &ldquo;This Administration is committed to protecting women, including those in custody, and will continue efforts to reaffirm biological reality and safeguard women&rsquo;s spaces.&rdquo;<\/p>\n<div class=\"wp-block-image\">\n<figure class=\"alignleft size-large is-resized\"><figcaption class=\"wp-element-caption\">Rhonda Fleming (Courtesy of Jeanette Driever, a friend of Fleming and former FMC Carswell inmate)<\/figcaption><\/figure>\n<\/p><\/div>\n<p>Fleming said she is willing to waive damages if the government agrees to place her in a halfway house close to her elderly mother in Houston for the remainder of her sentence. Fleming, a former FMC Carswell inmate, is currently held far from home at a <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.bop.gov\/locations\/institutions\/lex\/\">satellite camp<\/a> in Lexington, Kentucky, about 1,000 miles away.<\/p>\n<p>&ldquo;It is an old story,&rdquo; Fleming said. &ldquo;Women get shafted, no matter what they are willing to surrender.&rdquo;<\/p>\n<p>Fleming suggested that the federal government allocate funds to victims based on the level of harm that they have suffered. <\/p>\n<p>She said some of the women need mental health care after being forced to undress in the presence of male inmates, many of whom are convicted sex offenders.<\/p>\n<p><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/investigations\/4356741\/female-inmates-allege-sexual-abuse-transgender-separation-case\/\"><strong>MORE FEMALE INMATES ALLEGE SEXUAL ABUSE IN TRANSGENDER SEPARATION CASE<\/strong><\/a><\/p>\n<p>The transgender inmates currently incarcerated at FMC Carswell include Michael D.
