Judge Baek Dae-hyun said the decree &#8220;plunged the country into political crisis&#8221; and criticized Yoon for showing no remorse.<\/p>\n<p>This verdict is the first of several expected rulings linked to the martial law case. Yoon still faces a separate,more serious trial on insurrection charges (with a verdict expected in February),and prosecutors have indicated they could seek the death penalty in that case.Other accusations include violating the rights of nine cabinet members and blocking an investigators&#8217; detention warrant.<\/p>\n<p>Background: Yoon narrowly won the presidency in March 2022 and took office in may 2022. After the Dec. 3, 2024 martial law order was universally rebuked by the National Assembly (190-0), he retracted it and apologized. It is the first of an expected four verdicts related to charges against Yoon for his martial law decree.<\/p>\n<p>Yoon still faces a trial over the most serious charge against him on accusations of insurrection, multiple sources <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.aljazeera.com\/news\/2026\/1\/16\/south-korea-court-finds-disgraced-ex-president-guilty-in-martial-law-case\">reported<\/a>. A verdict for these charges in this separate trial is expected some time in February. The Washington Examiner previously <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/world\/4416561\/prosecutors-seek-death-penalty-south-korean-leader-yoon-suk-yeol\/\">reported<\/a> that prosecutors in this case could seek the death penalty.<\/p>\n<p>Yoon also faces other charges related to his <a href=\"https:\/\/amzn.to\/3YuVZYV\" >failed martial law declaration<\/a>, including violating the rights of nine cabinet members and blocking a detention warrant of South Korean investigators, according to <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.wionews.com\/videos\/south-korea-ex-prez-yoon-faces-first-verdict-martial-law-declaration-under-review-1768546287726\">WION<\/a>.<\/p>\n<p>Yoon won South Korea&rsquo;s presidential election on March 9, 2022 by a slim margin, 48.56% to 47.83%. He officially became South Korea&rsquo;s president on May 10, 2022.<\/p>\n<p>&ldquo;I learned a lot while carrying out the campaign, what is needed to be a leader of a country, how to listen carefully to the people,&rdquo; Yoon <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/abcnews.go.com\/International\/south-korea-elects-prosecutor-yoon-suk-yeol-president\/story?id=83343124\">said<\/a> in a speech after winning the election. &ldquo;This election process and competition are all for the people. Election is over now, and we need to be all one for the people and our Republic of Korea.&rdquo;<\/p>\n<p><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/world\/4416561\/prosecutors-seek-death-penalty-south-korean-leader-yoon-suk-yeol\/\"><strong>PROSECUTORS SEEK DEATH PENALTY FOR SOUTH KOREAN LEADER YOON SUK YEOL<\/strong><\/a><\/p>\n<p>Yoon declared martial law in his country on Dec. 3 but it was met with strong opposition in his country and would eventually lead to his demise. The martial law order was unanimously rebuked by South Korea&rsquo;s National Assembly in a <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/news4sanantonio.com\/news\/nation-world\/south-korean-president-lifts-martial-law-decree-after-unanimous-parliament-vote-local-news-near-me-law-international\">190-0 vote<\/a>. Yoon retracted the martial law order shortly thereafter and on Dec. 7, issued an apology to the country for doing so. He would face multiple motions of impeachment later that month.<\/p>\n<p>By Dec. 31, South Korea&rsquo;s Western District Court <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/m-en.yna.co.kr\/view\/AEN20241230010100315?section=national\/politics\">issued an arrest warrant<\/a> for Yoon but he failed to comply, instead remaining in the country&rsquo;s presidential palace. On Jan. 15, he was officially <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.koreatimes.co.kr\/southkorea\/law-crime\/20250115\/south-korean-president-yoon-suk-yeol-detained-for-questioning-over-martial-law-declaration\">arrested and detained<\/a> at Seoul Detention Center in South Korea, being placed in <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.koreatimes.co.kr\/southkorea\/law-crime\/20250119\/south-koreas-president-clad-prison-garb-placed-in-solitary-confinement\">solitary confinement<\/a>.
