Instead of cutting funding outright, the department moved the districts to a reimbursement-only system unless they change those policies, saying the policies likely violate Title IX. The school systems sued, citing the 4th Circuit’s Grimm v. Gloucester County decision and arguing they seek judicial review of agency action under the Administrative Procedure Act rather than contract enforcement. A district judge dismissed the suit based on a supreme Court ruling that grant-related disputes are contractual and belong in the U.S. Court of Federal Claims under the Tucker Act; the districts appealed. At oral argument, the districts’ lawyer (Timothy Heaphy) stressed statutory interpretation and equal-protection issues, while a Justice Department lawyer (Abhishek Kambli) argued recent Supreme Court precedent forecloses separating grant conditions from contracts. Judges on the panel debated whether parts of the dispute could be heard in district court and whether the matter is essentially contract law; a pro-Trump legal group, America First Legal, filed an amicus brief supporting the government. The court did not announce a decision.

Judges weigh Title IX funding fight over Virginia schools’ pro-transgender bathroom policies

A federal appeals court on Thursday weighed the Trump administration’s use of federal education funding to pressure two major Northern Virginia school systems to abandon policies allowing students who identify as transgender to use bathrooms and locker rooms of their choosing.

The case before the 4th U.S. Circuit Court of Appeals stems from a move by the Department of Education last summer to designate Fairfax County and Arlington County public schools as “high risk” recipients of federal funds.
