A three-judge panel on the 1st Circuit found the Trump governance likely to prevail, concluding the provision is lawful and not ambiguous; the case was brought by Democrat-led states having mentioned that they were not given clear notice of the change. This is the second time Talwani&#8217;s injunction on the same provision has been stayed or vacated by the appeals court (a separate Planned Parenthood challenge produced a similar result). Briefing in Pennsylvania Lawsuit to Flip the Election\">lower court&#038;rsquo<\/a>;s ruling halting a provision of the One Big Beautiful Bill Act that prevents&nbsp;<a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/medicaid\/\">Medicaid<\/a>&nbsp;reimbursements to&nbsp;<a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/abortion\/\">abortion<\/a>&nbsp;providers, marking the second case in which U.S. District Judge Indira Talwani has been overruled on the same matter.<\/p>\n<p>The three-judge panel on the U.S. Court of Appeals for the 1st Circuit <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.ca1.53585\/gov.uscourts.ca1.53585.00108385119.0_1.pdf\">found<\/a> that the Trump administration sufficiently showed it was likely to prevail on its arguments that the provision of the bill was lawful and not ambiguous. Fast-Tracks Challenges to Texas Abortion Law\">appeals court issued<\/a> a temporary pause to Talwani&rsquo;s ruling in a case <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3884533\/appeals-court-overruled-by-supreme-court-on-all-its-trump-cases-weighs-obbb-abortion-challenge\/\">brought by Planned Parenthood<\/a> challenging the legality of the same provision on different grounds.<\/p>\n<p>In both cases, the appeals court panels later issued firm rulings siding with the Trump administration and overturning Talwani&rsquo;s rulings, which both had attempted to prevent the One Big Beautiful Bill Act&rsquo;s defunding of abortion providers. In the Planned Parenthood case, the appeals court panel vacated Talwani&rsquo;s injunction blocking the provision and remanded the case back to her court for further proceedings.<\/p>\n<p>Talwani, an Obama appointee to the U.S. District Court for the District of Massachusetts, has ruled against the Trump administration in <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/the-latest-from-ukraine\/\" title=\"The Latest From Ukraine\">multiple high-profile cases<\/a> this year, including lawsuits over the administration&rsquo;s bid to end mass parole for migrants and funding for the Supplemental Nutrition Assistance Program during the government shutdown.<\/p>\n<p>The rulings by the 1st Circuit siding with the Trump administration in the abortion funding cases are noteworthy, as the liberal-leaning appeals court has <a href=\"https:\/\/amzn.to\/3YuVZYV\" >largely upheld lower court orders<\/a> that blocked the Trump administration&rsquo;s agenda.<\/p>\n<p><strong><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/supreme-court\/3970800\/trump-historic-year-supreme-court-victories\/\">TRUMP&rsquo;S HISTORIC YEAR OF SUPREME COURT VICTORIES<\/a><\/strong><\/p>\n<p>At the Supreme Court&rsquo;s emergency docket this year, the 1st Circuit has been reversed by the high court in every case the Trump administration has brought contesting its rulings.<\/p>\n<p>The provision blocking abortion providers from Medicaid reimbursements included in the One Big Beautiful Bill Act is only slated to apply for one year, but was <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/policy\/healthcare\/3452217\/trump-megabill-defunds-planned-parenthood\/\">a significant win for anti-abortion activists<\/a>, who have argued that the reimbursements indirectly help abortion providers fund the procedure.
