U.S.District Judge Hala Jarbou ruled that the National Voter Registration Act, Help America Vote Act, and the Civil Rights Act do not require the disclosure of those private records and that forcing such disclosure could burden voters\u2019 First Amendment rights. The decision adds to a string of defeats for the DOJ\u2019s efforts to access comprehensive voter data; California and Oregon rulings had already rejected similar attempts. The ruling Tuesday in Michigan marks the third time a federal district court has tossed the administration&rsquo;s efforts to get the sensitive voter information.<\/p>\n<p>Last month, U.S. District Judge David Carter <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/4421868\/california-judge-first-dismiss-doj-suit-seeking-voter-data\/\">dismissed the lawsuit<\/a> seeking to get access to California&rsquo;s voter rolls, saying &ldquo;the government&rsquo;s request is unprecedented and illegal.&rdquo; U.S District Judge Mustafa Kasubhai also rejected an effort to get access to Oregon&rsquo;s voter rolls, issuing a <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.ord.188997\/gov.uscourts.ord.188997.73.0_2.pdf\">sharply worded opinion<\/a> earlier this month.<\/p>\n<p>&ldquo;The presumption of regularity that has been previously extended to Plaintiff that it could be taken at its word&mdash;with little doubt about its intentions and stated purposes&mdash;no longer holds,&rdquo; Kasubhai said in the ruling dismissing the Oregon lawsuit. &ldquo;When Plaintiff, in this case, conveys assurances that any private and sensitive data will remain private and used only for a declared and limited purpose, it must be thoroughly scrutinized and squared with its open and public statements to the contrary.&rdquo;<\/p>\n<p><strong><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/white-house\/4444849\/trump-renews-election-integrity-crackdown-even-gop-shows-little-to-no-appetite\/\">TRUMP RENEWS ELECTION INTEGRITY CRACKDOWN EVEN AS GOP SHOWS LITTLE APPETITE<\/a><\/strong><\/p>\n<p>The DOJ could appeal Tuesday&rsquo;s ruling to the U.S. Court of Appeals for the 6th Circuit.
