However, the Department of Justice continues to pursue a criminal investigation into Chairman Jerome Powell based on committee testimony that no reasonable person could construe as possessing criminal intent,&rdquo; Tillis said.&nbsp;&ldquo;Protecting the independence of the <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/federal-reserve\/\">Federal Reserve<\/a> from political interference or legal intimidation is non-negotiable.&rdquo;<\/p>\n<p>&ldquo;My position has not changed: I will oppose the confirmation of any Federal Reserve nominee, including for the position of Chairman, until the DOJ&rsquo;s inquiry into Chairman Powell is fully and transparently resolved,&rdquo; he continued.<\/p>\n<p>Trump revealed early Friday morning that he is nominating <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/3902530\/trump-names-kevin-warsh-fed-chairman\/\">former Federal Reserve governor Kevin Warsh<\/a> as the next chairman. Tillis&rsquo;s reluctance to back Warsh is critical, as the lawmaker sits on the committee that the nomination must pass through before it can advance to the Senate floor for a vote. Without Tillis&rsquo;s support, the Senate Banking, Housing and Urban Affairs Committee vote would tank, halting the process.&nbsp;<\/p>\n<p>When asked on Thursday&nbsp;if the <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/section\/senate\/\">Senate<\/a> could confirm a Fed pick without Tillis, Senate Majority Leader <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/john-thune\/\">John Thune<\/a> (R-SD) said, &ldquo;probably not.&rdquo;<\/p>\n<p>To get a nominee to the floor without approval from the banking committee, which it wouldn&rsquo;t do if Tillis votes no, they would need 60 votes in the Senate. That&rsquo;s not likely, given that there are only 53 Republican Senators and Democrats aren&rsquo;t likely to vote with them.<\/p>\n<p>&ldquo;It is difficult to trust that any Chair of the Federal Reserve selected by this president will be able to act with the independence required of the position, knowing that this administration will levy charges against any leader who makes interest rate decisions based on facts and the needs of our economy rather than Trump&rsquo;s personal preferences,&rdquo; Sen. <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/mark-warner\/\">Mark Warner<\/a> (D-VA) said in a statement following Warsh&rsquo;s nomination.<\/p>\n<p>The DOJ launched a <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/4414264\/doj-criminal-investigation-jerome-powell\/\">criminal investigation into Powell<\/a> in early January, just months before his term as <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/bob-good-files-for-recount-after-falling-behind-in-gop-primary-washington-examiner\/\" title=\"Bob Good files for recount after falling behind in GOP primary - Washington Examiner\">chairman expires<\/a> in May.<\/p>\n<p><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/4419298\/doj-investigation-push-powell-hold-seat-fed\/\"><strong>DOJ INVESTIGATION COULD PUSH POWELL TO HOLD ON TO HIS SEAT AT FED<\/strong><\/a><\/p>\n<p>The investigation is related to <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/x.com\/mikebolen\/status\/2010835868064628884\">concerns that he lied or misrepresented<\/a> the taxpayer-funded, multibillion-dollar renovation of the Fed headquarters building during congressional testimony last June. The DOJ has subpoenaed &#8203;&#8203;Powell for information on the central bank&rsquo;s headquarters renovation as part of the inquiry. The investigation has <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/policy\/finance-and-economy\/4414982\/gop-chairman-french-hill-defends-jerome-powell-break-from-trump\/\"><a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/schumer-demands-rubio-give-senate-briefing-on-venezuela\/\" title=\"Schumer demands Rubio give ... briefing on Venezuela\">attracted bipartisan criticism<\/a> <\/a>as Powell <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.federalreserve.gov\/newsevents\/speech\/powell20260111a.htm\">maintains his innocence<\/a> and has suggested that it is tied to his <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/policy\/3487268\/trump-unloads-on-jerome-powell-federal-reserve-interest-rates\/\">clashing with Trump over interest rates<\/a>.&nbsp;<\/p>\n<p>&ldquo;This new threat is not about my testimony last June or about the renovation of the Federal Reserve buildings,&rdquo; Powell said in <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/4438120\/jerome-powell-defends-fed-independence-first-questions-doj-inquiry\/\">a rare video message<\/a> earlier this month. &ldquo;It is not about Congress&rsquo;s oversight role; the Fed, through testimony and other public disclosures, made every effort to keep <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/congress\/\">Congress<\/a> informed about the renovation project. Those are pretexts.
