U.S. District Judge roger Benitez sided with two teachers, Elizabeth Mirabelli and Lori West, who sued in 2023 after being told to withhold such information or face retaliation. Benitez rejected the state&#8217;s argument that the policy was necessary to prevent bullying, saying parental notification rights cannot be overridden by that aim. Bush, also rejected California officials&rsquo; arguments that the policy is needed to &ldquo;prevent bullying and harassment.&rdquo;<\/p>\n<p>&ldquo;Preventing student bullying and harassment in school is a laudable goal. The problem is that the parent exclusion policies seem to presume that it is the parents that will be the harassers from whom students need to be protected,&rdquo; Benitez said, noting that regardless &ldquo;such a policy cannot be implemented at the expense of parents&rsquo; constitutional rights.&rdquo;<\/p>\n<p>&ldquo;California&rsquo;s education policymakers may be experts on primary and secondary education but they would not receive top grades as students of Constitutional Law,&rdquo; Benitez said.<\/p>\n<p>The ruling also included a <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.casd.757886\/gov.uscourts.casd.757886.308.0.pdf\">class-wide permanent injunction<\/a> preventing the policy from being implemented, instead <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/colorado-to-pay-1-5-million-for-stifling-web-designers-free-speech-washington-examiner\/\" title=\"Colorado to pay .5 million for stifling web designer\u2019s free speech - Washington Examiner\">requiring state officials<\/a> to include a statement in a &ldquo;prominent place&rdquo; of state training materials asserting parents&rsquo; right to be informed of their child&rsquo;s &ldquo;gender incongruence.&rdquo;<\/p>\n<p>&ldquo;We loved our jobs, our students, and the school communities we served,&rdquo; Mirabelli and West said in a joint statement Monday. &ldquo;But we were forced into an impossible position when <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/school-demands-117k-for-curriculum-of-teacher-who-cheered-kirk-death\/\" title=\"... We are so thankful that this chapter is finally closed and that justice has prevailed,&rdquo; the two teachers said.<\/p>\n<p><strong><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3877805\/appeals-court-allows-texas-law-banning-children-from-drag-shows\/\">APPEALS COURT ALLOWS ENFORCEMENT OF TEXAS LAW BANNING CHILDREN FROM DRAG SHOWS<\/a><\/strong><\/p>\n<p>California officials could appeal the case to the U.S. Court of Appeals for the 9th Circuit.<\/p>\n<p>Parental rights have been a hot-button matter in federal courts in recent years, reaching the Supreme Court earlier this year when the justices <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/supreme-court\/3455080\/mahmoud-v-taylor-supreme-court-parents-right-opt-kids-out-lgbt-books\/\">ruled parents should be allowed<\/a> to opt their children out of LGBT books and curriculum in schools.
