The motion, if approved by Judge Scott McAfee, seeks recovery under a new Georgia law enacted by Gov. Brian Kemp that lets defendants reclaim &#8220;reasonable&#8221; attorney fees and costs when a prosecutor is disqualified and the case is dismissed. The case was dismissed on Nov. 26, 2025, after Willis was disqualified for improperly hiring special prosecutor nathan Wade, with whom she had a romantic relationship. Trump&#8217;s filing was submitted within the law&#8217;s 45-day window (three days before the deadline). Brian Kemp (R-GA) signed into law that allows defendants to recover &ldquo;all reasonable attorney&rsquo;s fees and costs&rdquo; when a prosecutor is disqualified for improper conduct, and the case is later dismissed.&nbsp;<\/p>\n<p>Under the law, each defendant has 45 days from the date of dismissal to file a claim seeking reimbursement for &ldquo;reasonable attorney&rsquo;s fees and costs,&rdquo; meaning Trump&rsquo;s action on Wednesday came just three days before the deadline.&nbsp;<\/p>\n<p>The law was pursued by Georgia Republicans with Trump in mind.
