The law-unique in mandating repeated checks for ammunition purchases-was struck down by both a federal district court and a 9th Circuit three-judge panel, which said it &#8220;meaningfully constrains the right to keep operable arms.&#8221;<\/p>\n<p>In its brief, DOJ argued the requirement was designed to make it difficult for <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/oregon-dem-slammed-after-suggesting-blacks-get-day-off-after-rittenhouse-verdict-everyone-involved-was-white\/\" title=\"Oregon Dem Slammed After Suggesting Blacks Get Day Off After Rittenhouse Verdict: \u2018Everyone Involved Was White\u2019\">lawful gun owners<\/a> to obtain ammunition and thus violates the Second Amendment. The brief highlighted burdens such as fees for each check and a high rate of denials caused by clerical issues (such as, mismatched addresses) rather than evidence of dangerousness. A coalition of Republican-led states filed a supporting brief as well.<\/p>\n<p>The full 9th Circuit will hear the case in march. The article also notes the Supreme Court is soon due to hear Wolford v. Washington Examiner\">law-abiding citizens&#038;rsquo<\/a>; exercise of their Second Amendment rights&mdash;finds no analogue among valid regulatory schemes of the past,&rdquo; the brief continued.<\/p>\n<p>The brief pointed to the fees to perform the background check and the high rejection rate, usually due to simple errors, such as a mismatched address, rather than evidence that someone poses a threat.<\/p>\n<p>&ldquo;When firearms regulations are designed to thwart the right to bear arms, they are unconstitutional, no matter the size or characteristics of the burden they impose,&rdquo; the DOJ brief said.<\/p>\n<p>A coalition of Republican-led states also filed a <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/shared.nrapvf.org\/sharedmedia\/1512154\/2026-rhode-states-amicus.pdf\">brief<\/a> to the 9th Circuit on Monday, arguing that &ldquo;California&rsquo;s intricate and <a href=\"https:\/\/amzn.to\/3YuVZYV\" >elaborate regulatory scheme imposes unique burdens<\/a> on ammunition purchases.<\/p>\n<p><strong><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/4356551\/justice-department-sues-dc-government-ar-15-ban\/\">DOJ SUES DC GOVERNMENT OVER AR-15 BAN<\/a><\/strong><\/p>\n<p>While California&rsquo;s ammunition background check law heads toward arguments before an appeals court, the Supreme Court is scheduled to hear a <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/supreme-court\/3858101\/supreme-court-could-load-up-on-gun-cases-this-term\/\">major gun rights case<\/a> involving a Hawaii law later this month.<\/p>\n<p>In <em>Wolford v. Lopez<\/em>, the justices will hear arguments over whether the <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/hawaii\/\">Aloha State&rsquo;s<\/a> law, which bars handgun owners who have a concealed carry permit from carrying their weapon on private property unless the owner or manager of the property has given the person &ldquo;express authorization to carry a firearm on&nbsp;the property,&rdquo; violates the Second Amendment.
