In a memorandum the agency said deferring review is warranted because its ongoing study could lead to a new decision that supersedes the 2023 REMS modification and that reinstating certain safeguards could be addressed through that process; it also questioned the survivor\u2019s legal standing. Plaintiffs and pro\u2011life groups counter that waiting risks more harm to women and unborn children and argue the FDA could promptly restore in\u2011person dispensing and other safeguards without waiting for the review. The piece highlights anecdotal reports and cited studies alleging injuries and coercive uses of abortion drugs, and <a href=\"https:\/\/amzn.to\/3YuVZYV\" >quotes pro\u2011life leaders calling<\/a> for immediate action. A poll cited by the article found broad public support for requiring a doctor visit to obtain mifepristone and for screening for coercion. the FDA says its review would typically take about a year or more but is aiming to complete it sooner; the case remains pending while both sides press their positions.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>The U.S. Food and Drug Administration wants a federal court to halt a&nbsp;<a href=\"https:\/\/thefederalist.com\/2025\/10\/09\/lawsuit-louisiana-demands-fda-end-bidens-illegal-mail-order-abortion-pill-permissions\/\" target=\"_blank\" rel=\"noreferrer noopener\">lawsuit<\/a>&nbsp;from Louisiana and an abortion pill poisoning survivor demanding the agency end the Biden administration&rsquo;s &ldquo;illegal&rdquo; mail-order abortion pill permissions. The plaintiffs and pro-lifers who back the case, however, say a pause and denial of preliminary injunction will only put women and babies at more risk.<\/p>\n<p>In its <a href=\"https:\/\/www.courtlistener.com\/docket\/71544002\/51\/louisiana-v-u-s-food-drug-administration\/\">memorandum<\/a> filed on Tuesday, the FDA claimed legal challenges to the radical expansions that make it easier for people to obtain mail-order mifepristone and initiate at-home abortions without medical oversight are &ldquo;disruptive&rdquo; and possibly &ldquo;unnecessary&rdquo; in light of the agency&rsquo;s ongoing mifepristone review.<\/p>\n<p>&ldquo;The rationale for deferring judicial review is simple: the &lsquo;harm of moving forward&rsquo; with judicial review of the 2023 REMS Modification outweighs the &lsquo;harm of holding back,&#8217;&rdquo; the memo states.<\/p>\n<p>No&nbsp;<a href=\"https:\/\/www.fda.gov\/media\/128651\/download\" target=\"_blank\" rel=\"noreferrer noopener\">review is required<\/a>&nbsp;for the FDA to reinstate some of the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/even-pro-aborts-say-mifepristone-needs-fda-regulation\/\" title=\"Even Pro-Aborts Say ... Needs ... Regulation\">common-sense abortion pill safeguards<\/a>, such as an in-person doctor visit, that were stripped from the FDA&rsquo;s Risk Evaluation and Mitigation Strategy&nbsp;(REMS) under President Joe Biden&rsquo;s watch. In fact, doing so would match the second Trump administration&rsquo;s mifepristone parameters with those present during the first Trump administration.<\/p>\n<p>The FDA, however, signaled it does not plan to act on those REMs until its review is complete. The filing goes so far as to claim that plaintiffs such as Rosalie Markezich, who <a href=\"https:\/\/thefederalist.com\/2025\/10\/30\/woman-coerced-into-abortion-asks-fda-to-stop-shielding-abusers-and-their-drug-dealers\/\" target=\"_blank\" rel=\"noreferrer noopener\">lost her baby<\/a> after being allegedly coerced into taking abortion drugs that her boyfriend mail-ordered against her consent, &ldquo;threaten to short circuit the agency&rsquo;s orderly review and study of the safety risks of mifepristone.&rdquo;<\/p>\n<p>Additionally, the FDA suggested that awarding the growing number of lawsuits the preliminary relief they desire could &ldquo;sow administrative and judicial chaos&rdquo; such as the <a href=\"https:\/\/thefederalist.com\/2023\/04\/07\/federal-judge-says-fda-wrongfully-approved-abortion-pill\/\" target=\"_blank\" rel=\"noreferrer noopener\">conflicting injunctions<\/a> out of Texas and Washington in respective challenges to the FDA&rsquo;s 2000 mifepristone approval and 2023 REMS. <\/p>\n<p>The 20-page document ends with the defendants declaring that Markezich, despite<strong> <\/strong>suffering an abortion pill poisoning, lacks standing. According to the FDA&rsquo;s counsel, Markezich&rsquo;s assertions that she could face another forced chemical abortion under the FDA&rsquo;s current policies is &ldquo;insufficient to satisfy the injury-in-fact requirement.&rdquo;<\/p>\n<p>&ldquo;FDA&rsquo;s review will necessarily result in a new agency decision that could supersede the 2023 REMS Modification, obviating any need to consider the merits of Plaintiffs&rsquo; arguments challenging the validity of the 2023 REMS Modification,&rdquo; the memorandum states. &ldquo;Any party adversely affected by the new agency decision on mifepristone may seek judicial review<br \/>at that time. And in the event of a further REMS modification, adherence to FDA&rsquo;s normal process will create far less disruption than the abrupt, judicially imposed change sought by Plaintiffs.