Joe Neguse (D-CO), asked a federal judge on Monday to block the <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/department-of-homeland-security\/\">Department of Homeland Security<\/a> from continuing to enforce a policy that restricts federal lawmakers from visiting <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/ice\/\">Immigration and Customs Enforcement<\/a> facilities without advanced notice.<\/p>\n<p>Last week, Secretary of Homeland Security <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/kristi-noem\/\">Kristi Noem<\/a> issued a <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/s3.documentcloud.org\/documents\/26466440\/icepolicy.pdf\">new memo<\/a> that requires lawmakers to <a href=\"https:\/\/amzn.to\/3YuVZYV\" >submit oversight visit requests<\/a> to ICE field offices and detention centers at least seven days in advance. Noem ordered ICE to oversee congressional visits &ldquo;exclusively with money appropriated&rdquo; by President <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/donald-trump\/\">Donald Trump&rsquo;s<\/a> One Big Beautiful Bill Act.<\/p>\n<p>The move is meant to circumvent a court ruling handed down by U.S. District Judge Jia Cobb last month in favor of the same group of House Democrats challenging Noem&rsquo;s revised policy.<\/p>\n<p>&ldquo;Defendants&rsquo; duplicate notice policy is a brazen attempt to nullify the limitations placed on DHS by law in section 527 and to subvert this Court&rsquo;s section 705 stay order,&rdquo; the plaintiffs&rsquo; <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.283200\/gov.uscourts.dcd.283200.40.0.pdf\">court document<\/a> reads.<\/p>\n<p>Section 527 of the DHS appropriations bill grants members of <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/congress\/\">Congress<\/a> the right to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/ethics-investigation-demanded-after-democrats-storm-ice-prison\/\" title=\"Ethics investigation demanded after Democrats storm ... prison\">conduct unannounced oversight visits<\/a> of ICE facilities using congressionally appropriated funds.<\/p>\n<p>Noem argued that the funds being used exclusively through Trump&rsquo;s One Big Beautiful Bill Act, instead of an <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/bob-livingston-the-need-for-regular-order\/\" title=\"Bob Livingston: The Need For Regular Order\">annual appropriations bill<\/a>, frees DHS from apparent Section 527 limitations. The plaintiffs disagreed, accusing the department of disobeying Cobb&rsquo;s prior order.<\/p>\n<p>In a footnote, attorneys for the plaintiffs said that they &ldquo;regret the necessity&rdquo; of the latest court filing but noted they &ldquo;were not made aware of the duplicate notice policy&rdquo; until Saturday, when Noem&rsquo;s memo was made public. By then, it had already been implemented against members of Congress.<\/p>\n<p>The policy prevented three <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/minnesota\/\">Minnesota<\/a> Democrats from gaining full access to an ICE detention facility outside <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/minneapolis\/\">Minneapolis<\/a> on Saturday. Reps. <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/ilhan-omar\/\">Ilhan Omar<\/a> (D-MN), Angie Craig (D-MN), and Kelly Morrison (D-MN) were denied entry to the site after they were briefly allowed into the facility.<\/p>\n<p>ICE officials told the lawmakers they were getting kicked out because funds from the One Big Beautiful Bill Act were being used.<\/p>\n<p>Noem issued the new memo one day after an ICE officer <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/crime\/4411039\/what-to-know-ice-shooting-minneapolis-left-one-woman-dead\/\">fatally shot<\/a> a woman in Minneapolis. The House Democrats who filed Monday&rsquo;s motion noted the timing of the policy in relation to Renee Nicole Good&rsquo;s death.<\/p>\n<p>The plaintiffs are requesting an emergency hearing, where the defendants can provide evidence to explain how the &ldquo;duplicate notice policy&rdquo; complies with Section 527 and the court&rsquo;s prior order.<\/p>\n<p><strong><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/policy\/immigration\/4414580\/kristi-noem-protocol-lawmaker-oversight-ice-facilities-minnesota-shooting\/\">NOEM CHANGES PROTOCOL FOR LAWMAKERS&rsquo; OVERSIGHT OF ICE FACILITIES AFTER MINNESOTA SHOOTING<\/a><\/strong><\/p>\n<p>They noted that annual funding for DHS expires on Jan. 30.<\/p>\n<p>&ldquo;Members of Congress are actively negotiating over the funding of DHS and ICE, including consideration of the scope of and limitations on DHS&rsquo;s funding for the next fiscal year.
