ICE says Alva Rodriguez previously faced DUI charges in 2020 and 2021, and it will place a detainer once he is formally charged. Arya&#8217;s mother, Jackie Acencio, recounted realizing her daughter had died and expressed grief and anger toward the driver. The family had been moving when the collision occurred; a GoFundMe has been set up to assist them. He was ultimately served with a notice to appear before an <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/breaking-biden-unveils-immigration-bill-leftwing-activists-call-for-end-to-filibuster-to-ram-it-through\/\" title=\"BREAKING: Biden Unveils ... Bill, Leftwing Activists Call For End To Filibuster To Ram It Through\">immigration judge<\/a> and released into the U.S.<\/p>\n<p>The Guatemalan national was then charged with two different DUIs, once on Sept. 6, 2020, and again on April 7, 2021, according to ICE. An immigration judge ordered Alva Rodriguez to be removed from the country on Mar. 16, 2023, but he failed to leave.<\/p>\n<p>&ldquo;ICE San Diego is tracking the case closely,&rdquo; the agency stated <a href=\"https:\/\/x.com\/EROSanDiego\/status\/1996333166379094092\" target=\"_blank\" rel=\"noopener noreferrer\">in December<\/a>, adding that it would be placing a detainer on Alva Rodriguez the moment he&rsquo;s formally charged. &ldquo;We will continue to pursue and remove dangerous individuals who threaten the safety of our community.&rdquo;<\/p>\n<p>Oscar Cruz Acencio, Arya&rsquo;s dad and a U.S. Marine, had one of his legs amputated above the knee and is currently recovering from traumatic brain injuries at a San Diego hospital. The family was in the process of moving, carrying all of their belongings in their vehicle, when Alva Rodriguez allegedly struck them in a head-on collision on Nov. 30, <a href=\"https:\/\/www.gofundme.com\/f\/support-the-cruzacencio-family-after-a-tragic-accident\" target=\"_blank\" rel=\"noopener noreferrer\">according<\/a> to a GoFundMe for the family.<\/p>\n<p>&ldquo;We didn&rsquo;t deserve it. Nobody does,&rdquo; Jackie said to Fox News. &ldquo;I care very deeply for these people that want to have a better life, I really do, but I have no sympathy for the driver that hit me and my family.&rdquo;<\/p>\n<p>The entire state of California is considered a haven for illegal migrants, <a href=\"https:\/\/www.justice.gov\/ag\/us-sanctuary-jurisdiction-list-following-executive-order-14287-protecting-american-communities\" target=\"_blank\" rel=\"noopener noreferrer\">according<\/a> to a running list of <a href=\"https:\/\/amzn.to\/3YuVZYV\" >sanctuary jurisdictions published<\/a> by the Department of Justice.
