The complaint says this policy lets those students pay roughly $40,000 less than out-of-state Americans &#8211; citing the University of Virginia&#8217;s 2025-2026 undergraduate tuition of $23,897 for in-state versus $62,923 for out-of-state. The DOJ contends federal statute forbids states from <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/doj-sues-illinois-over-laws-granting-in-state-college-benefits-to-illegal-immigrants\/\" title=\"DOJ sues Illinois over laws granting in... college benefits to illegal immigrants\">offering postsecondary education benefits<\/a> on the basis of residence to aliens who are not lawfully present if a U.S. citizen would be ineligible, adn asks the court to enjoin the conflicting Virginia code provisions. The filing follows other legal actions against states over similar policies, including a case in which Texas worked with the DOJ to overturn its own in-state tuition rule. This policy therefore allows illegals to access benefits not available to most other Americans, making it &ldquo;not only wrong but illegal,&rdquo; the Justice Department stated.<\/p>\n<p>&ldquo;Federal law prohibits States from providing aliens who are not lawfully present in the United States with any postsecondary education benefit that is denied to U.S. citizens,&rdquo; the court documents read. &ldquo;There are no exceptions. Virginia violates it nonetheless. This court should put an end to this and permanently enjoin the enforcement of provisions of the Virginia Education Code that directly conflict with federal immigration law.&rdquo;<\/p>\n<p>The classification means illegal immigrants are able to pay nearly $40,000 less than Americans who reside in another state.
