Lopez Belloza was detained at Boston Logan airport on Nov. 20 while trying to fly to Texas to see family; a court issued a 72-hour stay on Nov. 21, but she was deported on Nov. 22. Assistant U.S. Attorney Mark sauter called the removal an <a href=\"https:\/\/amzn.to\/3YuVZYV\" >inadvertent mistake adn saeid<\/a> the ICE officer believed the court order no longer applied once she reached Texas; government lawyers also noted her habeas petition was filed after she left. DHS described her as an immigrant ordered removed in 2015; her lawyer says she remains in Honduras. The court labeled her an &#8220;innocent victim,&#8221; and Judge Richard G. However, federal officials deported Lopez Belloza to Honduras on Nov. 22.<\/p>\n<p>Assistant U.S. Attorney Mark Sauter apologized for the deportation despite the court order, <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.nbcboston.com\/news\/local\/trump-administration-says-in-court-that-babson-students-deportation-was-mistake\/3877227\/\">saying<\/a> &ldquo;the government regrets that violation and acknowledges that violation.&rdquo;<\/p>\n<p>&ldquo;On behalf of the government, we want to sincerely apologize,&rdquo; Sauter said, according to the Associated Press. He said the <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"http:\/\/washingtonexaminer.com\/tag\/ICE\">Immigration and Customs Enforcement<\/a> officer who facilitated Lopez Belloza&rsquo;s deportation made &ldquo;an inadvertent mistake,&rdquo; and that the incident was &ldquo;not a willful act of violating a court order.&rdquo;<\/p>\n<p>The <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/trump-administration\/\">Trump administration<\/a> attorneys said in court that the ICE officer mistakenly thought the court order did not apply to Lopez Belloza anymore once she had touched down in Texas on her way out of the country. They also defended the deportation, according to the outlet, saying Lopez Belloza&rsquo;s petition for habeas corpus in Massachusetts was filed after she was already in Texas.<\/p>\n<p>DHS said in a December <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/x.com\/TriciaOhio\/status\/1996770512307888496?s=20\">statement<\/a> that Lopez Belloza is &ldquo;an illegal alien from Honduras&rdquo; who &ldquo;entered the country in 2014 and an immigration judge ordered her removed from the country in 2015.&rdquo;<\/p>\n<p>Lopez Belloza currently remains located in Honduras, <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.nbcboston.com\/news\/local\/trump-administration-says-in-court-that-babson-students-deportation-was-mistake\/3877227\/\">according<\/a> to her lawyer, Todd Pomerleau.<\/p>\n<p>In an electronic clerk&rsquo;s note, the court called Lopez Belloza an &ldquo;innocent victim in this case.&rdquo;<\/p>\n<p>&ldquo;The Government forthrightly acknowledges that it made a mistake and, this incident aside, has a record of complying with stay of removal orders issued by court,&rdquo; the clerk&rsquo;s <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.courtlistener.com\/docket\/71944450\/lopez-belloza-v-hyde\/#entry-34\">note<\/a> reads. <\/p>\n<p>The note announced that the U.S. District Court for the District of Massachusetts &ldquo;is considering means of mediating the parties&rsquo; dispute in a manner that might allow [the] petitioner to return to the country.&rdquo;<\/p>\n<p><strong><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/policy\/immigration\/4417667\/rubio-says-us-cant-return-137-deported-venezuelans-delicate-negotiations-maduros-successor\/\">RUBIO SAYS US CAN&rsquo;T RETURN 137 DEPORTED VENEZUELANS DUE TO &lsquo;DELICATE&rsquo; NEGOTIATIONS WITH MADURO&rsquo;S SUCCESSOR<\/a><\/strong><\/p>\n<p>The note gave several examples of possible means, including &ldquo;through the issuance of a student visa (petitioner has a full scholarship to Babson College), or through the reopening of her removal case and parole or admission back into the country to address the issues.&rdquo;<\/p>\n<p>Federal Judge Richard G. Stearns is presiding over the case.
