In an opinion by Judge Allison Rushing, the three-judge panel said the plaintiffs&#8217; claims belong in the U.S. Court of Federal Claims, not district court, and vacated both the preliminary and permanent injunctions that had blocked the administration from freezing the funds.<\/p>\n<p>The panel found the district court &#8220;abused its discretion&#8221; and relied in part on recent Supreme Court emergency orders and related decisions (including the national Institutes of Health matter and a similar California case) that <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/the-state-of-the-conservative-legal-movement-is-strong\/\" title=\"The state of the conservative legal movement is strong\">limited district-court authority<\/a> in <a href=\"https:\/\/amzn.to\/3YuVZYV\" >comparable grant-dispute suits<\/a>. Rejects Bid To Block Biden Eviction Moratorium\">emergency docket<\/a> orders allowing Trump to cut various grants and research funding, which similarly found that district courts did not have jurisdiction to hear the claims.<\/p>\n<p>&ldquo;There is no meaningful difference between the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/federal-appeals-court-hands-texas-a-major-border-win-over-the-biden-administration\/\" title=\"... Win Over the ...\">district court&#038;rsquo<\/a>;s order here and the district court&rsquo;s order in <em>California<\/em>,&rdquo; the appeals court&rsquo;s ruling said, citing a separate but similar case in which a lower court judge was overturned. &ldquo;If the <em>California<\/em> district court lacked jurisdiction to issue its order, it follows that the district court here did as well. Bush, and it marked a rare win for the Trump administration in the Fourth Circuit, which has generally ruled against the Trump administration.<\/p>\n<p>The ruling also marks the latest win for the administration in its legal battles over canceling various environmental, diversity, equity, and inclusion, and other grants issued by the Biden administration.
