Rep. Anna Paulina Luna, who made the motion, called the post &#8220;doxxing&#8221; and accused Harp of leaking classified facts; the subpoena passed with bipartisan support, including from committee Democrat Rep. Robert Garcia. Luna has referred Harp to the Justice Department and argued the disclosure endangered service members and national security. Harp denies doxxing, says he did not publish highly personal identifiers (though the wifeS first name appeared in his post), and argues the First Amendment protects journalists who publish classified material. In his posts Harp also criticized the operation and referred to Nicol\u00e1s Maduro as the &#8220;rightful president,&#8221; calling the U.S. action a kidnapping; he previously served in the Army Reserve and as an assistant attorney general in Texas. The journalist later claimed X locked his account until he deleted the post, <a href=\"https:\/\/x.com\/sethharpesq\/status\/2008305916048011296?s=20\" target=\"_blank\" rel=\"noopener noreferrer\">according<\/a> to a Monday statement he posted on the social media platform.<\/p>\n<p>The Daily Caller News Foundation is withholding the commander&rsquo;s name and the contents of the his biography which Harp had posted.<\/p>\n<p>Republican Florida Rep. It was reckless, dangerous, and put American lives at risk. The First Amendment does not give anyone a license to expose elite military personnel, compromise operations, or assist our adversaries under the guise of reporting. Congress has a constitutional duty to investigate when national security is endangered, and no one is above oversight.&rdquo;<\/p>\n<p>&ldquo;Seth Harp has also been referred to the Department of Justice for his actions, and I look forward to the findings of the investigation,&rdquo; Luna&rsquo;s statement added.<\/p>\n<p>&ldquo;Putting a service member and their family in danger is dishonorable and feckless,&rdquo; Luna <a href=\"https:\/\/x.com\/RepLuna\/status\/2009048734441546173\">wrote<\/a> on X after the vote, which indeed had strong bipartisan support, including from the committee&rsquo;s top Democrat, California Rep. Robert Garcia, <a href=\"https:\/\/www.washingtonpost.com\/business\/2026\/01\/08\/seth-harp-first-amendment-luna-subpoena\/\" target=\"_blank\" rel=\"noopener noreferrer\">multiple<\/a> <a href=\"https:\/\/www.politico.com\/live-updates\/2026\/01\/07\/congress\/more-epstein-subpoenas-00715597\" target=\"_blank\" rel=\"noopener noreferrer\">outlets<\/a>&nbsp;reported.<\/p>\n<p>In his post, Harp referred to the deposed, captured, and indicted Venezuelan socialist dictator Nicol&aacute;s Maduro as &ldquo;the rightful president&rdquo; of the South American country, and said that President Donald Trump had &ldquo;kidnapped&rdquo; the despot.<\/p>\n<p>The U.S. and the vast majority of its allies considered Maduro an illegitimate leader prior to his removal.<\/p>\n<p>The identities of Special Operations forces, including Delta Force, are heavily protected, and usually classified by the military, according to The Washington Post.<\/p>\n<p>&ldquo;The First Amendment does not give anyone a license to expose elite military personnel, compromise operations, or assist our adversaries under the guise of reporting,&rdquo; the congresswoman said Thursday in a <a href=\"https:\/\/www.washingtonpost.com\/business\/2026\/01\/08\/seth-harp-first-amendment-luna-subpoena\/#:~:text=%E2%80%9CThe%20First%20Amendment,is%20above%20oversight.%E2%80%9D\" target=\"_blank\" rel=\"noopener noreferrer\">statement<\/a> to The Washington Post. &ldquo;Congress has a constitutional duty to investigate when national security is endangered, and no one is above oversight.&rdquo;<\/p>\n<p>Garcia supported Luna&rsquo;s motion after he added an amendment to also subpoena to co-executors of Jeffrey Epstein&rsquo;s estate, Richard Kahn and Darren Indyke. Garcia has led House Democrats in obtaining records directly from the <a href=\"https:\/\/amzn.to\/3YuVZYV\" >deceased child sex trafficker&#038;rsquo<\/a>;s estate rather than the Department of Justice, which has failed to meet the deadline imposed by Congress to release all the Epstein files.<\/p>\n<div class=\"wpds-c-PJLV article-body type-text\" data-qa=\"article-body\">\n<p dir=\"null\" data-apitype=\"text\" data-contentid=\"6XEVTMRWZFDBXGUJH425LYSO4I\" data-el=\"text\">&ldquo;In no way did I &lsquo;doxx&rsquo; the officer,&rdquo; Harp wrote in his Jan. 5 statement posted to social media. &ldquo;I did not post any personally identifying information about him, such as his birthday, social security number, home address, phone number,  address, the names of his family members, or pictures of his house.&rdquo;<\/p>\n<p dir=\"null\" data-apitype=\"text\" data-contentid=\"6XEVTMRWZFDBXGUJH425LYSO4I\" data-el=\"text\">However, the bio Harp posted to X stated the first name of the commander&rsquo;s wife.<\/p>\n<p>&ldquo;Nothing about this should distract from the larger Issue: Delta Force, acting on President Trump&rsquo;s unlawful orders&hellip; invaded Venezuela, killed scores of Venezuelans who posed no threat to the United States, and kidnapped the Venezuelan president, Nicolas Maduro, as well as his wife,&rdquo; Harp added in his statement.<\/p>\n<p class=\"wpds-c-heFNVF wpds-c-heFNVF-iPJLV-css overrideStyles font-copy\" dir=\"null\" data-apitype=\"text\" data-contentid=\"6XEVTMRWZFDBXGUJH425LYSO4I\" data-el=\"text\">&ldquo;The idea of a reporter &lsquo;leaking classified intel&rsquo; is a contradiction in terms,&rdquo; Harp told The Washington Post on Thursday. &ldquo;The First Amendment and ironclad Supreme Court precedent permit journalists to publish classified documents.
