The department imposed a reimbursement-onyl payment system after determining those policies likely violate Title IX, which ties federal education funding to compliance with sex-discrimination rules.

the school districts sued, saying the department is misinterpreting Title IX and coercing local policy changes; they rely on the 4th Circuit’s 2020 Grimm v. Gloucester County decision. A district judge dismissed the suit, citing the Supreme Court’s recent ruling in department of Education v. California that disputes “founded upon” federal grants are contractual and must be brought in the U.S. Court of Federal claims under the Tucker Act.

On appeal, the districts argued they seek judicial review of unlawful agency action under the Administrative Procedure Act, not contract enforcement. Their lawyer said the dispute concerns statutory interpretation and equal protection. The Justice Department countered that recent Supreme Court precedent treats grant conditions as contractual, limiting district-court jurisdiction.

Judges on the panel probed both positions: Judge Allison Rushing questioned whether Title IX allows review outside the Court of Federal Claims, while Judge Julius Richardson appeared more open to the government’s contract-based framing. America Frist Legal filed an amicus brief backing the government and warned that the districts are reframing a funding dispute as a civil-rights challenge.

The case is part of a broader push by the trump administration to challenge school policies on transgender students. The appeals court did not announce a decision date.

Judges weigh Title IX funding fight over Virginia schools’ pro-transgender bathroom policies

A federal appeals court on Thursday weighed the Trump administration’s use of federal education funding to pressure two major Northern Virginia school systems to abandon policies allowing students who identify as transgender to use bathrooms and locker rooms of their choosing.

The case before the 4th U.S. Circuit Court of Appeals stems from a move by the Department of Education last summer to designate Fairfax County and Arlington County public schools as “high risk” recipients of federal funds.
