The suit covered the $1 billion Homeland Security Grant Programme; FEMA had previously allocated $250 million to the 12 plaintiff jurisdictions, and New York reportedly lost more than $100 million (about 77%) of its FEMA funds.<\/p>\n<p>The <a href=\"https:\/\/amzn.to\/3YuVZYV\" >restored funds support border security<\/a> with Canada, protection of critical infrastructure, and local emergency services such as the NYPD and FDNY. DHS reallocated that funding in September, prompting James and others to <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/ag.ny.gov\/press-release\/2025\/attorney-general-james-takes-action-protect-critical-national-security-and\">file an additional lawsuit<\/a> after winning a previous case.<\/p>\n<p>&ldquo;We won our case against [DHS], restoring funding for lifesaving anti-terrorism and emergency response programs,&rdquo; she <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/x.com\/NewYorkStateAG\/status\/2003492974169296932?s=20\">said <\/a>on X. &ldquo;This is a major victory for our law enforcement and local leaders who depend on these funds to keep New Yorkers safe.&rdquo;<\/p>\n<p>U.S. District Judge Mary McElroy, who was appointed by President <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/donald-trump\/\">Donald Trump<\/a> in 2019, sided with the plaintiffs in this case. She concluded that the funding set aside for counterterrorism and law enforcement programs was indeed &ldquo;vital.&rdquo; As a result, DHS was ordered to return the money originally allocated to the plaintiff states.<\/p>\n<p>In her ruling issued Monday, the Rhode Island judge referenced this month&rsquo;s <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/crime\/3917647\/what-we-know-brown-university-shooting\/\">shooting at Brown University<\/a> as a reason why the money would be essential in responding to an emergency.<\/p>\n<p>&ldquo;To hold hostage funding for programs like these based solely on what appear to be defendants&rsquo; political whims is unconscionable and, at least here, unlawful,&rdquo; she wrote.<\/p>\n<p>Joining New York in the lawsuit were California, Connecticut, Delaware, Illinois, Massachusetts, Minnesota, New Jersey, Rhode Island, Vermont, Washington, and the District of Columbia.<\/p>\n<p>FEMA previously granted $250 million to the 12 plaintiff states. New York lost more than $100 million, or 77%, of its FEMA funds, James said in a <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/ag.ny.gov\/press-release\/2025\/attorney-general-james-wins-case-restore-funding-lifesaving-anti-terrorism-and\">press release<\/a>.<\/p>\n<p>The funding in question helps strengthen security along the border between New York and Canada and protect critical infrastructure in the state from possible attacks, her office said. The New York City Police Department and the New York City Fire Department also benefit from the allocated funds.<\/p>\n<p><strong><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/campaigns\/state\/4355485\/mamdani-inauguration-bernie-sanders-letitia-james\/\">NYC MAYOR-ELECT MAMDANI TO BE SWORN IN BY BERNIE SANDERS AND LETITIA JAMES<\/a><\/strong><\/p>\n<p>Other attorneys general joined James in celebrating their win this week.<\/p>\n<p>&ldquo;I&rsquo;m pleased with the court&rsquo;s ruling.