&rdquo;<\/p>\n<p>Pro-lifers vehemently disagree. While the FDA mifepristone review is considered a small victory for the organizations hoping to save women and babies from the suffering linked to mifepristone, it is not enough to stop the most popular abortion drug in the U.S. Stories of&nbsp;women, even those in states where chemical abortion is banned,&nbsp;suffering&nbsp;<a href=\"https:\/\/thefederalist.com\/2024\/09\/24\/nations-top-ob-gyn-org-could-combat-lies-about-pro-life-laws-but-that-would-hurt-their-agenda\/\" target=\"_blank\" rel=\"noreferrer noopener\">injuries and even death<\/a>&nbsp;<a href=\"https:\/\/thefederalist.com\/2025\/05\/02\/media-blackout-on-abortion-pill-study-proves-they-never-cared-about-amber-thurmans-death\/\" target=\"_blank\" rel=\"noreferrer noopener\">after&nbsp;taking<\/a> or <a href=\"https:\/\/thefederalist.com\/2025\/11\/12\/suspended-ohio-doctor-posed-as-ex-wife-to-get-abortion-drugs-then-allegedly-forced-them-on-girlfriend\/\" target=\"_blank\" rel=\"noreferrer noopener\">being<\/a> <a href=\"https:\/\/thefederalist.com\/2025\/08\/11\/man-allegedly-murdered-his-unborn-baby-by-spiking-her-moms-hot-cocoa-with-abortion-drug\/\" target=\"_blank\" rel=\"noreferrer noopener\">force<\/a> <a href=\"https:\/\/thefederalist.com\/2025\/06\/11\/tx-man-arrested-after-allegedly-poisoning-his-girlfriend-murdering-his-child-with-abortion-drug\/\" target=\"_blank\" rel=\"noreferrer noopener\">fed<\/a>&nbsp;<a href=\"https:\/\/thefederalist.com\/2024\/10\/02\/tim-walz-repeats-lie-blaming-pro-lifers-for-woman-killed-by-abortion-pills\/\" target=\"_blank\" rel=\"noreferrer noopener\">abortion pills<\/a>&nbsp;without medical supervision continue to surface alongside studies showing mifepristone is <a href=\"https:\/\/thefederalist.com\/2025\/04\/28\/study-rate-of-serious-or-life-threatening-complications-after-abortion-pill-is-22-times-higher-than-fda-claims\/\" target=\"_blank\" rel=\"noreferrer noopener\">more dangerous than previously thought. <\/a><\/p>\n<p>&ldquo;There is no reason that the FDA couldn&rsquo;t immediately reinstate [mifepristone&rsquo;s] in-person dispensing requirement while at the same time doing a thorough safety review to see if more safeguards need to be put back into place,&rdquo; to wait on the FDA.&rdquo; <\/p>\n<p>&ldquo;They deserve safeguards NOW,&rdquo; she <a href=\"https:\/\/x.com\/marjoriesba?lang=en\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a>.<\/p>\n<p>Kristen Waggoner, President, CEO, and Chief Legal Counsel of Alliance Defending Freedom, encouraged the Trump administration <a href=\"https:\/\/x.com\/KristenWaggoner\/status\/2016173504912031918\" target=\"_blank\" rel=\"noreferrer noopener\">on X<\/a> to &ldquo;stand with Louisiana&mdash;not with abortion extremists like Gavin Newsom and Letitia James.&rdquo; <\/p>\n<p>Louisiana Attorney General Liz Murrill <a href=\"https:\/\/x.com\/AGLizMurrill\/status\/2016566792412365188\" target=\"_blank\" rel=\"noreferrer noopener\">framed the FDA&rsquo;s memo<\/a> as &ldquo;an affront to our sovereignty and the dignity of women and the unborn.&rdquo; <\/p>\n<p>&ldquo;FDA should stand with us for life, not with&nbsp;@CAgovernor&nbsp;and&nbsp;@GovKathyHochul,&rdquo; Murrill wrote. <\/p>\n<p>Mere weeks ago, Murrill warned in a Senate hearing that until the FDA reimposes the mifepristone safeguards stripped away by Biden, &ldquo;Louisiana&rsquo;s efforts to protect mothers and their unborn children and to hold out-of<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/dem-senator-forced-abortions-are-just-part-of-history\/\" title=\"Dem Senator: Forced Abortions Are Just &#039;Part Of History&#039;\">-state abortion pill traffickers accountable<\/a> for the harm they inflict will be all but futile.&rdquo;<\/p>\n<p>A&nbsp;<a href=\"https:\/\/thefederalist.com\/2025\/10\/28\/trumps-trusted-pollster-even-pro-aborts-say-mifepristone-is-dangerous-and-needs-fda-regulation\/\" target=\"_blank\" rel=\"noreferrer noopener\">recent McLaughlin and Associates survey<\/a>&nbsp;found that 71 percent of likely voters approve of the FDA requiring a doctor visit to obtain an abortion drug prescription. Three-in-five respondents even went so far as to agree that &ldquo;chemical abortions are far more dangerous than advertised, and women deserve a doctor&rsquo;s care to prevent serious health complications like hemorrhaging, bleeding, or infections.&rdquo;<\/p>\n<p>Approximately seven in 10 of those surveyed, after agreeing that &ldquo;chemical abortion drugs are used by sexual abusers to cover up rape, exploitation and sex-trafficking,&rdquo; said doctors should also be required to &ldquo;screen for and report signs of coercion or abuse&rdquo; before prescribing mifepristone.<\/p>\n<p>The FDA <a href=\"https:\/\/thefederalist.com\/2025\/12\/10\/fda-head-makary-commits-to-releasing-robust-abortion-pill-review-as-soon-as-it-is-completed\/\" target=\"_blank\" rel=\"noreferrer noopener\">previously failed to answer<\/a> The Federalist&rsquo;s questions about how long the review is estimated to take.
