Casey Pitts said ICE failed to show a logical connection between its stated rationales and the expansion of civil arrests and failed to consider the policy&#8217;s &#8220;chilling effect&#8221; on asylum-seekers and other migrants attending immigration court. The ruling, issued Dec. 24, applies to ICE&#8217;s San francisco area of responsibility and creates a split with a September decision from the Southern District of New York that upheld the policy. That split could prompt appeals and possibly Supreme Court review. In September, U.S. District Judge P. Kevin Castel <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.nysd.646893\/gov.uscourts.nysd.646893.51.0.pdf\">ruled<\/a> that the ICE courthouse arrest policies did follow proper federal rulemaking procedure and were not arbitrary or capricious.<\/p>\n<p>Pitts acknowledged the September ruling in the New York federal court in his Wednesday ruling, disagreeing with it and saying that ICE&rsquo;s &ldquo;bare acknowledgement of the 2021 guidance&rsquo;s existence and rescission does not constitute reasoned decisionmaking.&rdquo;<\/p>\n<p>The split between two federal courts could provide a reason for review at the <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/section\/news\/supreme-court\/\">Supreme Court<\/a>, should these two cases and others make their way through federal appeals courts.<\/p>\n<p>The Christmas Eve ruling by Pitts marks the latest instance of courthouse immigration arrests being barred in Democratic-controlled jurisdictions. New York state and Cook County, <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/illinois\/\">Illinois<\/a>, instituted policies barring arrests at local courthouses, to the frustration of the Trump administration.<\/p>\n<p><strong><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/supreme-court\/4356987\/supreme-court-denies-trump-bid-deploy-national-guard-chicago\/\">SUPREME COURT DENIES TRUMP BID TO DEPLOY NATIONAL GUARD TO CHICAGO<\/a><\/strong><\/p>\n<p>The administration sued over the New York law, claiming it violates the supremacy clause by <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/judge-tosses-trump-lawsuit-over-ny-law-blocking-immigration-arrests-at-courts\/\" title=\"... tosses Trump ...suit over NY ... blocking immigration ... at ...s\">unlawfully obstructing federal law enforcement operations<\/a>. A federal judge <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3890352\/federal-judge-backs-new-york-law-blocking-immigration-arrests-local-courts\/\">tossed<\/a> the lawsuit in November, finding the law was constitutional.<\/p>\n<p>The <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3853316\/chicago-new-york-set-up-legal-clash-over-where-ice-can-arrest-illegal-immigrants\/\">Cook County policy<\/a> has not been challenged by the administration in court, but officials in the <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/department-of-homeland-security\/\">Department of Homeland Security<\/a> have publicly criticized policies that block courthouse arrests.<\/p>\n<\/div>\n<\/div>\n<div class=\"tdb-block-inner td-fix-index\"><\/div>\n<div class=\"tdb-block-inner td-fix-index\"><\/div>\n<p><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Judge halts ICE courthouse arrests in N.
